I was heading south toward the bonnie doon shopping center traffic circle from the other traffic circle that is just north of there.. actually that statement is incorrect I was heading down the road that links the two.. My friend lives just south of the more northern traffic circle.. I entered the road at the smaller entrance from a side street (there is a set of lights to the south of it and the traffice circle is north of there). Now it was 10:18PM.. it was VERY dark out.. now I am driving along.. I look down wow I am going 80.. I start slowing down.. just as I do that FLASH... now I was under the impression that this road was 60.. its 50.. (I got the ticket going 65km/h) Anyway.. I didn't remember seeing a photo radar sign.. so I turn around and drive back to where I entered the road.. start driving back.. there is no photo radar sign.. so I go back again just to make sure.. nothing... so I drive my car Right up to the front of the photo radar van.. (blocking the flash, rat bastard cash cow vans try and work at night with no flash).. I get out and walk up to the guys door.. I wave at him..
he rolls the window down about a half inch and asks me to go around to the other side of the van.. (this is where I think to my self, if I was going to start something with this guy I would just go threw the window... its just glass... my boots work great on stuff like that) But anyway I walk around to the passanger side.. the guy looks really uncomforatable.. I was pretty pissed off I have a really limited budget because of school and tickets eat up my tuning cash... So I say where is your sign.. the guy just looks at me blankly.. so I repeat me self... he says oh its back at the round about back there right after the 50km/h sign.. (which I did not drive past..) So I go back ya its there its one of the ones that is there all the time on the pole.. so I set my trip meter.. drive to where the truck is on the road and stop.. my trip meter reads .9km.. so 900meters... this photo radar van is parked almost a KM down the road from the sign.. its 2 entry points down the road (on of those being were I came in the other is a intersection WITH LIGHTS). If this is not enuff.. I got my ticket today.. you can actually see the pedestrian sign above my car in the picture..
Now.. we have photoradar which is a pro public safety thing.. and the truck is parked 50 feet from a pedestrian cross walk at night.. with a huge ass flash on it.. personally I think thats kinda counter public safty is it not.. that flash goes of and someone starts walking out it will blind cars coming the other way and make a nice speed bump out of a person..
I have no problem with paying for something when the police catch me doing something that I should not be. (which is normally speeding) But when some civy dumb ass parks a photo buggy in a place that does not warn on coming traffic of its existance (as they are suppose to) and manages to park it right infront of cross walk at night just pisses me off.. I all ready payed a redlight ticket this year that was not my fault and I don't feel like paying this one..
Anyone got info on how to fight a photo ticket.. I am actually kinda more interested in getting the photo radar van guy in shit for where he parked it truck then at getting a reduction in fine.. its only $78.. But it just pisses me off how it was set up..
How abouts do you fight these tickets anyway.. like what do you say in court.. I actually.
Oh, I actually said to the guy when I was looking for the sign that I came in after that location were the sign was posted.. all he said to me was "I willl see you in court..".. I really felt like going into my trunk.. pulling out my C7 and shooting the flash off the front of his photo van.. But I guess I will just go to court and fight the damn ticket.. |

I think I got my picture taken last night by the UofA....? I dont' know for sure though, there were a bunch of cars.... I'll just blame it on my dad if it comes, it wasn't that late.... :o
Stupid night photo... but the last time that happened (and the first) I never got my ticket in th email. |

Be sure to write everything down (so as you don't have to try and remember it later) while the details are still freesh in your head, write down EVERYTHING possible you can think of.
I hate low light Photo Radar as well. Not only does it wreck your night vision like Nightstalker said, it can take time for your eyes to re-adjust to the darkness during which time you could hit something or someone.
PhotoRadar and Redlight radar does NOT work for public safety. All it does is provide another means for the Governing bodies to take your money.
That guy is speeding, oh well, take a picture, char him later, let him be on his way... STILL SPEEDING.

