ok, so i rolled through a stop sign at the very end of Anthony Henday today on my way home from school and got a stop sign ticket. (along with like 20 other cars, just while i was there. BIG $$$ to be made there.)
37a "Use of Highway & Rules of the Road Reg."
37 A person driving a vehicle that is about to enter onto a highway from another highway that is marked by a “stop” sign shall bring the vehicle to a stop
(a) before entering on the intersecting roadway and at a point no further than 3 metres back from the intersecting
my question: are there demerits for this? google isnt helping.
Also, can anyone post a link to the complete list of demerits for this?
edit: and, i thought this was like a $80 ticket, whats up with $287 :mad: thats double the speeding (by +25) ticket i got a year ago. |

Yeah I remember getting one of those. It's a big ticket.
Almost worth getting a lawyer to fight it down to something else, so your insurance doesn't go up too much.

Moving violations such as unsafe lane changes, etc...are all TWO (2) demerits. Stop signs are THREE (3) demerits.
As to the cost, where were you years ago? The $287 fine was instituted about two years ago. Be thankful it wasn't for failing to yield to a pedestrian, as that's over $500. |

I got one of those tickets last year and the officer and crown prosecuter informed me that it was 4 demerits. My ticket was around $300 as well and I went to the crown prosecuter to fight the ticket.
I made up this story that I was going downhill and it was difficiult for the officer to see whether I fully stopped or not and also that I was just learning to drive stick and thus made it harder. All of which was bs but it worked. He dropped the demerits and cut my ticket in half.
I would try to fight the ticket. I'm sure you can get the ticket reduced a bit as well as rid your self of some of the demerit points. |

The fine changed in May of 2003 when the Traffic Safety Act took over from the Highway Traffic Act. The reason the fine is so high is because the majority of the collisions in Alberta occur at controlled intersections (data has been collected on EVERY collision report in rural Alberta since 1996).
People seem to think that stop means only if there's someone coming (and not even then sometimes). This offence is one of my pet peeves - especially when I have to clear a landing zone for STARs to air lift an innocent driver / passenger to the U of A because someone else did not feel like stopping.
There's an old traffic cop story where the officer stops a guy / or girl (got to be politically correct these days) for not stopping at a stop sign. The violator says "well I slowed down - what's the difference?". The officer says "if I was hitting you with my flashlight / baton would you want me to stop of just slow down"?? Ha - Ha (okay so I'm not a comedian but I'm sure you catch the drift).
The demerit points for a "stop sign / red light" ticket are "3" as compared to a "traffic control device" which is 2. Here is a link to the Demerit Regs . Happy reading ...

i understand your frusterations, but this intersection was MEANT to be a yeild, not a stop. Based on the fact that there is a yeild sign perminantly installed in the ground with a bag over it, and a temporary stop sign sitting like a foot above the ground (really hard to see).
Along with the fact that there was NO oncomming traffic and there never has been any time i was ever at that intersection. Not to argue with you, or the law, but i wasnt going an unsafe speed through the sign, and i did check for traffic, and if there was any chance that i was making the turn unsafely, i woulda stopped. |

lol, it would be funny if you went and took a picture of the intersection like that (with the yield sign showing and the stop sign gone) then took that to court with you.
Kyle: Sir, look at this picture of the location, is this the intersection where the offense occured?
Officer: Yes, I can see the street signs in the photo.
Kyle: Alright then, please identify in the photo the stop sign which I rolled through.
Officer: ......there isn't one.... uhhh, but there was one there that day.
Kyle: And you have proof of this?
Officer: .....uhhhhh, well no, but it was there!

| I would suggest taking pictures of the scene. It can't hurt your argument to get it reduced or thrown out. But don't be snobby and rub it in his face about the yield/stop signs. |

seems im not the only person pissed off about this BS. There was a personal add in the Devon Dispatch (i heard its in teh sun and journal too, but i dont know for sure) about people that want to get together to fight the ticket, wonder how that is goona turn out.

| can you help me out with what you did??? i gotta fight a unreasonable rate of speed ticket with 4 demerits on wednesday. the cop only gave it to me because i swore at him when he told me he pulled me over for my exhaust. anyways i just dont know what im doing whats the first thign you did when you got there? |

