Process of Fighting a Ticket - Click HERE for Original Thread

92_J
Yesterday at 5pm, rush hour traffic, Gretzky Drive and just between 118 Ave and 112 Ave I got pulled over by an unmarked Traffic car. He was way ahead of me and I guess he got me going 105km/h in an 80km/h on "Roaming Rader" from behind. So he waits for me too pass and pulls me over. I could go on and bitch about how I was only going 90-92 KM/h and how it was rush hour and I was going along with the traffic flow. So I get the ticket, $150 bones and 3 demerits. But the officer who wrote the ticket screwed up on the ticket. He checked off that I am an adult when I am still a youth (17).

1. Do I have a strong case?
2. Whats the process I go through to fight it?
3. How will this effect my insurance which just went down!?

RSN CRX
Go to justice of the peace downtown and they will probably "squash" the ticket for you. However, they will brobably say that the officer has 6 months to issue another one, which they usually don't.

TrevorK
If you're absolutely sure you were going 90-92KM/H and the officer clocked you @ 105KM/H, I'd definetely get your speedo tested.

Fulblown Motorsports' parent company can do this for you, for ~$30 - which is well worth it to avoid this hassle again.

Mustard
don't try and get out of the ticket with the age thing... so help me god if you go in there saying "i'm not adult... i'm kid, no tickee for little 'ol me.... "

get your speedo checked so you don't have to worry again, and goto the Court date and talk to crown prosecuter... he's a dick... but you will more then likely get a reduction.
They seem to give them away like haloween candy. A 10km/h or 1 step on the fine ladder reduction is pretty common.

as for your insurace... is it your first ticket?
i'm guessing yes. Don't worry TOO much about it, especially if you get it reduced... Don't get anymore, of course... but it shouldn't be a problem. I had a FAR worse first ticket then that and i havn't seen any changes.

Thats not what Im saying....the officer checked off on the ticket that I am an adult...when im a youth...

Mustard
right, but it would seem like you're only pointing that out because you're hoping it will be shown as an Error, getting you out of the ticket....

It's a beef of mine.

If the officer cant write a ticket correctly...what else can't he do?...that the way I see it...

He can clock you speeding.

Which you don't deny what you were doing.

Why not take responsibility for your actions?

Honestly now, you wouldn't do anything to try to get out of a ticket or even get it reduced? Probably if I had money coming out of my ass then I wouldn't bother with it but most of us don't.

seriously send your ticket to "tickets" i gaurantee you will get no demerits and maybe a reduction, but at least you won't get any demerits..
and the fuckers gave me a $350 ticket cause my license was "defaced" so don't put anything on your license, or if a friend puts a marking on it, get rid of it. it was bullshit

No.

It's not about the money aspect - it's about the ticket being something to learn from. If you weasel out of the ticket, you've learned that next time you speed, it's OK because you can get it reduced to a registered owners ticket and pay a $100 fine.

However if you suck it up, and pay the fine, it further reinforces that you need to perhaps pay more attention to your speedometer, more attention to your surroundings, etc, etc....

Just phone tickets they are the best way to "Weasel" your way out of a ticket. If i get a ticket , im fine with paying the outrageous amount that is on the ticket but f#ck, you get a $400 stunting ticket and then have to live with inflated insurance rate for 3 or 4 years. In the end that tickets ends costing 5 or 6 times what the oiginal ticket did. Thats what i dont agree with.

Canada and the US are 2 of very few countries in the world that have it so that tickets affect your insurance.

Why shouldn't tickets reflect on your insurance?

Wouldn't you say that, in general, someone who gets a lot of tickets is a "poor driver"?

Because a $400 ticket shouldnt cost you 3 or 4 grand in the long run. Even though i went through a lawayer with my stunting ticket and didnt get demmerits I LEARNED MY LESSON.

European countries dont have tickets that effect their insurance and i can vouch that there are alot better drivers there than here.

Most people who are bad drivers are so because they cant drive properly IE; they cut people off without knowing it, grab the wheel with both hands as if the car is controlling them, are not aware of what is going on around them , and dont drive defensivly.

I considered myself an average driver thats knows the limits of my car and am aware of what is going on around me as i drive. If i have to make an aggressive manouver on the road to avoid a potential accident i know what to do and i know how my car will react. Doing donuts, drifting, powersliding what have you, do help you to find out what the limits of your car are and how it reacts when when you go past the limit, or how it feels when your your reaching the limits!

If the ticket doesn't have any bite to it people will just keep ignoring the rules.

I'm sure if you could go back and scan previous posts here you'd find a lot of posters who brag about how many demerits they have and it's obvious it hasn't changed their driving habits.

You may have learned, but most people don't without doing it the hard way.

Don't European countries have stricter licensing - which would easily explain why they are better drivers.

Nothing wrong with testing out the limits of your car provided it's in a safe and controlled environment.

Yes and its very expensive and time consuming. I think if their sysyem was applied here 60+% of the people whom have licenses wouldnt have them. They are tested with a manual car also and one of the test includes finding the friction point on a steep road way.

CJDP
i guess if you can't get up a steep hill, you shouldn't be able to drive

Call Mr. Tachograph Ltd. we can do a distance check and let you know if your speed is off. If it is we can provide you with a legal document detailing how much its is off.

In many cases we find that a ticket is issued for faulty equipment in substitute for the speeding ticket.

THIS IS NOT A FAILSAFE, please fix your speedo if it is out!

Thanks