Yeah, thats pretty sad.....usually those vans park at usual spots though....all I do is scan far enough ahead....even at night.....havnt got a photo radar ticket yet! Actually, just one but thats only cuz i didnt know the speed limit like u did...

| I put all the info in my palm pilot the night it happened.. but what kind of defence can you really put up for your self... I was speeding.. I am fine with the ticket.. its just the way I got it was pretty messed up.. from the brains showed by the vans driver I would think there should have been the good old handycapped tag on the mirror.. I know that I can make this ticket cost the city more then $78 just but getting all the information... going to view the picture 50 times and going to court.. and thats the plan.. I just don't know what to say once I get there |

just say what you said here, that you think its a public danger, positioning photo radar with its "blinding" flash somewhere that could result in a poor "innocent" pedestrian injured, or (gasp now) even killed.
at the very least it should get the judge thinking, might even get you off, but i highly doubt it. |

I also find that if you go talk to the prosecutor he'll cut the fine and deadline for payment way back.... you simply have to ask for that... for photoradar.. |

Make sure you COMPLETELY understand the charge. You're charged with speeding, but under what statute. They have to prove undeniably, that not only were you speeding, but also that you were at the location and the specified time. Because this is not a personally addressed ticket to yourself, they need not prove that you were the OPERATOR at the time, just that your vehicle was at the specified location. In summary, there must be evidence to prove that the offence occured at the time and place as written on the ticket. That you were in fact travelling on a provincial highway/road. And also that you were exceeding the speed limit. Now, when you're in trial, pay attention to these details. The Crown has to establish a prima facie case, which means proving EVERY aspect of the charge as I stated earlier. These are some details you should listen carefully for while the crown questions the officer:
1) has the prosecution identified that the vehicle is in fact a motor vehicle.
2) has he identified that the vehicle was the one cited, with the license plate, model and color the same as the one on the ticket?
3) what province is the plate registered in?
4) has the prosecution testified that the defendant was travelling on a provincial/municipal highway (street, avenue, road, etc.)?
5) how fast was the defendant travelling?
Check these off as the officer is examined, if he misses one, wait till the closure of the Crown's case, and move for dismissal. When the Crown's case is closed, the court usually doesn't allow it to be re-opened again. However, if you don't move for dismissal, but later testify yourself and fill in the missing info, a conviction will follow.
You will also get to cross-examine the officer. This is payback time now. Ask him detailed quesitons about the event. Ask him about calibration records, his training pertaining to the use of photo radar devices, etc. Attack every possible detail.
DO NOT testify yourself, while it's not true that the judge ALWAYS takes the officer's word over the defendants, you are under oath, and lying under oath is perjury, an indictable offence punishable by 14 years imprisonment...not worth it for a simple speeding ticket. Second of all, unless you have a witness to confirm in fact what you are testifying, it's very unlikely that it will carry any weight whatsoever in the final decision on the charge.
There's a lot to do to prepare for trial. And remember you will miss school because court is only during the week and during the day. Anyways, hope this lengthy post has helped.

Just remember that the "cop" shows up they have huge blown up full COLOUR pictures unlike your small black and white 5x5 pic. Reseach yes but don't prepare for it like a friggin criminal case. ITS JUST A SPEEDING TICKET. just $$ no demerits.

Buggers probably work off commision even though the force says they don't!!!!! Still my opinion..... otherwise they wouldn't be out there hiding in the darK!
I prefer photoradar as opposed to laser or conventional... cause it's only money and no demerits.... so it's not a "bad" thing unless your poor like me or unless the ticket comes at a bad time... plus like I said, the prosecutor will always drop the charge so you pay less and extend the date if you "beg" or ask nicely....
I'm just not sure which is better in the end... I think the photo has more potential to cause accidents, by having ppl slam on their brakes... on the other hand, conventional radar could kill a "traffic" cop stepping out infront of someone not paying 100% attention!
I don't know which is better, but my insurance doesn't suffer with photo, so?! (I have completely clean record now, not even a photo ticket, yet, and insurance is killer since i'm 19) :thumbsdown: |
