| I didn't know the Edmonton Police Service had the authority to ammend Alberta's Highway Traffic Act. |
|
|
| shawley |
stunting is defined in the highway traffic act as distracting other drivers, how are u distracting other drivers if ur sitting in ur vehicle, in a parking lot not driving?
how can they give u a stunting ticket then? |
|
|
| DeathBy240 |
| The police can give you tickets, but they don't make the law. That's what politicians do. |
|
|
| charger_guy |
| they are obviously bored....soon aftermarket gauges with blue lights will be illegal....see if u have the screen 4 engine....i would say its my digital guage cluster.......cops will ding me with a million illegal tthings lol |
|
|
| bigmack000 |
umm iam watching the same thing and they said
" the only legal way you can wathc tv in your car is while its parked and on private property."
I belive a parking lots is PRIVATE property  hence why lots of them say private property and violators will be fined :dunno: |

the Vehicle equipment regs say:
quote:
Video entertainment systems
75 A person shall not drive or operate a motor vehicle that is equipped with a video entertainment system if the driver can see the screen when the vehicle is moving.
Sooo technically if you can see the screen or potentially could see the screen, it's illegal to have on the street.
Most of them have that e-brake lock thing so your e-brake has to be on before it'll play a movie. |
|
|
| shawley |
all of them have the ebrake lock, just not everyone hooks them up
but what about ones that give digital guage read outs
or navigation? |

From the Highway Traffic Act:
Television in motor vehicles
60(1) No person shall drive on a highway any motor vehicle that is
equipped with a television set.
(2) No person shall operate a television set in a motor vehicle
while the vehicle is on a highway.
(3) Notwithstanding subsections (1) and (2), a television set may
be located and operated in a motor coach or a holiday camper or a
self-propelled mobile home if the driver of the motor vehicle
cannot by any means see the screen of the television set while the vehicle is in motion.
It helps to know the law before you bitch about it. As long as a vehicle is parked you shouldn't get a ticket. If you do get one, it won't be easy to fight.
EDIT: Thats from the 2003 HTA, not the current Traffic safety act. It is outdated. |

See um Alberta doesn't have an HTA anymore... we have a traffic safety act and Vehicle equipment regulation |
|
|

well the only thing i'm bitching about is the fact that just for having one in there u can get a ticket, cus most ppl i sell dvd players to at work are for navi for rig workers and shit, or performance shit
but also alot to little rich kids that blow there money |

Haha I knew that too. Still, the current law is pretty vague and definately could be argued in court. |

i completley agree that u should not be allowed to watch tv while u drive, but giving demarets for it is a litttle too much
but the just having it, is dumb |

You're going to get one if you watch movies within the city while driver. It is distracting to other drivers. I agree with that - it's just like that big 100sq ft LED TV on Gateway.
The problem I have is that so many cars come equipped with DVD's now, even minivans. So what about the driver who lets his kids watch a DVD in the back seat? Will he get a stunting ticket? This is where the police officers interpretation of "stunting" becomes a point of contention. There should be no reason that a child in the backseat can't watch a DVD.
Which leads to the assumption that you're only going to get the ticket if you are:
- Watching the DVD yourself
- Driving recklessly/iresponsibly/They think you deserve a ticket and need an excuse
Which means that the typical trucker/soccer mom won't get a ticket. But it'll be the "younger" crowd that has them for the "bling" factor that will get the tickets. I assume most DVD installations hide the DVD player when not in use (Retractable, or in a spot that can be concealed) so they don't get stolen, so it would be safe to say that if you keep it concealed when driving you should be safe. |

Except for the vehicles like say the pacifica that have a screen in the dash. Most like say the ford freestar and the grand caravan the driver cannot see the screen from the drivers seat, thus making them legal.
DVD player decks like the one I want to get have very and I mean very limited controls when the screen is hidden.
Technically, if you have the e-brake switch hooked up you should be able to fight it.
Me personally when ever I get pulled over I turn off the stereo, so the screen would retract. |

better question is does that mean the big honking laptop screen in cop cars is illegal ?
i will see them saying no cause it helps the officer. well nav systems help the driver so who knows |
|

| keebler811 |
| This is nothing new. As pointed out above, the laws have always been there, it's just a media promotion right now. Screens for navigation and such as fine as they are not "entertainment systems". And as long as the driver cannot see a DVD screen it is fine, which is how the minivans get away with it for the kids. Finally, the $402 ticket they are talking about is not stunting, it's driving without due care and attention, also $402. Officer discretion plays a big role in that one, as putting on makeup, talking on your cell phone, reading the paper, watching a DVD, etc. can potentially all fall into the careless driving ticket. |

