What if I win in court but get ticketed again by another cop over same mod? - Click HERE for Original Thread

SilverNeonRacer
Ok, here's a senario,

I got tickets for my LED signal lights, they're white, the RCMP said they looked blue.

Now let just say for the sake of the question, when I fight this the Judge sides with me, and I win.

So I put the bulbs back in... what stops any cop or the same cop from writing me up again? Is there something I can carry in the car to say hey, been there done that, and I won, they're completely legal. So the cop doesn't write me another ticket and so I don't have to go throught he whole process again.

The Skyline muffler thread made me want to pose this question.

icydude
why not use red leds?

:dunno:

Soulfly
No chance White LED's would look Blue.. haha..

Carry the ticket with you once they stamp it with "VOID" or whatever they stamp or write on it.. just keep it with you...

Or keep a copy of it with you.. And then if you STILL get a ticket.. Bring the photocopyed version to court and get it thrown out again..

Because red is illegal up front.

The funny thing was I pulled the bulbs out of hte housing while still on, and he agreed, the bulbs where white, but said my factory original housing made it look blue.

Soulfly
well then.. Maybe get some Amber LED's.. I find.. They look better anyway... :P

SilverNeonRacer
And I think white looks better :P

My lenses are clear stock, well not diamon clear, they have a diffuser.

but the Equipment regs say white or amber, but thats besides the point.

The LEDs where just an example, another example would be a bone stock skyline or truck getting an exhaust ticket of any sorts.

you can't be charged for the same crime twice so i'd say it's a go...

i know i would...

Canada doesn't have a double jeopardy law and LED clear signals is hardly a felony offense. You most certainly can get pulled over for it again.

well i'm just saying if they are found to be legal than they can't get you in trouble for it.. it will just get thrown out...

So if I fight a parking ticket and win then it is legal to park in the same spot next time. I dont think so.

If you park there on 2 seperate instances yes.. but if you park there.. and say at 10am they write you a tciket, and if by noon or 2pm... if that tickets still there and you haven't moved your car they can't write you another one..... tow you and write a different ticket maybe....

you wouldn't win if it wasn't legal is my logic here...

Wow does know one know what case law is here ?

Really SilverNeonRacer if you dont want another ticket keep the notes and transcript of the case with you in your car.

And for everyone eles If you get the same ticket for the same reson As long as the circumstances are exactly the same the judge should dismiss it. You would need get an order of transcript, but the cost to get that might be more then the ticket its self. To get an order of transcript tho you need Neons case file number so the court house knows what to look up. but yeah that is the way case law works though. It is called a "precedent" when you do it .

What you said depends on the outcome of the first ticket though.

An enlarged exhaust that you're found guilty for can and will be ticketed again.

A parking ticket for parking in the same spot will result in another parking ticket. And really, why park there again? "Well, I got a ticket last time, but this time... I'm sure I'll be fine."

SilverNeonRacer
Well in my first post, it was stated if the judge sides with me or the potential offender and the ticket is dropped or deemed that it's legal. AKA I win.

So Carry the Voided ticket with you..

And if you ever get the ticket again.. Just bring the old ticket with you, to Court...
