well as some ppl know a few of us were pulled over on anthony henday a while back and given exhaust and tint tickets
i am like the only one that is fighting it, and i've got a court date in may, and recentley i talked to my moms cousin who is a police officer in the EPS pretty high up, and was the srgt or cpt of the traffic dept before and now is something else, well anways now hes saying my exhaust is 100% legal and i should of not gotten a ticket for it as i had passed a OOP and it's not loud or expelling any visable gasses like black smoke or anything
so now i'm excited as he will be comming into court with me when i fight this and will be getting it throwen out!! YaY,
just thought i would share this
and also my exhaust muffler outlet is 4 inches (ish) and also 4 inches inlet, and the there is technicly no tip there is just a muffle with a hole int he end and a pipe comming off of it the hole size, to as the law states muffler outlet can not me modified, and outlet of this aftermarket muffer has not been moddified hahha |

you got a ticket which is 100% legit.
your exhaust is bigger than stock and both you and i know that.
A car passing oop means nothing in terms of getting an exhuast ticket.
They wont fail a car due to a enlarged exhuast......its not a safety issue like tie rods or twisted frame.
you'll just end up paying the ticket :rolleyes: |

because no where does it state that a aftermarket exhaust is illegal!
the law states that the muffler outlet can not be moddified lol and it hasn't lol
w/e hes super high up in the EPS and event he cops that i got the ticket from knew who he was
and yea we'll see what happens haha |

Technically the muffler is part of the exhaust outlet... Plus switching in a new muffler with a bigger outlet technically is modifying the stock outlet size since it's not the same size as before.

All you have to do is ask one question to the officer that gave you the ticket.
On a (Fill in blank with car model) what is the stock size of the exaust outlet?
Referring to this law: (2) A person shall not drive or operate a motor vehicle propelled by an internal combustion engine if the exhaust outlet of the muffler has been widened.
If he doesn't know the stock size how does he know it's widened? If it looks aftermarket where's his proof it's not stock?
These tickets are complete bullshit. |

then how come i've had police including the drive of the police tiburon saying aftermarket exhausts are LEGAL, and i have 3 cops names that will back be up not including my moms cousin and his son who are both cops, the police turburon has aftermarket exhausts but is still legal, hell i has a full nitrous kit hooked up, but they say it's legal as long as the bottle is not open on the street.
and yes it states the MUFFLE OUTLET CAN NOT BE WIDENED!! well says nothing about aftermarket mufflers being illegal
i think i will win, hell i won't pay, i'll fight it for as long i could drag it on for, just keep fighting it,
cus it's a bullshit ticket for a bullshit law,
and luckley i met some police officers in the EPS that are COMPLETE ASSHOLES, and ones that are actualy willing to help out |

| a agree...the law is so general, the law doesnt even use the word STOCK, or ORIGINAL OEM part. so why is everyone ASSUMING the law means this. It doesnt say it therfor it does not mean it.. if it does MEAN it then thats for a judge to interpret. not us |

Thats why I think the regulations need to be written or re-written so they're more clear cut, but if they did that they would probably add a buncha shit and really tighten it up.... |

It's a bullshit money grab when they can't find anything else to give you a ticket for. Just go in, show them that the stock exhaust is not MODIFIED, it's merely replaced for an after market exhaust. If aftermarket exhausts were illegal then I doubt EVERY auto store would sell them.

They could, but every aftermarket exhaust would have to have the "For off road use only" disclaimer. like most wannabe hid bulbs and some performance parts like an exhaust dump. |

| we've been through this 1'000'000 times, the tickets do not stand up in court as long as you carefully state that there is no reference for the definition of "stock" or how big stock is. it's been proven many times on here, so dont' be afraid. im sure we've wasted enough prescious electrons debating this. |

shawley. call me and ill get you a packet we put together for court dates just like yours. the one we fought got thrown out with out discussion.
the fact of the matter is that the police are using the law inccorectly, regardless of how big your tip is.
second if you know how to show the court that fact, it will be thrown out.
fact. the law is NOT about the visual, it is about mechanics.

100% correct on that.
I got pulled over the last month I was living in Edmonton for "exhaust". I asked the officer why, and we got into a discussion about the law. I told him I was a lawyer (which I am not) and he quickly backed down. haha.
Being Asian / driving a red car / Magnaflow exhaust = picked on by the cops.
I asked if he would like to meet in court, he said he was giving me a warning instead of a ticket. Didn't tell me what the warning was for, but I just drove off. |

That would be synapses boys. Electrons refer to the outer surrounding of an element which gives it a charge. They can be lost or gained. They are a negatively charged particle. The human body doesnt naturally contain electrons. Just throwing that out there. |