They ticketed him or attempted to ticket him for watching a movie while parked. Took the regulation a bit to the extreme. |

| the law talks about "television sets", but does not have anything to say about what a "television set" is. if, it is expected to be understood as being a television receiver (technically a set) then your dvd display should not qualify under that regulation. that would be one way of fighting it. another would be that you could argue that the system was equipped with the parking-brake lockout therfore satisfying the part about not being able to see "while the vehicle is in motion" and thusly being perfectly legal. shit, even if it's not hooked-up, then hook it up, and have some kind of proof that it is in-fact working so that when you go to fight it, the car is perfectly legal. i didn't see any mention about the cop testing for evidence wether or not the system was actually capable of displaying "television" to the driver while the car was in motion. |

|
|
| 95EagleAWD |
If the city enforces quotas on tickets for their municipal police service, why shoudn't they get to spend it?
The Calgary Police Service no longer has ticket quotas for their officers. That sounds like a step in the right direction. |

I've owned an import for years and have had no problems. Perhaps it's the way some people draw attention to themselves... |

driving a talon is a little more common than a GTR. Cops will raz vehicles that attract attention.
I used to drive this, I know all about getting tickets.

That was the meat of my post... ;)
My Talon is loud, but the cops don't seem to care... maybe because I don't speed, don't weave in and out of traffic or do anything to attract unwanted attention.... :dunno: |

so if you intergrated a laptop on the dash, it is illegal ?
a laptop can display
1. movie
2. GPS
3. Car stats
4. internet.?:dunno: |

| ya im think what about LCD's in the sun visor say my passenger is playing ps2 adn its titled towards him hmmmm that might work |
|
|
| SketchifisT |
well for the rule of parking lots, it is private property, however if you are breakin the law in the parking lot the cops can inforce the law.
IE you cant speed in a parking lot, or run stop signs just because you know the guy who owns the parking lot. All the rules still apply. However if the car is not movin, you are allowed to be usin your underglow or tv and so forth they cant stop you.
My question is , how does something in the front dash that the driver is not watchin differ from a Mini van with a dvd going for the kids to watch? i can see both when im drivin. Sure i prefer not to have a DVD player in the front dash but some of these rules are getting stupid.
Only way to fight it is go to your MLA with a properly written up statement with some signatures and just go from there. |

| The way i figure it... if you have one of those in-dash ones... its hardly noticable to a police officer if you are driving down the road playing music videos. I think its a stupid move to fine people for that... but i find alot of laws are a bunch of shit made up out of no where... so MP's and EPS has something to do. |

I'm sure it is.
Until you plow into a pedestrian, or a police cruiser on the side of the highway, or a minivan with mom, dad and the kids in it; all because you're "playing music videos".
Use your head. Keep your eyes on the road when you're driving. They should damn well fine you for such a gross violation of basic common sense. |

Me personally I want an in dash DVD, cause well I want one, my screen would only show the time, the name of the file/track/radio station thats playing, and maybe a vu meter type thing while driving. Thats all my current deck shows, I'd probably attach a rear view camera to it, cause that would sure come in handy.
If I where to drive out of my normal area, say cross country, maybe a navigation thing.
Ya, if you playing any sort of video while driving your a moron. |

Now they saw you can get a ticket if the screen is in view of the driver and it is on when he is driving. And thats a stunting ticket or a driving with undue care and attention?
But if the screen is in the back thats ok??? But if I am in the vehicle behind them and I can see the screen, now isnt that a distraction to me, hence that vehicle with the screen would be stunting??? |

ya, but i guess you have to draw the line somewhere, cuz a guy in a yellow ferrari enzo is likely to garner just as much, if not more attention then the LCDs in the headrests of other vehicles...both those would constitute stunting by that very same principle you mentioned above...tough to draw the line. |

pretty soon it will be illegal to use your cell phone in your car while parked.
i don't know about you guys, but i am starting to feel stereotyped by the baby boomer generation (our parents generation), and it seems like most of these vehicle regulations are just to tax our asses for being "bad" (eg. having 3" exhaust). they are aiming these regulations directly at us. i guarantee if a 50 year old guy in his lexus SUV was watching a dvd, he would never get hassled for it.
