OK so since this months already been shitting on me why not some more eh, alright friday night me and three friends r leaving hudsons tap house on whyte i'm dd as usual driving my buddies car, its around 2.30 so we get to the car and start on our way to McD's. Anyway i'm driving down whyte east and b/c its closing time everyone is on the street hailing cabs so i'm driving about 40ish watching 4 ppl, and as we get closer to the tracks theres a few ppl in the middle of my lane(R) i slow done they move maybe a step towards the curb so i proceed around them, then bam lights, i figure whatever their probably looking for drunk drivers (tis the season) and since i'm stone sober i figure i'll b on my way shortly. Ok the officier comes up to the vehicle asks for my lisense and reg. i tell him i'm driving my friends car and hes sitting beside me (also quite sober but why risk it u know) he asks me how long i'd been driving? i say since i got my lisense (i wasn't gonna say since i was 7yrs old) which hapened to be in August, then he asks me if i had any reason for swerving at ppl? i was like huh? he said he had a professional witness say that i was swerving at ppl trying to hit them, i was like, i was swerving around ppl (i don't like to say swerving b/c i was going so slow but whatever) anyway he said that i just got a $400 ticket and he'd b back, i'm like wtf, everyone in the car is dumbfounded, then i figure he's just fuckin with me and gonna gimme a warning, he comes back tells me to out of the vehicle and explains the ticket once again they have a professional witness saying i did it and i was gonna lose my lisense, i'm like this is bullshit theres no way i was trying to hit anyone i'm just trying to get home for god's sake, he sais i could fight it but they had a professional witness that helps them all the time and i was pretty much fucked i told him i'd see him in court and to have a merry christmas, fuck so far this month i've had to retarded tickets and everyone seems to fucking with me or my car, why can't everyone just piss off its christmas,
anyway sorry for the language but this shit is serious what should i do?

| I've noticed that during the holiday season the cops like to be a bit more giving mostly cuz of the drunk drivers which deserve to get the tickets. But like last year I got a ticket for having blue corner lights 2 days after christmas. I think you should for sure fight it and good luck to you. BTW what was the description on the ticket??? Attempted murder or something??? |

No - the police don't issue tickets without due reason or else you'd plead not guilty, go see the crown prosecutor and it would be immediately dropped by the crown for lack of evidence.
I assume the ticket you got was for failing to yield to a pedestrian?
Why didn't you just stop for the pedestrians?
The cop probably thought you were drinking or something because of the swerving, so he pulled you over since he already had 1 ticket on you. |

You are aware of course that in Edmonton, pedestrians have the right-of-way in a cross-walk, and that you must stop if they're on the road?
Get a copy of the Jay-walking bylaw from the city of Edmonton and read it. The wording is plain to read. Granted, it's vague at best in regards to what to do when the pedestrian is past you and continuing on in their direction (away from you) and the EPS has chosen to enforce it one way (you may wish to argue for the other), but swerving around people is a generally a no-no. |

it was a few people grouped together on the side of the road, they weren't crossing they were just standing there like stupid drunks.
there's nothing wrong with changing lanes, or turning to avoid them, I see cops do this every sinlge weekend on whyte |

Again, read my posting. The EPS has chosen to enforce the Edmonton bylaw in their interpretation...I don't agree with it, having read the bylaw, and the Traffic Safety Act (which doesn't apply, as the Edmonton bylaw superseeds it). YMMV |

lol, did you read MY post? I said the weren't "crossing" I never said they weren't on the road.
but since you want to be an anus, they weren't on a crosswalk at all, so all the pedestrians should have been ticketed according to the Edmonton City Bylaws, not the driver that simply exercised due care and avoided the group. |

| sorry for the late reply, i was ticketed for "careless driving", and the ppl that were on the road weren't tryin to cross b/c most of them had their hands in the air as if hailin a cab so i proceeded around them, and its not like i was flyin down the street dodging them, and also i wasn't swerving in and out of them, i went around one group of ppl that was it....:dunno: :( owell i'll be fighting this ticket %100, i doubt they'll even bother tryin to defend it. |

by the way the police do (sometimes) issue tickets without due reason b/c a year ago i was driving my moms car b4 i had my lisense with a person over 21 with a valid lisense and was ticketed a driving without a lisense when he stepped out of the vehicle b4 me and went inside my friends place while i grabbed my stuff out of the back seat, the officier came around the corner told me to get back in my vehicle and wrote me a ticket, it was complete bs so i went to court pled not guilty, they called the next day and said they'd dropped the charges. |

Dude I feel your pain :mad: . In my opinion our road rules should change to more like the Europeans. Where it's okay to hit stupid pedestrians. Since its not. You just have to live with it. My guess is the cops professional witness, was the hooker sitting beside him.

| well if they have a "witness" this witness will have to take the time out of thier life to come to court to testify. most ppl arent gunna take time off work to come testify so you can get a traffic ticket. So option 1 will be to fight it and the witness wont show. Without a witness the issuer of the ticket can not tell a judge based on hear say what the witness told him. If the witness DOES show well then its your word vs his you can tell the story just as you told it here id say you have a 50-50 chance. Maybe youll get a reduction in the ticket. |

As far as the "Professional Witness" ... this could be someone such as a Citizen On Patrol (COP) member or someone similar who has been trained to observe such things & report them to the police.

Yea, his name is John/Jack (I think) and he works at the Pointts downtown. I think that address is correct too. He got me off a few tickets in the past, hes very good. |

| Fight it. If the guy who's car you wre driving was sober then you've got a witness. It sounds like a bullshit charge and will likely either get thrown out at initial evalutaion or will be ruled to be misadventure in trial. Good luck. |
