I just bought a used car, took it for a test trive when i went and looked at it, it started up fine, drove fine, ran fine.
Went and picked it up tonight, got two blocks and no it wont start. Tried all the obvious things, it sputters but wont catch. It has gas.
I am going back tomorrow to try and start it again but I am wondering if there are any lemon laws in Alberta. If I get a car privately and it makes it two blocks then dies, I am entitled to a refund? The Bill of sale says as is where is, but nothing about final sale.
Anyone have some insight?

| If you can prove that the previous owner failed to disclose knowledge of a serious problem with the vehicle, then I believe that's grounds to sue. But I'm not 100% sure. |

| did you atleast have an inspection done before you bought the car? atleast while going to the inspection palce, youd be able to test it out and see how it handles and have some foresight on what might need to be done. or atleast if it died on the way there, you would know to stay away from that particular one |

I wasnt going to pay for an inspection on a $300 car. Not really worth it. The car ran smooth and drove just as well when I went the first night. Obviously had some flaws in the body, but mechanically it seemed fine.
It was quite the adventure tho... I almost killed Bigmack's CRX but draining his battery. Luckily the Honda held up and got me home. Fucking Hondas. Fucking Nissans. |

had no idea it was a $300 car :lol: :lol: :lol: , i guess the saying 'you get what you pay for' can be used here, dont worry, your not alone. i bought an 86 accord ex-i that has a really smooth running engine, but it has a bad transmission(i didnt know about it until the second day i drove it which was like 2 months later). it was fun until the transmission wouldnt go in reverse. not sure what your problem is, but it costs me about $300 to fix my problem |

I think for a $300 car there's an unwritten understanding between seller and sellee that it probably won't remain mobile for long. Anyways, would you want to invoke the lemon law on a $300 car? That would just be redundant. |

Not really. I just wanted to have some grounds to ask him nicely for my money back. Worst case scenario I take it to the junkyard and cut my losses. |

Ya!! Stop being cheap dave and admit you got burned! I have spent that much before on CRAZY nights of drinking and when I woke up alone the next morning I didnt run to the bar and demand a refund because I didnt get lad! :blink:
You must have really pissed off the FWD gods. My sentra was great to me.

On this forum, Got Boost has a sentra that is parting out due to accident. PM hiom to see if he has cheap parts for ya.
On the sme note I bought a $200 Hyundia from a forum....drove it home & parked it for 7 months. Put in a new battery & exhaust for under $200 and drove it for 1.5 years before somebody hit it.
Cost effective I think....Lucky? U bet!
Oh, and even implied "as-is" means your toast. In Alberta, if there is nothing mentioned on the sale contract about conditions of sale you have basically bought the car as is. |

Thanks for your input :rolleyes: All I expected was it to run like it did when I test drove it. I have bought a $300-500 beater every winter for the past 4-5 years and they have always made it through the winter.
I dont suspect the guy will give me my money back, but hell if he did I wouldnt complain.

Refunds are usually done as a good will gesture by businesses that want to retain customer loyalty. They absorb the cost of a percentage of returns as an expense. There is no legal reason for anybody to give a refund unless it is stated prior to the sale.
Your only recourse when you feel you are screwed is to file a lawsuit, small claims court will cover most used cars. The person would have to knowingly mislead you about the cars condition for you to get anything. I think if you have been getting by on $300 cars for 4 or 5 winters then the law of averages has just caught up with you. |

all i can say as is means the way u see it the way it is the moment u sign the bos . so its your own job to find out what is wrong with it and make a desision to buy or not to buy. as far seller he is only responsible for no liens against the title.
as far as accident what do u think most of used car lots sell ???
they go dealer auction pick up accidents, salvage, right off's get them fixed than inspected if they pass than they sell them .they don't tell u if its been rebuild , they don't have too it has passed an inspection , if it needs rebuild inspection than they have to disclose that to you otherwise go mvr and pay to get vin checked
economy thats how it works too much too fix insurance rights it off no matter if its collision or theft recovery, dealers buy 2 messed up cars and make 1 good one recycling :blue: |

| Not true, The seller is obligated to disclose write-off/salvage vehicles. I bought a $3000 dollar car with a repaired title and didnt find out until i registered it. I returned the car the next day to a full refund including registration and insurance costs. |

you only know what the sellers know(in most cases). if they had no idea the car was in an accident, then chances are you wouldnt know until you find out on your own.
i bought a $700 accord, it didnt make it through 2 months of driving due to a bad transmission which nobody saw coming. asides from putting a few hundred into it, it was well worth my 'investment' |
