Okay, today I got a ticket for my tint (i dont wanna hear, dont tint your windows, take it off, blah blah blah....thats not my question). Anyway, for the offence he cited "Section 65 (1)(d) of the Traffic Safety Act....Which is:
65(1) Except as otherwise permitted under this Act, a person shall not do any of the following:
(d) drive or operate a vehicle on a highway unless the vehicle and its equipment are used in a manner or as prescribed for by regulation.
Now, he gave me a $115.00 ticket for this. I have gotten tint tickets before on a different vehicle and they were only $57.00 and they were cited to the proper tint law Section 69 of the Vehicle Equipment Regulation / Traffic Safety Act. Can I fight this ticket and get it changed to the proper law and have the reduced fee of 57 dollars?? |

the new price may have been because of a change in the fines since your last ticket. As of the wrong section #, you could always try to get it thrown out, the least you could do is try.
Also, the section # stated above does seem relivant because your windows are not regulation (100% transparency) and therefor arent supposed to be used on a highway |

It's not guaranteed that the ticket will get thrown out but it's definitely worth a try. I know it's a possibility that it will get thrown out if it has false or invalid IMPORTANT information on it...ex. wrong name, no badge number or police signature. My buddy tried to fight that they spelt his address wrong but they told him to screw off.
I would give it a try and at the very least, they should just charge you the standard $57 ticket for the violation. Go in there expecting to pay the $57 ticket and if it gets thrown out then bonus. |

Yeah i have the exact same scenario. I got a ticket last year for tint in section 69(1) and it was only like 57 bucks. I got one this year and it was in 65(1)(d) and it was $115.
I was wondering the same thing as you, my court date is in december so i guess i'll find out then whether i can get it reduced or not. |
