Most so called "pedestrians in the right" don't even give two shits about what they are doing.
You're supposed to wait for the car to stop, especially in slippery driving conditions.
Utter BS.
I don't know the entire situation, but I hope he atleast fights the ticket. |

| Well its a tough call... the driver should be going at a safe enough speed to slow down safely. However, whats with a 6 year old crossing the road with barely any supervision? The 6 year old should have someone directly with him while crossing the street or at least close by. Not to have his brother rush in at the last second to save him. Ah well, thats just my take on it but i see your point of view as well. |

Hi Billy,
That is an interesting read. However there are certain facts wich have been left out. IE where exactly was the 6yr old kid, was he in a cross walk, was he jay-walking, did he jump off a curb and infront of the car? Where there traffic lights, was there a Stop sign?
All it says is " The teen was taken to hospital in stable condition after being struck by a car near 152 Street and 107 Avenue around 5:30 p.m."
I do not know all the facts involved in this so I can not really comment on it.
It is too bad for the people involved in this mess. I do know that you are required by law to stop for pedestrians. Unfortunately there appear to be many interpertations of this law. On my drivers exam I took many years ago, I had received points docked off for failing to judge and yield to the right of way to a pedestrian. I was at a T intersection in a resedential zone, I stopped to make a right hand turn, there was this fellow on the opposite side of the street whom was not even lined up with the curb to cross. He was about 20 feet away from it. I waived him to go by, he waived me to continue so I proceeded. As I was about to finish making my turn he casually walked in a diagonial line accross the road. My instructor told me I should have waited for him to cross, even though he waived me through, then proceeded to Jay walk accross the street.

Failer to to adjust to driving conditions.
I hate how some people just step off the curb at a crosswalk and hope that people stop for them.
It had to happen at a crosswalk or no ticket would been issued. |

I've been in this situation - on both sides...
As the driver a pedestrian ran out in front of my car - out of a cross walk - was told pedestrians have right of way everywhere.
What happened in mine was there was a car stopped, no lights, not nothing(not even brake lights, and it was a slight down hill) so I started to slow down - got about 3 cars length behind the stopped car and saw the pedestrian, tried to stop...
Road was clear, parking lane was slushy - he was going left to right, stopped car was in the left lane. Had he stood put I woulda most likely been able to stop, as he was stopped(the ped) when I saw him, he started to walk out infront of me, and I twitched and hte right side of my car hit the slush. and those ties locked, I got pulled into the parking lane... and wasn't able to stop, now had he stayed put all would have been fine.
When I was about at the other car's bumper he ran a full lane and a half to be in front of my car.
I wasn't charged or anything, neither was he. this happened in Dec 99, and he passed a year later to other issues and his wife/lawyer are still trying to blame it on the accident, officially for now it's a 50/50.
In my case the cops told me had the witnesses collaborated my story he would have been put 75% at fault, but all they saw was the aftermath nothing before the impact, or the impact.
As the pedestrian I sucked it up and kept going |

We should implement some British pedestrian rules.
I think the laws here should be if you're not in a designated crosswalk you're fair game. |

Meh, I don't think it's as cut and dried as that. Leaving my residential area there's a bit of a hill that ends with an intersection. As I was slowing down for the stop sign I was doing about 3 km/h hit a patch of ice I couldn't see and slid a few extra feet with no control. Thankfully I didn't wind up in the middle of the intersection but yeah. Invisible ice = teh fuckz0r.

| in my eyes, a pedestrian stepping out in front of a car that is not obviously going to, or able to stop might as well be attempted suicide. if you jump in front of a heavy hauler, they automatically call it attempted suicide and put you in a straight jacket-if you survive, of course. :D |

Similiar situation about 2 weekends ago. I was already passing the crosswalk when about five or so 16 year old g-unit thugs decide to start crossing yelling "fuck you asshole your supposed to stop, what the fuck" blah blah. I slammed on the brakes in the middle of the road, and I kid you not, all I could hear was "ohh shit!!!" as they all split up and ran in different directions :lol: Best part, I was alone.

I dunno bout everybody else, but when I cross a road, I know where pretty much every car is that could hit me is. And bout 80-90% of the time I'm prepared to move outta the way if they don't stop.
I'll admit the one time I was hit, buddy in a jeep was stopped at a red light, with his signal on, he was looking left for a break in traffic, he started to take off, but forgot to look right again until he hit me. But I was somewhat prepared and since he was going slow I slammed my hands on his hood(didn't dent anything) but made it sound like he killed me and I twisted out of the way, since I wasn't injuried, I just yelled "look next time" and was on my way, Mean while he was kinda in shock. I got half way down the next block before he picked up his jaw. |

5 teen girls jaywalking back home from the 7-Eleven in Lake District, I mean like JAY-WALKING diagonal crossing the road. I move around two of them that were ahead of the other three and continue on.
squeely high pitched I love backstreet boys voice: "You're supposed to stop asshole!"
I slam on the brakes, lean out the window and yell back:" You're JAY-walking bitch!" and continue on my merry way. |

True enough.
One of my buddies slid into a house once. I thought it was funny as hell, seeing as I was sitting shotgun. We knocked his garage wall off the foundation and hit the car inside... I couldn't open the door, so I climbed out the window... and was kind of laughing... the cops and tow truck showed up and pulled the car out and lo and behold, beneath the crushed front fascia and hood, both headlights still worked!! :lol: |

| i will stop for anyone in a crosswalk that is my duty as a driver.. but if some dumb invalid decides to just jump in the middle of traffic and not even bother to look i dont even come close to my brake.. one time i even made it dramatic and swerved with my horn and slammed on my brakes and made the tires squeel.. im hoping to send the message of death in this case... hopefully he thinks before he just crosses the road... let it also be known i was in full control and had no chance of hitting him what so ever hah |

you still have to stop, if you don't they can claim you were driving too fast for the conditions even if you were sliding at 5km/h. |

| Right after I got my neon, twas a couple weeks old, I was up here, going down a hill, slid through a stop sign, but grabbed the e-brake and kept it in the parking lane(t- intersection, I turned right) a cop was quite a ways back on the road I turned onto, he pulled me over, I explained, new car etc, etc he said still you should know where the stop signs are you live here, and as I handed him my license, I said actually I don't I'm just visiting(my license had an Edmonton address, not an Athabasca one. nad he let me off with a warning cause well I did slid through under some control, kept it outta the traffic lane, not like there was any though.. just me and him on the road. |
