| I'm looking for people to help me out with a problem, This is my problem On Sept 25 driving home from work (budpark) at about 11:30 and night i was in the far right hand lane going north on Calgary trail when about 1 km before elerslie Road turn off i hit a massive pot hole and bent two of my rims on the right side really bad. I'm just looking to see if anyone else has hit and damaged there car on this same pot hole between sept 10th to sept 28/2004, because I'm trying to go after the city for this and I need as many people to help me out, please leave all your info if this has happened to you thanx! i don't wanna sound skeptical, but have fun.
I'm guessing your car is lowered.... they will will see that and say, well you shouldn't have lowered car, yadda yadda....oversized rims... same thing.
In their defence, they do have a point, you take risks driving a car that can't handle pot holes, even Big ones. :( |

| Good luck with that man. If I could get the city to pay for repainting my bodykit weekly for every pothole I hit.. as well as every parking lot I "try" to pull out of.. I would be happy ;) |

Doubt u would get that.
I was gunna go after the city for when they were grading without any warning or trucks following behind, and scraping a big chunk of ice, and it tearing my exhaust in half (Integra). But thought it was too much of a hassle. |

| A guy I used to work with hit a pot hole in an alley and it messed up one of his 18s , and the city paid for repairs. |

| good luck proving it was the citys fault because it is so long after the fact. because this happened in september and it is almost 6 months later they could argue that it happened somewhere else not within the city limits. also the evidence is probably gone (filled with snow). good luck with your fight though:bthumbup: |

Hey man good luck, go for it.
its their responsibility to fix pot holes. escpecially if it wa sin septemeber that pothole was probably their for the entire summer.
fight it and win because they obviously didnt do their job if its that big. you dont pay taxes so u can drive on roads with huge holes in them. |

| most of the time , even if it is there fault they blame you for either going too fast or not payin attention to avoid it. wutevs gluck with it, i am just speakin from my experience with it |

| Same thing happened to my buddy on Argyil. They dragged it out for about 3 months, but in the end he didnt see a dime. Its definely worth trying to get some money out off, but dont get your hopes to high. This is why I drive a truck 8 months of the year! |

they can't tell you to swirve to avoid potholes.. I have a friend who got a ticket for it, he was all ove hte road.. well mostly in his lane dodging potholes and he got a reckless driving ticket.
If they refuse to pay.. try the same thing... won't fly very far but it's worth a shot, they obiously didn't pay to fix the road so why should you pay your taxes.
i live in a small town and they where doing road work, the guys quite for the day and didn't leave any signs.. I was driving lucky for me a rental dakota, they dugout the road for re-paving, but they tried to make a ramp down, but ended up making a bump. the rearend of the dakota got airborn. had i been driving my car, my front bumper woulda been ripped off. Later I dorve the wife's car there and i had to treat it like a steep parking lot enterance in MY car, and her's is/was stock. I ended up going down to town hall and letting them know. cause there wasn't even any signs. by the time I picked up a movie and headed home, signs where up. |

this is acctually half true... and it reminds me of the very unfortunate situation of that fellow who fell in the open man hole while walking home late one night.
The city is only respsible for the damaged roads, ie. Pot-holes, cracks, sink holes that have been reported, and they "KNOW" need to be fixed.
This also stands true for the manhole thing, because apperently the fellow who fell in was initially not entilted to any compensation. The manhole was no-where on record as being missing so they can't be held responsible, because in all fairness (and i have to agree here) you can't get mad at the city for not fixing something they didn't know they had to fix. In the manhole case, it was probably taken off by some punk kids, and obviously hadn't been seen yet, so it wasn't called in to be replaced. The guy who fell in, was probably the first person to "notice" it :(
So I ask you... and be honest, when's the last (let alone, first) time you you've bothered to look up the public works of Edmonton's phone number, gone through all the menu's and left a message saying there was a large pothole at such and such street.
If you're like most drivers, you avoid it, or hit it... grumble a little, and say, MAN I WISH SOMEONE WOULD DO SOMETHING ABOUT THAT.
This of course leaves the unfortunate situation where the only way the city finally DOES find out about the pot hole is when some body with a lowered car with oversized wheels, bends a rim after hitting it, and now he' looking for money.
When this is the case, i'm pretty well on the cities side... it's not their fault.
So, if in fact this is true, and the city did not know about the pot hole, and you are in fact entitled to no payout... what have we learned? First off, call in pot holes... whats the worst that could happen? they don't fix it?... well their not going to fix it anyways, if they don't know it's there right? Chances are you drive that way many times on your way to work, so call it in one day.
If everyone called in all the potholes and cracks they saw, they'd prolly realize they need a bigger budget for road maintanence?!?
Right now, they probably think the roads are fine, cause "pothole reports are down 20% since last year" :P |

They did a big pothole patrol push a couple years back....
the spot in question now.. it'sn't that a recently worked on section of road though? |

Sounds like a cop-out to me. Let me get this right, the city's has no responsability to ensure that the roads are in good condition? What about a little something called quality control? Pot-holes don't just appear over night, shouldn't the city either A) Invest money to identify and fix pot-holes before they are big enough to destroy somebody's rims or B) Pay for the repairs caused by the pot-hole that they didn't bother to identify in the first place. I don't believe blaming the drivers for not calling it in is an acceptable excuse.
At the very least, all major roads such like calgary trail, yellowhead, etc etc should be examined on a regular basis, and all potholes idnetified.
Personally, I find it pretty hard to believe that in a city the size of edmonton they are not able to identify EVERY pot-hole that is big enough to bend a rim. Seriously, how many man hours would it take? 80, 100? 200? It's peanuts in the big picture. |

| i think the main point here is that it will be hard to prove that the pot hole caused the problem because this incident happened 4 or 5 months ago and it is just being reported now. i think he would have a better chance of winning if it was faught right away, and he took pictures of the hole and the rim right after he hit it. |

| I did fight it right away... I sent a complaint. And it took so long for them to get back to me. When I took my rims in to see how much to fix.. their was a another guy in their that hit the same pot hole. He’s coming to court with me |
