put a deposit on a truck, ran a car fax, was written off, so what now? - Click HERE for Original Thread

Okay, so i found a Toyota Tacoma, and it was really nice, so i put a $500 deposit on it, and wrote up a bill of sale, pending an inspection and VIN number check, he told me it was in a minor accident,

i did a car fax search on it

and it turns out it was written off, and car fax won't even offer a buyback guranteee on it.

now can i go to the guy and say hey i want my $500 deposit back (cus it was written up as refundable pending inspection and vin check) becaue he told me it was a minor accident when it was really a complete write off

am i able to get it back?

yes, be like ok, this is what carfax came up with. Can I have my cheque or whatever back.

If he says no. Be like ok, my lawyer will be investigating this since you agreed and signed that you would refund it if it didnt check out.

well i just called him and he was like, i don't know how major or a accident the previous owner never told me,

and some stuff like that


and i just told him we would be checking out the vin numbers on carfax and after we will contact him, and yea


so tomorow were calling him and asking for the money back

If it was a cheque that you gave the guy go to the bank right away and put a stop on that cheque. That way it will not be able to be cashed.

Since the agreement was that it depended on the inspection then tell him it failed and you are not buying the vehicle.

Agreed, the potential sale was based on checking the vehicles history. You have him the $500 to hold onto the vehicle while you checked into things. Since the carfax came back negative, I wouldnt suggest buying the truck. He might not have even known that it was written off b4 if he wasnt the original owner.

Id ask for the cash back, and if you paid by cheque, then deff cancel it. Good luck.

Even if a vehicle was written off it can be repaired and pass inspections to become active again. I beleive if you look at the registration, were it says active on yours it will say repaired on his. Therefore making it roadlegal. But he should know this information already. He should return your deposit because not only no sale but you weren't given all the info on it.

why was there even a deposit in the first place? i would assume that asking for a VIN so you can do a check meant your a serious buyer as it is...

there was someone saying they would pay him 5grand cash that day for the vehicle if he would sell it to them,


and i saw the persone say it to him


but anyways i talked to him and hes giving me my money back, he dind't even knwo

Thats cool. At least the guy said he would give ya the cash back. Your lucky.. some ppl might tell you to take a hike.:mad:
