Photo Radar ticket....can I fight it? - Click HERE for Original Thread

So I opened up my mail this morning to find out I was charged $100 and some odd dollars by photo radar. The ticket came with a picture of my liscence plate and I admit I am guilty.

The thing is I was only doing 61km in a 50km for fucks sake...yes it's STILL over the speed limit but is there anyway to fight this on my own? No points are being deducted as they can't identify the driver btw...

I'm pretty sure you can't fight photo radar... Not only that but you admitted that you were guilty. Buck up, pay the fine and don't worry about it. Just think, at least there are no demerits.

BTW I've only seen one person fight a ticket and win. Mainly because the picture was of a vehicle he didn't own in a city he wasn't in, with plates that were stolen off of his truck.

I got a Photo radar ticket and I went to the Crown Prosecuter and I said that I wasn't speeding and there must have been a mistake because another car beside me was speeding. I set up a court date and then I got a letter in the mail saying they dropped the charges. So I dsay go fight it and see what happens.

On what basis would he fight it, he already admitted he was speeding, the only thing i can think of is was the speed correct or not.

They even admit all their "defence" does is waste taxpayer money.

Great, first my money goes to young drivers, now it goes to stupid ones who speed and have too much time on their hands to go to court.

so what is the speed that photo radar kicks in? i heard it was 15km over the limit? but i guess that is wrong considering s2000 was only goign 11 over

Yes it's "illegal" but do be dinged over $100 for what EVERYONE does is ridiculous...
I will fight this ticket if anything to have the fine reduced.

The most restrained response I can think of is, DONT SPEED then. Why is it that people who get caught speeding and know they are speeding at the time then complain about the injustice of the system. In some places this may be justified ie: Whitemud etc. but otherwise if you're going to speed be vigilant in watching out for photoradar or laser. Getting caught by photoradar means IMHO you werent really observing the road ahead of you. If you are on an unfamiliar road, dont speed. You just never know where they may be hiding. Also by speeding I'm not referring to the excessive like 20 or more over the speed limit.

Stupid for 2 reasons:
1) If you're paying attention to the road, how the hell do you miss the van?
2) You want to waste MY TAX DOLLARS so that you can get away with speeding in a place where there are obviously concerns over pedestrian safety (Hence the 50 zone)

Do I need to come up with more?

And how the hell can you get it reduced below $100? Is there even a fine for anything that's under $100 anymore?

You don't just have to just watch for the van. Photo radar is supposed to be posted by a sign in advance of the radar "target area". Next time you see the photo radar sign on the side of the road look for a likely radar spot within the next kilometer. They rotate around these target zones. I have heard of them operating outside these signed zones but I have never seen it.

Of course conventional radar or laser radar using the manual ticket writing method can be anywhere, but IMO their use has gone down dramatically since photo radar became popular with the city.

They're getting pretty inventive (not quite as inventive as St Albert RCMP though) with where they place them. I almost missed one on the weekend going north on Wayne Gretzky just after the Hans Moellman Bridge. They were parked behind the little safety wall beside the bridge so all you could see was the top of the van poking out. I'm sure they caught quite a few people to since it 50 on that stretch and most people haul ass on their way to the Yellowhead.

Here are the fines for speeding that are still under $100. Have I ever charged someone for 1 km over the speed limit ... not even close. These amounts are sometimes used when the officer decides to give the violator a break w/ a lesser fine. What some officers are finding though is if a break is given roadside, the violator is still attending the "First Appearance Centre" to get a further break. That's not the point of giving someone a break - I believe the term is "Looking a gift horse in the mouth".

I've heard of people on the base getting pulled over for going 2km over the limit, so it can happen. Although I'm sure if it was taken to court it would get tossed. Then again give the officer a reason and i'm sure they will find something else to nail you with. My policy is always be polite and respectful when dealing with police.

Your tax dollars?? Thats the dumbest fucking thing i have ever heard. i fucking hate it when people say stupid shit like that.

thats like walking into a into a store and getting into an argument with a employee and saying i pay your wages.

if u wanna bitch about tax dollars there are way bigger things that waste alot more of YOUR tax money. go bitch at that.

Dumbest fucking thing? Obviously you don't pay much in tax...

Do you want to pay more in taxes because people adopt this sort of policy - "Might as well fight it, at least it'll cost them money". Where's the taking responsibility for your actions?

Why should the city/taxpayers have to pay for people who can't grow up and accept the consequences for the actions they've done? Is that too much to ask?
