Advice about my accident - Click HERE for Original Thread

So this happened on Tuesday Nov 28. Around 3:30pm i was driving west on Prin Eliz. Ave on the right lane towards Nait. It was pretty slippery that day and as i was driving i noticed a car going pretty fast from the street ahead (103St). The other driver stopped short of the stop sign and im guessing he slid and was almost in my lane. Since there were no cars around i decided to shift my car to the left to avoid him. I don't know if he hit me or not, but my car started to curve right and i slid into a light pole. I was shocked at the moment and was trying to get myself together. I turned off my car because it was making a weird sound :( and since the other driver didn't come to see if i was okay, i decided to get out of my car and talk to him. So we exchanged information and the police came like 2 hours after my phone call :( Bad thing is i have no witnesses, and now im waiting for the insurance company to call. What should i do now?

If you slid into the light pole and there was no contact with the other car, it's 100% your fault.

However, it sounds as if either way you hit him - from your story, it sounds like he may have swerved into your lane while stopping and you couldn't control your car and stop behind him, so you swerve around him. So even in that scenario, you are still at fault.

You should feel lucky he exchanged info with you - if he wasn't one of the cars involved in the accident all he had to do was give the police a statement.

The other driver may have caused you to undertake the manoeuvre to avoid him, however, you're still supposed to be in control of your own vehicle. Had you t-boned him, it would have been his fault entirely, but, taking the action you did, you caused a single-vehicle collision with a fixed object, which is entirely your fault. It may even warrant a "driving too fast for the conditions" ticket.

Sit tight until your insurance company gives you the bad news...

If you would have ran into him from behind it would most likely have been your fault as well.
