So my dad recently received a letter from the City's Planning and Developing Department for violating a Nuisance Bylaw. Apparently someone in my neighbourhood filed a complaint about the number of cars that are on our driveway. We have an old Nova, a Jeep Cherokee, a small trailer, and a small cargo van, all which are on our driveway right now but still leaving at least 15ft. of free space from the main road. (We have a long ass driveway.)
I read up on the bylaw on the City of Edmonton website and apparently any "wrecked or dismantled vehicles, or those that are unsightly and abandoned, unregistered or uninsured" is a violation.

My dad had used all the cars for business purposes and all cars are still functional (except the cargo van). The reason why we have so many cars is that he hasn't found the time to sell them which is why they're left on the driveway. Any stranger driving by my house, looking at the driveway, wouldn't think twice about it being a problem. The City defines a nuisance as any condition on or around Property that is untidy, unsightly, offensive, dangerous to health or which interferes with the use or enjoyment of other Property.
The area around my driveway is very clean and does not look like a wrecking yard. Just looks like normal cars that are parked on a driveway.
Has anyone had this kinda BS happen to them??? Any other ideas on what other arguments I can use to appeal? BTW there's a $250 fine if I don't fix this within a week. :( |

Are they unregistered? If so - that's probably the easiest way for them to get you on it.
You can appeal the ticket, which will at least buy you some time to figure out what to do. However, I would think that with that number of vehicles you will be forced to move at least some of them..... |

btw...If you go to court, you'd find out what neighbour it is and then you get nasty right back and complain about their dandelions!

The first thing I would do is fight it. Primarly to get the name of of the moron that made the complaint. If you go to court, I think this person would need to testify. I could be wrong on that.
The second thing I would do, is that once I had this persons info, I would then study the bylaws carefully and his property and launch an arsenol of bylaw related complaints against him. Every single infraction of them I would notify bylaw. Make this persons life one of which they have created for others.
I am certain the above mentioned person would think twice about making a complaint against you again.
If this person does not need to testify, then you can keep a watchfull eye out on those who watch with satisfaction when you need to clean your driveway up. This should give you a list of "persons of interest". :D

Thanks guys, I will be going to fight this. The trouble I'm having right now is that I will need to present my case in front of a quasi-judicial committee. I will be be given 5 minutes to speak to the panel but I'm not sure what I should say or bring to the hearing.
If my dad goes in with the defense that he is undecided what to do with the cars, would that be sufficient? All he did was just park his unused cars on his driveway. He doesn't have a lot of free time to sell the cars, so he shouldn't be penalized for parking a normal car on his property. Like I said before, most of the vehicles are out of sight. And even when you drive by my house and take a quick glance it looks like ordinary parked vehicles.
What about people who park cars over winter? What about people working on project cars? Have boats on their driveways? Why are they allowed to have shit lying around? Should I take some pictures of my driveway to court from a neighbors perspective?

| I've lived by plenty of neighbours like this and it gets annoying really fast. I also hate seeing junk, its an eye sore, but hey its your property and I strongly believe you should be able to do whatever you wish with it as long as there is no harm(but apparently someone thinks there is). fuckin a-hole neighbours, I'd park a couple of those babbies on my front lawn and start taking the motors out right there. Ya maybe if you lived in a million $ house but I guessing you dont. Go look at a trailer park bet they ain't getting hassled. People like that just piss me off, if you take care of your place that should be enough to satisfy them. On my drive way is a talon rear sub and diff assy, 2 car doors, old varsol tank, old pipes off a chopper, and a rusty sheet metal break beside the garage. Half the time I got a few cars parked around.
If they dont like it tell them to move to a acerage |

Unfortunately, the nuisance laws exist to protect people, and their property value. If YOU don't like them, you have the option of moving to an acreage. If they don't like your property, and it's against the bylaw, they have every right to complain.
You know (Or should know) the laws surrounding these sorts of things. And if you don't, well, that's why you are given a warning first.
I'm all for being able to do what you want with your property - but as a homeowner, I also see that it has to be within reason. It isn't just a home, it's an investment. And your investment directly impacts others. |

Theres nothing but a bunch of cranky :asshole:'s in the city that seem to try and make everyone else's life miserable. Though I can understand why the city would have something like that in place, you've gotta be a real jerk to file a compaint about it. I've got a ford probe that I'm using for parts that was in an accident sitting in the driveway and nobody's said anything about it.
My neighbours gotta focus svt that he only drives once and a while and he parks it on the city street. And once someone noticed it didn't move for quite some time and called it in and someone came out and put one of those pink stickers on it. And he was like :wtf: and just took it off the car.
It just goes to show you the type of people you get to live with when you live in a city. |

i had a similuar sutuation to yours..
I had 83 trans am parked on my drive way and i was doing some work on it getting it ready to go to the body shop and get some work and rust fixed ( it was a lil rusty) so one day i am working on the car and some dude pulles up besides me walkes out and started off nicely asked wut car is it and wut year and wut am i doing...buy after he it makes his neigboor hood look dirty becouse it is an old car in the fairly new neigber hood, so he asked me to get rid of it and move it from here.
first i was wtf and who to hell are u to tell me wut to do and after i told him to leave my property and never come back..
sometimes i just dont undestend ppl like that...

Same thing happened in our neighbor hood. Someone had and old Celica and an old MPV minivan on their driveway with no plates on them. They sat for over a year before 3 people decided to complain. And although I wasn't one of them, I totally agree with them because it made the block look like a trailer park and maybe the owner just didn't even realize how bad it looked.
I obviously don't know what your place looks like, but if one or more of the vehicles don't have registration then you deserve the ticket and I hope your dad has to pay. There is a law and your dad broke it. Take some pride in your place.
Now if they are all registered and not too unsightly looking, I think it is unfortunate you want your place to look like a used car lot, but you shouldn't get a ticket for simply owning several cars. |

Lots of cars isn't usually a problem. But if your lot is covered in a bunch of pos old cars that haven't moved in years and your neighbor wants to sell his house, do you think that might affect him and the price he can get for the house? Of course, and he has every right to bitch. |

| Inlaws has a beater parked in front of thier house by a neighbour. Late that night some smashed in the windshield, all head/tail lights, and totally wrecked the car. No one seen or heard anything. The next morning a call was made to the police to come tow a abandoned car. Funny how life works out sometimes. |
