Can an "AS IS" sale have any kind of warranty - Click HERE for Original Thread

I know this has nothing to do with cars but i dont know any other forums to post this in. it would be great if someone can point me to some good forums. anywayz this is what i have to say and its about shoppin for a sofa. any input is welcome as i am in a rather confused state right now.

Today I went to check out BEST PRICE FURNITURE right beside UNITED FURNITURE WAREHOUSE on 133ave St. Albert Trail. Im not sure how long has the store been there but theres a 'Grand Opening' sign on a place thats nowhere close to the entrance.

Anyways. I've done my share of shopping around for sofas and the ones they sell at BEST PRICE FURNITURE are priced much lower than at anywhere I've been to so far. Yes they are on clearnace and the sofas have at least been used as displays. The salesmen there were very very fishy. They gave me that "the deal ends today" and how great the sofa is bla bla bla. You know, the price is good and the sofa is good , but I didn't trust the salesmen at all. I felt like being ripped off somewhere. So after all I put down a $50 deposit(which should be refundable if I decide not to get the sofa within 7days) to put the sofa on hold while I go home and think about it.

Now here is the part that made me very uncomfortable. The salesman wrote up the sale order sheet and told me that the sheet was so there wouldn't be the need to do one later when I decide to pay for the sofa. On the sale order there is a stamp that says "Clearance Item AS IS Final Sale". From my understanding, an "AS IS" item does not come with any warranty and the seller is not responsible for any problems and such for that item. When I asked the salesman about the "AS IS", he told me that is just a business term and the sofa is covered for 5 years from any defects while the leather has a lifetime warranty. He also added in a STAINSAFE 7 year warranty for $150 that covers just about anything you can think of that can go wrong for a sofa(after a few Google search, STAINSAFE warranty turned out to be completely worthless piece of ****).

Now here comes my question. Does any kind of warranty actually apply to an item that is sold "AS IS"?
Does anyone have any experience with BEST PRICE FURNITURE? I just want to know what the hell I am getting myself into. There are alot of things that don't seem right.

You know afterall that sofa is near top of my sofa list out of all the ones that ive seen so far(~150 different ones). Even though the sofa may not be new, the price is still about half of what I expected to pay when I first saw it. So if everythings normal and Im just being weird then I still like to get that sofa even though I don't trust the salesmen there at all.

well honestly i cant answer you question .lol..sorry but if youir still looking for a sofa...there are several nice ones to choose from Liquidation World.....156st and "116 ave i think"..ull see it.....but yeah ...ask for Les and tell him Kris sent you.hell give you a freaking good deal!!probablly youll find what u really want and for much cheaper..cya

Typically no - AS IS means there is no warranty.

There are certain provisions within Canadian Law which is supposed to force a retailer to take something back within 7 days (Could be less) - but I highly doubt that applies to goods that state as is, final sale.

As for experience - I've yet to have ANY good, honest salesmen/ladies on St. Albert Trail EXCEPT City Furniture (I got my reclining Palliser's for $1000/sofa). I had one guy try to tell me that he used to upholster show cars and everything (Since he was telling me about how tough his fake leather was).

As for your sofa - beware, it's probably not real leather. If you got it cheap (Under 700) it's probably a synthetic leather blend/nubuck (I think that's the term). The guy at UFW came clean on their sofas as to what they were really made of....

The sofa itself if it's a display model should still have a manufacturers warranty (Which is not through the store) though - which is probably what the salesperson was mentioning.

It's a contradiction, as-is means no warranty, but they state is has a warranty, I would find out where you would go for warranty claims... It could be that there is a warranty, just through manufacture(PITA) and not the store. Basically if you have something stating you have warranty, you have warranty, mind you, you might have to put up a fight to get service though..

So, it's WRITTEN that the sofa is "as is" but the salesman TOLD you that there's a warranty???? I think that answers your question for you, right there. A verbal warranty ain't worth the paper it's not written down on.

Don't believe anything a salesman tells you. If it's not in writing in your hand, you don't have it.

I would have him put on the bill of sale the warranty that comes with the sofa so if there is any problems you have it in writing.

I would assume the "as is" is on there because the poster said that he bought a display model.

When buying a display model you are typically buying something that is visably worn, and may have scratches, tears or stains on it.

This is what I would say the "as is final sale" is on there for. This way he can't return it saying it's not in the condition he thought it was in, and so on.

There's still a manufacturers warranty on the frame and such, but that warranty obviously won't cover any of the physical defects that come with a display model.

i belive in that situation it is stating final sale, you still have what ever warranty applicable to your item, but you cannot take it back as it is final sale

if your unsure, don't buy it, thats my motto.

It is illegal for someone to sell something "as is".
Noone does it but you can bring them to court.
i'm not to sure of the legalities and what not but it has been done.

I'd love an explanation - as typically that's how private individuals sell cars.

As well, it's typically how a lot of discount places sell stuff.

Normally in private sales, you sell as-is so that they don't come back in 2 weeks because it broke. In this situation selling as-is would seem weird since it is a brand new item and you are buying it from a store. I would make sure you get everything in writing before you purchase anything. This place seems kinda shotty to me and just from reading this thread I wouldn't trust them.:dunno:

who needs a warantee on a Sofa anyways? Do they just collapse out of the blue? Spontaneously Combust?

All I can think of wanting one fore is if your leather wears out, cracks, or the fabric develops tears. But how long will that take??

If it reclines you typically get a lifetime warranty on the mechanisms (From the good manufacturers)...... Which would probably be costly to replace, and are a wear item...
