Ticket error? - Click HERE for Original Thread

~30oZ~
Hey guys,

My friend was wondering if his ticket will be thrown out or if he can get out of it some how. Here's what happened, my friend got a speeding ticket and on the ticket the officer marked him down as an Adult but he's a youth...so can he get the ticket thrown away due to the error? If yes, what does he need to do?

thanks for helping him out!:)

Cop might just be able to re-issue the ticket...

Read closely.

in bold lettering above it it says
"THE FOLLOWING DOES NOT FORM PART OF THE CHARGE"

It means that no the ticket does not get thrown out.

So the ticket is 100% valid and you have no chance arguing it.

Pay it, learn from the experience, and drive better.

the only thing that will void a ticket is the name, and time/date of the ticket..

i can vouch for this!!

i got a u-turn ticket, went to pay it and BAM..the officer didn't put 2005..so the ticket was invalid..i win

i should also add, if he doesnt hand in his portion of the ticket it is void as well.

you'd find out when your car got broken into but no cops were available for patrol that day cause they were too busy fighting people who fight tickets...

Sometimes the ticket is BS and should be fought.

But yeah, if you blatantly broke the law, yes just pay up, or go in on the first court date and try to plead it down and suck it up.

Fighting BS tickets are the only way we as the motering public can attempt to keep police inline.

IN the case presented in this thread, if being a youth as compared to being an adult changes the penalty, yes he should fight it.. well plead not guilt to this offence as an adult, but plead guilty to the same offence as a youth. Ont he first court date the cop has to be there anyhow, unless he didn't write any tickets.

In small towns court dates are always on the same day, here in Atha it's Monday, in Westlock it's Wednesday. So if the cop is in court for an assult or drug related case, they deal with the traffic stuff right after. Or right before.

thanks for the help, I let him know what you guys have said.

As a side note, I didn't read the ticket because IT'S NOT MINE!:)

yea maybe we should let the police dictate everythign we do in our lives...maybe we should pay our taxes which pay the judges who sit on these court dates to sit there and do nothing while we just pay fines for stupid things we shouldnt even be getting fined for.. its a right to fight a ticket...innocent until PROVEN guilty in a court of law.. if you lose the case thats it you pay the ticket then..

I have personally gotten out of a ticket that the office put me down as an adult when, at 16, i clearly was not in the legal sense. that was also 11 years ago so i'm sure things have changed since then.

LOL cept with tickets it's more guilty until proven innocent. It's not the cop who is trying to prove you did what you did. You have to prove you didn't do what the cop says you did.

not necessarily. laws are very general. a police officer issues you a ticket based on his personal interpretation of a law. it is up to HIM to prove to the judge you broke the law in every way the law was written. understandably yes things like speeding tickets are pretty straight forward, however each case is different. I dont fight a ticket if i was "caught" speeding but ill fight it if i get an exhaust ticket (i now run stock exhaust but just for arguments sake) theres so many ways the law can be interpreted so i see NO harm in excersiing your rights to a fair trial and providing evidence as to why YOU think its not illegal compared to why the officer felt it was. as i said before if you lose, suck it up pay the ticket, but losing in court is better then bending over and letting a cop who had a bad day stick his dick in your ass
