Question about collision report? - Click HERE for Original Thread

Here is the situation. A buddy of my was in a little fender bender with another car. There was less than $1000 in damage on both vehicles. This was in Calgary. He told the other person he would pay for any repairs that was required.

A week later he gets a phone call from a community police station to come down and fill in a collision statement. He goes down there, asks the volunter why there is even a report needed since there was less than $1000 damage. The other person even stated in the report there was less that $1000 damage. The volunter was unsure to why he had to fill a report as well. The volunter said that the report is for insurance purpose only and even if the person was suing my friend, the report is not for any of that. There was no CPS officers in the office that day so he was unable to get an answer.

My friend find out that the person he hit is going through insurance and a lawyer because she had headaches after the accident.

So I ask another friend who is a legal assisstant and she told me that whenever someone goes through a lawyer for a car accident you need to fill a collision report form regardless of the damage amount.

So the question is: who is right? Is the collision report ONLY for vehicle damages that are more than $1000 or does one have to be filled if you are going through a lawyer and looking for compensation and NOT for vehicle repair? :dunno:

Police assistance is not required if the damages are below 1000 dollars, but a police report should be filed if you wish to be reimbursed through your insurance company. I think your friend just got screwed over by the other guy in the accident.

$1000 damage, damage to public property, or injury of any occupants of any vehicles involved in the collision would warrant a police report.

As Blaine pointed out - because she claims she was injured, she HAS to file a police report.
