Name spelled wrong on ticket? - Click HERE for Original Thread

I got a speeding ticket last night. The cop spelled my last name wrong. It is spelled MacFarlane and he spelled it Mcfarlane. Does this affect the ticket? Can I get out of It?

I'm pretty sure you could... go to the judge and say, the ticket is for this man, but that's not me!:thumbup:

Cop will probably just re-issue the ticket, especially for something as trivial as the prefix to a surname.

i got a noise complaint ticket living in my last house (wasnt even loud, just a small stereo playing) and the cop dated the ticket with the wrong year AND day. at court they told me they would just reissue the ticket. the strange thing is they never did.:dunno: from what i was told when i was asking around about it is that its more or less 50/50 chance of getting off or getting reissued.

You got a ticket for a noise complaint? Usually, they just tell you to shut up and keep it down... :confused:

ya i had asshole neighbours. i showed the cop the loudest the stereo could possibly go, which wasnt even loud enough to hear in the basement so i dont know how my neighbour heard it. the reason we got the ticket is because the jerk called the police at least twice a week for noise complaints when we werent even loud. i have a feeling the cop purposely dated the ticket wrong, because he realized the guy next door was a tool. he said there was times the guy called the cops for a noise complaint and when he came to the house we werent even home, hahahah.

I dunno i guess I will pay pay the ticket and be on my way. They would probably just re issue it anyway

go into the court on the day the ticket is due. and then show them.. more then likely they will toss it. be nice about it. the only person that can issue you the ticket is the officer that wrote it originally so if hes not there that day he may not waste his time re writing you the ticket.

It should be Void since they spelt your name wrong..

go in on the day and tell them he spelt your name wrong.. and They Better Void it... :p :thumbup:

another quick question. I am gdl and it is my first ticket I have heard that you dont get demerits for the first ticket and if you do how many would i get. 37 km over the speed limit.

GDL or not, demerits come with all "real" tickets (not photo). One ticket will not affect your license (or insurance), but the second will...

So look out for those No Parking signs, obey the speed limit, and keep your nose clean.

Speeding under a GDL is pretty dumb, no offense. You'll lose your license a lot quicker, especially for something rediculous like 37 km/h over.

Slow the hell down and you'll be driving a lot longer and a lot cheaper than being a meathead about it at 16 years old.

just because they spelt it wrong may not void the ticket. as long as theres no doubt it could possibly have been someone else.

as said before the cop can re write the ticket within a 6 month time frame whether or not its thrown out.. that ticket can be thrown out and then the officer can issue another ticket to him only this time im sure hed spell the name right.

This is an issue that's come up a few times ... I was at court once waiting to fight a ticket, some kid came in with the same problem, he spoke to the crown prosecutor who told him "if the ticket is not for you, what are you doing here?"

anyway he made it sound like, too bad... once the judge showed up the crown dropped the case.. so it's worth a try..

I dont know how this works but wouldnt it be a better idea to let the ticket expire and have them issue a warrant?

Seeing as it isnt your name you shouldnt have a problem..

I dont know if they use DL #'s to issue warrants but if it's by name my theory would work...

for my ticket they misprinted the date they said something like tuesday nov 1 instead of 11 and when i went to see the justice of the court or whatever they voided my ticket

Sorry but just letting it sit is the dumbest thing you could possibly do. It's not going to hurt to go in early and talk to them about it, but I can see you getting in some serious shit if you let it sit past the court date.

I'll admit, I got a pretty bad ticket almost exactly the same as this guy (96 in a 60 zone) and they spelt my name Toker instead of Tokar, I took it to the justice of the peace and he voided the ticket. Your best bet is to be proactive and go talk to the justice of the peace.
