hi yall, need some advice. It was my dad's accident.

so outside a supermarket around 6:30pm.
car A
car B

both car are parked. then both parties leave.
Car A about 10 second faster to backing the car.
while Car A doing that, about 45 degree to the road.
the Car B start backing.
Car A sees it, honk, Car B didn't care (notice) and keep on backing. hit car A's bumper, cracked. but Car B bumper is unharm.

there is 1 witness and He said he didn't see it.

car A & B exchange insurance info.

so 2 question.
is car B at fault ? or car A ?
what can you do if you are car A?
do both party need to report accident in police station?
(I'd say car A is screw)

The way I understand it is that if you're the one backing out, you're the one at fault.... so if Car A was already out of his spot and Car B backed into him, then it would be car B's fault.... but I think this has happened to some people on here before so they might be able to give you a better answer. :dunno:

Did the accident occur while both vehicles were backing up? If so, provided both parties state that they were backing up when the other ran into them, will be a 50-50 since there is no evidence to prove either side.

However, if car A is perpendicular to car b (Already backed out) and the damage demonstrates this, then it will most likely be car b's fault.


The hardest part is that you're in a parking lot, which is an instant 50-50 unless you fight it.

i had the same thing happen to me
i was backing out, someone passed me, i waited, then continued to back out of the stall, then the other guy that just drove by threw it in reverse and gunned it for some reason and i hit his side with my rear bumper.

both reverse= 50-50

yeh. that's what I though so too.
car A is stopped (and honking) because he saw car B was backing.

so just a lesson to me and you all.

when you back up, you see a moron backing up. don't just stop & honk and hope he stop
coz chances are if he hit you, it is 50/50.

If you can somehow prove you where stopped it's his fault. IE a good witness, store cameras, etc....

Oh and you have to report it to the cops if the damage is over a Grand or 2 grand combined between the cars.
