So I was at the University and this old guy decides to cross the road in front of me.
Here is the situation, he is crossing right in the middle of the block, no marked crosswalk, there are marked crosswalks on either side of him about a 10 second walk. He gets in fornt of me and forces me to stop. He argues with me that "This is a corner" to which I reply "This isn't a marked crosswalk"
The only corner I can see is the exit to a parkade to my left, where the guy was crossing. He was using that as a corner and sticking his hand out indicating he was crossing, but if it wasn't a marked crosswalk would this be considered Jaywalking or not?. |

Both the cities of Edmonton and Calgary have Jay Walking bylaws, which prohibit pedestrians from crossing roadways anywhere outside of intersections.
Know that a lane access is considered an intersection under law in regards to viable pedestrian crossing locations. A private parkade access is not.
Whether there is a marked crosswalk at an intersection or not is immaterial.
Outside of Edmonton and Calgary, the Traffic Safety Act applies, which allows for pedestrians to cross a roadway anywhere.
The legalities of who's in the right vary as well, as in Edmonton, the pedestrian, once they have their foot on the asphalt, has the right of way (within a valid crosswalk location) over traffic. So long as they're on the road, you're to give way to them. Per the TSA though, for such municipalities as Sherwood Park, St. Albert, etc... the pedestrian may only cross when it's safe to do so, and must proceed in as expedient a manner as possible, so as not to hold up traffic.
So, in your specific case, yes, he was jay walking, and therefore in the wrong. |

| in the TSA do they use the wording Valid Crosswalk or marked crosswalk? There would be a big difference depending on the wording. |

Check out Sections 90 to 104 of the Use Of Highway & Rules Of Road Regs to see what it says about pedestrians.

| I usually will let people cross wherever they want.. but if there not at a intersection I usually rev my engine at them as they are crossing and then as they are across the middle of the road I leave a patch directly behind them.. Just because it usually pisses me off.. Its one of the reasons I stopped driving down the busy part of whyte ave. |
