How long after an accident happens must a party a fault report the incident to their insurance?
I got rear ended on Sept. 24/04. Damages were under $1,000 so no police report had to be filed. I informed my insurace company with the details of the driver who hit me. My insurance company calls the other party's insurance and they are told that they can get a hold of him because his phone is not inservice. Now inorder for me to get my car fixed I first have to pay a deductable of $500 until his insurance company can get a statement saying he's at fault.
This sucks because I might have to wait awhile before I can get my car fixed cuz I don't have the $500 deductable to pay at first. Can the police contact this person who hit me and let him know to file a report with his insurance company?
What can I do so I can speed the process up and get my car fixed?

| maybe get a more expensive place to show that repairs are over $1k and file the police report? |

I'm sur eyou can file the police report even if damage is under 1000 - as the police officer has no way of knowing. |

| You can file a police report if it's under $1000 I did it just last week. It was being considered a hit and run but the car that hit me was left against my car. The persons car is still impounded and I still have't gotten my copy of the report because the other person hadn't gone back to the Police with her insurance. Looks like I might be bitting it myself. |

You'll just end up waiting until the person is formally charged and a statement is made. As long as the person has insurance, it'll all work out in the end....
A guy here at work had his car hit (Along with 17 others) one night. And he had to pay his deductable and was told that if they find the individual, then they'll get his insurance company to give it back.
Turns out it was a kid that wasn't insured, so if he wants his deductable he has to go through small claims.... |

| I always thought a bodyshop wouldnt fix your vehicle if it was in an accident if it didnt have the accident sticker on it from the police. No matter how small the amount is. |

Depends on the shop.
They aren't supposed to, but then again, a lot will do anything for some cash under the table.
As well, if you put the parts on yourself and get the shop to paint it, that route is perfectly lega. |

| i just got read ended yesterday, i thought the damage was under $1000 but i went to get a quote n they said i need a police repport, so i got that window sticker thingy, got the estimet, $2798 :( i didn't want to go through insurance but now i might have to, will my insurance go up if it wasn't my fault? so ya u should just go fill a police report, i took about 15 mins for me today |

If the other party is 100% at fault, then no, your insurance will not go up.
If you and the other party split fault, or you are declared completely at fault, then yes your insurance will go up.
If you have a large number of not at fault claims, you may be moved to a different classification though, so be aware of that.
Remember - when it's not your fault going through insurance is typically a good thing. You'll get a rental car and a guarentee the work will be done right. |

If you are not at fault and there is only 1 other person involved, go through your insurance company. If you are not at fault and there are more than 1 other person at fault, go through your insurance company...BUT it will cost you more right now, because the insurance companies have to decide how much at fault they are. So a rental car would be out of your pocket. Then just bill them for the %age they agreed to. This can take up to amonth but just remember to keep all your expense reciepts. You will get it all back, it will just take more time. |
