I have to go to court for a photo radar ticket next week. Does anyone have any good info on how to fight this.

Go try to argue that the photo radar system could have inaccuracies..... etc.
In general, usually if you go to the court house and talk to the crown prosecutor/justice of the peach people .... on photo radar tickets they'll usually offer you a reduction right off the bat so you don't take them to court and waste their time. |

and he says, i drive a toyota and it's imported aswell

Just pay the damn ticket, save yourself the hassle.
You'll probably need a lawyer to get off on it(which will cost you more than the ticket itself) , since they will prove that the radar is always working properly.
And the EPS will bring in some fucking cop who wasnt even there to testify that he got you with "his" radar aswell.
Fucking crooked cops in edmonton.

I got a ticket going 70 in a 50 because the cop "heard" how loud my engine was so assumed I was speeding.
He even ADMITTED that he didnt get me on radar.
I LOST IN COURT.
Suprise cop witnesses that werent there..
Cops who said they got me on radar.....

Similar thing happened to me, I was driving a truck.. went around a traffic circle a couple cops where coming out of BP's and heard my font tires squaking. I was doing 35, so yeah I was speeding by 5km/h, the tires where noisy cause they where my rears and I got stuck in some mud and over heated them.
Anyhow.. the cops assumed I was speeding, couldn't prove it so they hit me with everything else possible, and had the truck towed, didn't actually tell me they where towing till it was up on the tow truck, and I was still inside. Cost me $1400 to get my $2200 truck back 2 days later.
I was pissed.... for more reasons than just them taling my truck.
but with tickets, like speeding, it's always your word vs theirs, and unless you can pull a miricle out of your ass, chances are the jp, judge will take the cops or photo operators. |

Anytime I go to get a reduction I get HUGE reductions.
Also there are quite a few ways to get off tickets like this.
All manufactured products have instruction manuals and in these manuals they have error guides "this machine has a 30% error probability" type deal.
If you really want to fight it, you have to prove a reasonable doubt that the crime was not commited for you to be innocent.
Essentially if you get a hold of the manuals, operators certifications, etc.... you have a very easy chance of having it thrown out.
However think of the opportunity cost. Photo radar tickets do not go on your drivers abstract nor do they carry demerits. If you work full time at a decent paying job, the amount of time you will have to devote to having this ticked quashed will not be worth it in the end. If you're a poor ass struggling student who has nothing but spare time on their hands, I suggest figuring it out and saving some money. |

Yup.
And Kayle is right, they would still have to PROVE you were behind the wheel at the time the crime was commited.... photo tickets are tickets to the registered owner and never appear on your record. Should you be summoned to court for the offence they'll hit you with a careless driving, driving with excessive speed or some jazz like that but again it'll be to the registered owner unless you're dumb enough to confess you were the one driving :P |

| When I was in Traffic court setting a date for my issue a guy pleaded not guilty, but guilty as registered owner. No demerits, but like a huge fine. |

It should be the same fine.
I've had a few "Careless driving" tickets where I was stopped and one given to me that was for registered owner - both were not deserved and both were 100% thrown out of court. Needless to say, the fines were identical. I believe it was $402 a pop if I'm not mistaken (thankfully I never had to pay either). |

If someone did this a lot of photo radar tickets could start getting thrown out and eventually photo radar not being worth using anymore... Anyone agree on this? I would be willing to try and get all the information if people want to donate to the cause haha. With someones elses help though as well. |
