EPS Hyundia Tiburon - Click HERE for Original Thread

I am fighting an exhaust ticket and I was just wondering if anyone knows if the police were driving their Street Legal Tiburon on the road last summer as I know it has dual 4 inch exhaust. Also, does anyone know where I can also find some pics of the car?

Yea it was it came to a UC meet b4.

Yea I missed out on that meet but thats alright because I went to few car meets in the States when I was down there and I got to see a very sweet 900HP CRX.

The car does have an aftermarket exhaust with dual 4" tips and according to them it is 100% street legal.

Good luck fighting it.

Yes I am talking about tickets, but more so I am asking about whether ppl have seen this vehicle driving on the streets. I did consider where to post this and I figured this is where I could get the most response to my question. How about you learn not to be a dick!

To everone else, thanks for the help. I have a meeting with the prosecutor tommorow. I think I have but togther a pretty good case, and I will let you know how I do (maybe I will post that in a new thread in Speak with your local law enforcement! lol)

There are pictures on here somewhere from the meet. They did drive it there I cant say if they left driveing it I left when they got there well shortly after. Everybody where brown nosing that piece.

I commend you on this post. Very good, totaly vaild point. I would never say this to a cop on the street as the last thing you would remember is "tripping" and smashing your face on the hood of your car. Bring it up in court with the proper respect that a Judge deserves and you should win. Good for you 180....:bthumbup:

If you want any information call the EPS and ask for Officer Terry Inns (i believe thats how his last name is spelt) Let him know your part of 780, let him know your situation w/ your ticket and see if he can help you out. The EPS Tib DOES have dual aftermarket 4 inch tips. If anyone can help you out he can. Maybe he can even direct you in your best course of action on the ticket. Perhaps even ask if he will side with you on fighting the ticket? Can't hurt to ask right? If you do call plz post what he says I'm interested in knowing how it all turns out. --HWZ.

Its also an interesting case because my exhaust is Kakimoto and it is Jasma certified. The Jasma certification is stricter than our own Db requirements and for this reason it is very quiet. The outlet is 3 inches, and at the time had a 4 inch cover around it. This is a far smaller outlet area then the EPS Tib. The cop pulled me over on The Mud after following me quite a ways. First he said it was to loud. Then I told him about the Jasma certification, and reved it a bit to show how quiet it was. Then he told me it was just to big, I told him there was a 4 inch cover around it, and he told me he didnt care and stop arguing. Maybe the judge will care.

I'm pretty sure if you bring all of this information to the attention of the Prosecutor he will most likely lower the fine significantly or drop the charges altogether. But what you must also realize is that the charge is under the discretion of the officer and although you can prove the decibal rating is approved to be lower than that of standard mufflers, you still are breaking the law based on the definition set. good chance that the crown will tell you of you have to take it before a judge who will more than likely thow out the case... as for how can the epd tips be legal cause they are not from factory if those tips are changed then would that make it illegal since they are not from the factory...

has anyone thought about bringing some of these issues to the new mayor...like seriously..the underglo (altho i think its gay) tickets are rediculous...if your driving and happen to notice underglo and get so spaced out by it that you hit someone else..perhaps you shouldnt be on the road...and as for exhausts, its a plain law discriminating tuners...or wannabe tuners...either way.

my best buds uncle is freinds with the new mayor so ill try and see if i can get his number or meet with him although i seroiusly doubt ill get to talk to him id like for these laws to change also.

Too bad they're provincal laws.. not city laws.. you've need to have a meeting with ralph.

Unless they cna make a bylaw that counter acts the HTA. However with the EPS cracking down on tuners and the illegal stuff... I highly doubt that they're gonna pass laws to make this stuff legal.

good luck with the new mayor, I heard he wants to have photoradar tickets come with demerits. If thats the case good luck talking to him on modified vehicles.

lol yeah.. when i first started to drive... I'm pretty sure I paid for one of those vans.

Photo radar still pisses me off, I saw one of the vans blow through a crosswalk and almost crem the pedestrian.. everybody else was stopped.

And howcome they can park on curbs and stuff and if I did i'd get towed.

Also why does the one van need that technocolor prolly $3000 paint job?

I heard rumors a couple months ago they want to start putting photo radar onthe highway as well.

And I heard they wanted to change the law so radar could be unmanned and have the red light tickets duel purpose, red light and photo radar.

Good luck in your case, but I think you're still going to lose simply because, according to the law, if your car has an enlarged exhaust tip then it is in violation, end of story. The fact that the EPS also has an illegally modded car doesn't mean you're innocent, it just shows that the EPS is hypocritical.

Now if you could show that your car actually came with a 3" tip, then you'd likely win.

I think the point with the EPS tibi is that they say that car is 100% legal, and he's wanting it to be a referance point, walk in and say wellthe eps tibi is 100% legal, my tips are the same size or smaller that theirs... and hope like hell the judge sees the point.

The other point is motor bike mainly cruisers who put bigger pipes on them, or how about 805 of the 3/4 and 1 ton diesels who upgrade from a 3" to a 4 or 5" exhaust

I know what the point is, but to just walk in and claim that the EPS's demo car has an illegal exhaust and that means you can have one too won't fly as a defence, in fact it would basically be like pleading guilty because you would be admitting to having an illegal exhaust. :(

Exactly my point! I spoke with Const. Innes of the EPS and he expained the the Tib is legal. He recommended that I go to court and explain the the cover around the exhaust is simply for looks and it is not the actual outlet for the exhuast. As well, it has no effect on the fuction or sound of the exhaust. I have taken some pics, and I have also cut it of, so I can show it to the judge in court.

Get the officer to put it in writing and take that in with you, and if the prosecutor won't budge on it go to trial.

This would effectively kill all the enlarged tip tickets that people around here get.

Be forewarned though, that as a Provincial law, a trial for such a matter would be heard by a Magistrate, not a Judge. Although they dress similarly and look like the same thing, they are not. A Magistrate is not a Judge, and does not have the ability to decide whether your exhaust is acceptable or not, he only has the ability to decide whether a law was broken or not. If the law states that your exhaust cannot be larger than the factory size, then that is all he has to work with. If it is indeed larger, and that is against the law, then you will lose. Period.

I'm not trying to be rude, I'm just saying that a Magistrate can only see things in black or white. They're not allowed to 'interpret' any further than what a law states.

You do have very good points though, and may stand half a chance of having a Magistrate dismiss the charges simply because he doesn't want to have to deal with it.

Keep in mind though, that your first court appearance will be for pleadings, which is simply "Guilty" or "Not Guilty", so don't try to fight it there. You can talk to the Prosecutor, but if he isn't willing to budge, then just set it down for trial, and ask for at least 2 hours (should put it off for a few months, at least), and give you some time to decide what you want to do.
