Hey Jimbo I got busted speeding on the weekend i was doing 127KM in a 100Km zone How many demerits will it cost me?

| bahahaha i got busted for doing that in my buddies car and he wasn't with me! it was bout 2:30am on Hiway 625...just outside of beaumont and it was raining.... I was going one way and the cop was going the other.... couldn't see him or nothin... I was doing 127 in 100 zone and he was if it wasn't raining out and dark i wouldn't give you the ticket so i will mark the ticket as 120 in 100 zone... i was just like shit.............. oh well he was a really nice guy....... i Dont think it was too many demerits... i hope :unsure: |

| The cop I had was a nice guy i think he would have let me go but it was -33C out and he made a valid point that at that speed my car could freeze up |

Hi Jim I got a question for you,
last year I went to court for a speeding and failure to signal ticket right before court the crown made a deal with me to lower the ticket and the demerits to 2, and he told me that the failure to signal was would not have any demerits on it, he told me verbally infront of the officer who charged me.
Now when I went up for my insurance renewal I was given 2 demerits for the signal violation, can that be right?
The only reason I pled guilty was that a 52 dollar ticket he wasent gonna be any demerits? can I appeal this or is this to late?

Hi Brandon;
The 2 demerit points for the failing to signal ticket is correct. As far as being able to do anything about it ... you would have to apply to the Court of Queen's Bench to have the guilty plea esponged. The Court may or may not allow this. Basically you have to explain to them why you want the guilty plea reversed. Then you would have to go through a trial to try & get an acquittal. They may also esponge the guilty plea on the speeding though as that was part of the plea bargain. In the end you may have 5 demerit points instead of 4. I can't tell you what to do but if you were to take a recognized defensive driving course you would add 3 merit points (subtract demerit points) from your licence ... just a suggestion.

| but even if you drop your demerits to 3 it doesnt matter your insurance company doesnt care.it still looks at your tickets. and goes 3 years. |

| That is true, I took a PDIC course and used my free 2 demerits and still my insurance dint care. Dang! |

Here's the chart for speeding ticket demerit points:
01 - 15 km/h over = 2 points,
16 - 30 km/h over = 3 points,
31 - 50 km/h over = 4 points,
50+!!!! km/h over = 6 points,
All of you were right when you answered 3 points to "KAOS41" & "WookeysRX7" questions ... give yourselves a lollipop!!

Anyone receiving a stunting conviction will receive 3 demerit points on their licence. Here is a website that shows all of the charges under the new Traffic Safety Act (coming into effect May 20th, 2003) that include demerit points. I can't see any place where the demerit points have been increased ... only the fines. I have also included a website that shows the new fines (specified penalties) but REMEMBER ... you also have to add 15% victims of crime surcharge to the amount!! Please do not shoot the messenger ... I just enforce the laws ... not write them.

Hey Wookey;
Fail to stop @ red light or stop sign = 3,
Fail to stop for Peace Officer = 5 (it's also a Criminal Code charge if a pursuit occurs),
Fail to stop @ accident scene = 7 (one that you're involved in),
Fail to stop for school bus = 6, (w/ red lights flashing),
I assume you meant @ a stop sign or red light. Then again we all know what assuming does!!

| ouch, tough luck on the bus... Jimbo do you know anything about legally having to yield for buses with a left signal on (letting them in) like most of the bigger cities have? Also since we're talking about stunting.... what about noise violations? My Porsche sounds pretty mean and I think there's a hole in the silencer and well it's bound to get bigger before I replace it and it might be a bit loud on the streets.. what are the regulations for that? I know obviously p.o's don't go around with equipment to measure... if it is a stock set-up on the car you can't get charged right? |

| I would also like to know the laws regarding noise violations. I have heard that it takes several different complaints before the police can do anything but i dont know. the reason that i ask is beacause last year, i was coming out of my last diploma exam (ie finally done high school) and i was rewarded with a long ass warning under my winshield wiper :thefinger: it claimed that my exhaust was too loud and the exhaust tip is too wide among other things. i have a sheepdog cat back system that is moderately louder than stock but its not like i was driving the piss out of my car in a residential neighborhood. I am pretty sure that it was because my gf had just moved into a house that was 2 doors away from the officer that wrote the ticket and he was using his power to his advantage. I decided to do nothing about it and i moved to Edmonton that summer. I guess i am also just wondering what the laws are regarding vehicle noise?? Thanks |

yeah, just a lil bit...keep it clean.
here's a gross statistic. an average male of age 18, with ONE 6 demerit ticket will face an increase in insurance premiums that will cost him $29,000 by the time he's 40. how's that for expensive insurance...think of losing the opportunity to put a downpayment on a nice house. :mellow: |

FYI- noise bylaws are in effect 24hrs a day.....all you need is for one person to compain and the police may come out to speak with you. HOWEVER the noise complained about MUST still be occurring when the police arrive or they cant do anything.....the police must hear/wintess the infraction. You get a warning and then if you keep doing it and the police have to come back you will get a ticket for ~$260.....if you get another complaint and the police catch you again within one year you will get another ticket ~$510......and then if you have a third offenc within a year it is ~$760......this is for "cause objectional noise"
there are also HTA sections for Inadequate muffler and use MV to disturb residential area between 10PM and 7AM......
just to give you an idea of what you could get hit with.....
