Well,

2 nights ago i finally get my winter car on the road, and some jerk-off decides to run a stop sign and sideswipes clip the rear of my car, smashing the bumper, tailight, rebar, and putting two big dents. He admitted fault and i got all his information.

I have a witness, i have insurance on the car(new pink slip), etc. BUT, i didnt have registration on the vehicle at the time since i got there when it closed(registries) and the accident happened right after. I did have my old registration, and old pink slip from my summer car, and the plate was good till 06/2005.

We were going to settle without going through insurance, but this guy isnt willing to pay me a penny(he says he is broke, and he can pay me with "payments"-no thanks) and i have damage quotes up to $1700.

Should i continue to go through insurance, given the circumstances?

Do it, i believe there is a X amount of time when switching cars/plates.

not having registration is a huge deal, and I m pretty sure you have a grace period to get it.

now if it was no insurance you where driving with then you would have a problem.

by the sounds of this guy I would go through insurance as he will probably give you one or to payments and then you would never hear from him again. And if you go outside the insurance you dont have anything to go after him with if he screws you

It is irrelevant to the insurance company if your car is registered at the time of the accident. This plays no role as to how they determine who is at fault in this sort of circumstance (I mean, if both parties were disputing who was at fault and there were not witnesses, your integrity could be in doubt if they find out you had no registration. However that's not the case here).

It is relevant to the police - and you may be ticketed accordingly (Since you'll be obviously going to the police if you go through the insurance).

But I don't know how they could ticket you any worse than driving without registration (400-500 ticket I believe?).

If you've purchased the car within the past few (Is it 10 or 14?) days you can get away without registering it for that period.


Bottom line - suck it up and go to the police. Remember - it's up to the officer whether you'll get a ticket, and he may be sympathetic. Don't put up with that bullshit of "...I'll make payments..." because he won't.

I went to the police and filed my claim.

Unfornuatley, my car is a writeoff as the value of the car is less than what it costs to fix it($1300-$1700 damage). And thats just for a bumper and a tailight anda a dent. I only asked $450 for everything without going to insurance.

Now, the dude ran a stop sign, hit me, attempted to take off(he got 75-100ft away and hit the ditch), and is driving with a expired drivers licence. Im sure this alone adds up much more than $450 in fines(i have witnesses for it all too)..

What a tard :rolleyes:

Haha, I swear Steve with the black 240 must have hit you. It sounds exactly like something he would do. On the other hand, are you just gonna keep the car and take the money? Or are you going to be purchasing another ride? I just have to state that you have some seriously bad luck dude, between you and Andy with the B18B Civic, I don't know who has it worse.

Some old guy in a 86 gmc pickup truck hit me.

Id love to keep the car, but, since the book value on the car is $600, and damage is $1700 im not sure whats going to happen.

Accidents are a fucking hassle. Its bullshit. Oh well, at least your getting it resolved and hopefully, a new winter shit kicker out of it.

as far as the cops go, if anyone asks, you sold your old car and transfered the plate over to your beater until you could find time to get the registration transferred. That's all prefectly legal, as long as you DON"T still own the original vehicle, you can use the plate. I think they give you 2weeks after the date you bought the new car.

as for insurance you can probably do what I did when my integra was stolen, it got t-boned and they looked at it and said it's a write off, not worth it to fix, so they offered either:

- the book value($4000) + GST and they take the car
or
- the book value - (12.5% salvage fee) and I keep the car,

i choose to keep my car of course, then I called them and asked If they could waive the write-0ff flag, my argument was that the car was mechanically sound prior to the accident, and since all the damages are superficial, it's still mechanically sound and doesn't need to be flagged as a salvage vehicle.

well it worked, they waived the write-off flag, i kept my car and insurance cut me a check for $3600, i ended up getting everything fixed and a colour change for just under $3200. I didn't need an inspection or anything.

My adjuster said that's the first time she's ever seen the write-off flag waived, and usually the inspectors are extremely picky, so it might take some arguing and persuading on your end.

Well, i have a situation now.

I still want to keep the car, the damages are superficial(two dents, broken tailight and a bumper). Nothing i cant pick up at kar bashers and be on my way.

Book value is $600-$1000 for it, i got a really good deal on it just less than book. Now, i dont have the time(i go to school 7am-10pm almost every weeknight), nor patience to look for a $600 beater. The car is perfectly fine, zero frame damage, just cosmetic.

Will his insurance company charge him with a accident, if i dont go through his insurnace company to pay out for my car? I dont want to lose my car, but i want to see this guy pay far his actions.

If you don't go through his insurance, as far as they are concerned there was no accident.

It sounds like if you want any money (As he said he'll make payments - yeah right) you'll have to bite the bullet and go through insurance.

It's up to the appraiser/adjustor you get whether you vehicle is written off, talk nicely, and see what you can do. Of course, if the vehicle doesn't belong on the road, he'll write if off.
