Here's the story.

I frequent another forum, resource.crx.org, where they have a classifieds section very much like the one here on v8less. A member of the Resource posted that he had an pm6 distributor for sale. I replied and made a deal with the guy. I sent him a money order about three to four weeks ago now. I've emailed the guy on numerous occasions asking if he has received the money order yet. To this date, I've heard nothing from him and have received nothing in the mail.

My question.

What are my options. Am I SOL? I've asked this question on the Resource and another user said that if he is trying to rip me off, he is committing "mail fraud." Is this true? All I want is the part or my money back. :angry:

The first thing I would do is get the money order company to trace it & see if it has been cashed. Where was the money order sent to ... Canada / USA? Unfortunately mail fraud is when a person or company sends something through snail mail w/ an intent to defraud someone ... e-mails & the internet really hasn't gotten to a level where laws exist to protect buyers. Some of the larger internet auction sites such as eBay have brought in their own policies to try to prevent people from getting ripped off but private transactions are pretty much buyer beware. Your money order company may have a similar policy to eBay so you may wish to check w/ them. If it isn't too far a drive maybe you could arrive on his doorstep & pick it up yourself ... if it's too far to go or it's a postal box (how do people live in those things anyway) you're probably hooped. There's always civil actions such as Small Claims Court but if the seller is in a different province or out of country ... once again you're probably hooped. I'm sorry I have to be the bearer of bad news but ...

also, try asking people on the resource board if they know the character, and or where they live, or perhaps there are some people on the board who live in the same town, or close to.

having a bad seller know there are people looking out for you is often a good way to get your part, and quickly, as i belive they can press charges in some jurisdicitions on your behalf.

also, they can go visit and "ask" him to send you the part, although thats not really kosher, and jim, dont read that eh ;)

This guy is in Pensilvannia. There is another member on the other site that lives in his area and is looking into it as best he can. I guess I'll be biting the bullit on this one. I would really like to see this guy get what he deserves especially if he's doing it to other people.

Kato... as far as pursuing something civally... unless you're goin there or he's comin here you're SOL..... it is illegal to fraud someone like this and the states have strict rules about this... trace the m.o and see if it was cashed.. also put a stop payment/cancel on it as well. There is nothing else you can do unless he signed an agreement of some sorts... sorry man :(

kosher is the reference to jewish food that they are permitted to eat under judiaism, basically disallows pork and some other stuff i cant remember.

so, when somethings not kosher, its by jewish terms, not cool.
and i didnt loose anything, i do suggest you read the whole thread to find out the actual details.

jim, i was just referring to the fact that its not really good to suggest someone go kick the guys ass, lol :)

also, kato, my friend from chicago told me that you can contact the USPS and sometimes they take a hand in things like this, but i have no idea who you would contact.

To wonderful world of the internet, I was able to find his home phone number from whitepages.com.

How should I proceed, I haven't called him yet, I don't know what to say. Any suggestions would be great. I want to resolve this in a mature manner...if he's a young punk then...look out. :o :angry: B)

Kato get a friend to write out some dialogue and then have your friend call him pretending to be your attorney and scare the shit out of him

make sure you cancel the money order fast.....I've been screwed like that before....

i would take Jims advice and cancel teh money order and check through the MO company to see if it was cashed......if I send a MO i always use a post office one because they are able to tell very easily if someone has cashed it because they have to sign for it when they get it. Good luck with what ever you decide to do.

BTW- I would call the guy and be straight up with him....just let him know what YOUR options are and what HIS options are....maybe just maybe he has made an honset mistake or something has happened to him not allowing him access to his computer....

I see...well the MO was from my bank, so it's garenteed funds. I can't cancel it. :( . I'll probably just call him and ask what's going on. If he hangs up on me...I'll know that he's screwing me and than the "lawyer" will come out.

The bank should still be able to tell you if it's been cashed or not...

..after a certain amount of time The TD bank would let me stop payment on one and give the money back as long as it hadn't been cashed....
