does this usually make a difference on whether they throw it out or not..i know that if its with your name and or address, its more of a concern...but how about the spelling of the month? or is it all myth?? he spelt the month as Februay...im sure he meant to put it in but his handwriting was terrible....just a question...sure ill pay the ticket...but like many of us i think if we could find a way out then we would... id rather put the 70 bucks into getting a new exhaust with outlet...thanks

| you can only get it thrown out if they screw up on the make, model, or license plate.... year almost doesn't matter same with your name etc... |

| i dunno if that is completley true cuzm y dad got a speeding ticket and the screweed up on the date and for that they droped it man i dunno go downtown and check it out................. |

Really the only time a ticket will be quashed (thrown out) is if it is for the wrong date such as January 01st, 2002 (for this year - 2003) or the Court date is wrong. Some members use abbreviations & some add things like the "st" behind "01" etc. These aren't things that are called fatal errors for tickets. When it comes to names & addresses we have to go by what's on the driver's licence or what the violator gives us & it's surprising to see how many errors are on driver's licences ... here's a good one: "Drayton Valley, BC". I've written tickets to two different people in one vehicle & later found that I put the first name of one w/ the last name of the other ... they each got a call from me saying the charges were not going forward & it was their lucky day. I'm not big on following up with additional charges if I'm the one that screwed something up. Putting the wrong Section or the wrong Act also ends up in the ticket getting quashed. Lots of times it's the Court stenographers that find this out when the computer won't let them enter the ticket because for example: Section 98(6)(e)(ii) of the Highway Traffic Act does not exist. As far as vehicle descriptors they usually don't appear on the copy you receive but if you contest the ticket you can ask for disclosure which will give that information. This info does not form part of the charge but if it's wrong it can give a Judge / Justice reason to find in your favour because if the officer made a mistake here then what else did he screw up. When times are stated we all have to realize that no one ever has the same time as the next person.
Well there's my "Ticket Writing 101" lesson. Now you can all go to the local arcade / pool hall for a "Hand - Eye Coordination 201" lesson.
ALIAS81; if you have the time you can always go & ask if the prosecutor can do anything for you (lesser fine etc). He / she will also be able to say if the error made will be a fatal error for the ticket.

I once got pulled over for driving in the bus lane, my clock on the dash showed 6:57 AM. I was on my way to pick up a buddy with a broken ankle on our way to school and I was running late. The bus lane came into effect at 7 AM. On the ticket, my memory is a little unclear, it was a long time ago, it said just 7 AM. Could this ticket have been disputed? I paid the ticket in the end but I was quite peeved by the whole situation. |

There's nothing wrong with going on your first appearance date & asking for some lenience. I'm not saying you have to always plead not guilty & cause a trial to be set etc etc but if you went in & stated the offence happened at 7:00 & the bus lane time didn't start until 7:00 I'm sure something could have been worked out. Did you speak w/ the officer when the ticket was issued as far as what HIS / HER correct time was? Perhaps your clock was wrong ... perhaps the officer's clock was wrong ... perhaps it was the weekend the clocks were set back / forward???