He risks his life to make your life better.......that's no way to thank him!
Not trying to insult you or anything, but if I were him and someone swore at me for doing my job I would give them a bigger fine too! And if he shows up in court, you can be sure he will remember you and let the judge(or whatever) know too!
If you treat them with respect, they will take it easyer on you |

| and on a side note, i dont care if i made fun of his dead mother its against the law for him to write false tickets.. theres fuck all i can prove other then to state the weather conditions of the day were perfectly fine for me to be driving the speed limit.. and he cant say he gave me a ticket for speeding because then he would have had to issue me a speeding ticket as far as i know.. because he had no idea how fast i was going if he did he would have wrote me a speeding ticket with his evidence of my speed. |

OK, fair enough.......I will agree not all cops are nice, and even good ones have bad days.
However you have to agree that swearing at them is only going to make things worse, and give you less of a chance of getting the ticket thrown out or reduced.
If you have a solid case, and everything you said is true, and you tell this to a judge, he might say "yeah, your right....blahblahblah.....I will throw the ticket out" Then the officer speaks up and says you were swearing at him and being rude, and telling him what to do with your big muffler. Well all of a sudden the judge decides you might not desserve the break he was going to give you, you don't seem as mature and reliable anymore. That's why I think no matter what, it's not worth making a big deal of it and treating the officer like crap (even if he deserves it)!! |

| yea of course.. im always very respectable to police.. ive been yanked over for street racing and i knew i deserved it so i was very co operative.. i just lost it when he did what he did all to pull me over for my exhaust i was shocked they would do something like that for such a stupid thing so i just said what i said.. i never told him to fuck off or anythign and i think a judge will understand my reasoning. my intent is to plea guilty for the exhaust ticket provided the other ticket is thrown out .. if they wont then im fighting them both. i almost shit my self when he came to my window with the driving at an unreasonable rate of speed ticket it made no sense whatsover not even a GUESSTIMATION as to how fast i was going.. i had my gf in my car i know damn well i wasnt speeding. |

If your driving pattern was a marked departure from the norm, compared to other vehicles on the road, his ticket will most likely stand. Now, that coupled with swearing at the officer may not look good on your part.
As for him turning around with emergency equipment on to stop you, look at it this way...
If you are driving down the road in the midst of other traffic, and some yahoo speeds past everyone and there is a police car sitting there watching this take place, would you not say to yourself 'I hope that cop chases him down and gives him a ticket'? Of course you would. Everyone would. And, if I am sitting there im my patrol car, and someone makes an obvious infraction in front of both me and other motorists, I am definately going make an effort to stop the contination of that offence, either through some sort of education or a violation ticket. Why? Because its my job.
Now, I'm not saying that you did anything wrong. I wasn't there, so I have no idea. But, that scenario I described should be taken into consideration. |

Umm... okay. I dunno why you're coming off at me on this one. Besdies, there's nothing at all illegal about a Police cruiser pulling a U-turn through an intersection with his lights on...
The point I try and usually make on this (and every other) forum is that we know we're breaking the law. Enlarged exhausts, speeding, whatever the case may be. I do it too. It just seems everyone gets pissed when they finally get caught |

i take your point and understand it... i dont understand why a police officer needs to endanger anyone coming through that intersection to turn around to give me a ticket for a piece of metal on my exhaust. specially when they know we are being hunted daily and the next officer will more then likely ding me for it. I understand all your points. my problem is i recieved a ticket i didnt deserve because i was mouthy.. and thats not right.. sure fine me for my exhaust and anythign else illegal he can find on my car but dont give me a BS 4 demerit fine for talking mouthy to him...anyways im going to court today we will see how it all turns out. |

i've gotten pulled over twice for not stopping at a stop sign.
the first time, it was at night, and i deliberately ran the stop sign to get in front of a string of traffic... unfortunately the car that i cut-off while doing this was a squad car, so yeah i got pulled over, but the cop was ridiculously nice to me and let me go, as i was a new driver at the time.
second time i just didn't see the stop sign, and took the corner fairly "spirited" and got pulled over and ticketed.. i also had my music loud and window down, and it was in a school zone. so the cop didn't like me much.. i know the ticket was less than 300 bucks though. |
