I was pulled over for driving in a bus lane 97 street by the crazyhorse
he gave me a ticket for "failure to obey directional arrow" because its a smaller fine than a buslane fine. ~$115
now there is no directional arrows on that particular street.
directional arrow, to me, is one that shows flow of traffic and changes for rush hour...
or is the buslane considered directional arrow in some sick and twisted way?
do you think I have a chance to fight it??

there should be a sign beside it or over.
i know you have to venture into it slightly to go onto the yellowhead assuming thats what you were doing?:dunno:

Directional arrows
27(1) When a traffic lane is marked by a traffic control device showing a directional arrow or arrows with or without accompanying words, a person driving a vehicle travelling in that traffic lane shall make only the movement indicated or permitted by the traffic control device at the intersection or other place to which the traffic control device applies.
(2) When a traffic lane is marked by a traffic control device prohibiting a turn, a person driving a vehicle travelling in that traffic lane and approaching the traffic control device shall not make the turn that is prohibited by the device.
(3) A person driving a vehicle that approaches a traffic control device showing a downward pointing illuminated green arrow symbol marking the traffic lane in which the vehicle is travelling may continue to drive the vehicle in that traffic lane.
(4) A person driving a vehicle that approaches a traffic control device showing an illuminated red “X” symbol marking the traffic lane in which the vehicle is travelling shall not drive the vehicle into or continue to drive the vehicle in that traffic lane. |

I wouldn't fight it, looks like the cop did you a favour. If you explain your case to the judge, he'll most likely:
1)Be pissed off for wasiting his time
2)Will enforce the ticket because you SHOULD have been given the higher ticket. This will come out when you try to explain yourself to the judge.

Yes, they have up to 6 months to reissue the appropriate ticket, Pay it and be done with it. He did you a huge favour.

yes it shows on the abstract for three years, Demerits show for two. I think we've all been through this argument before. However your abstract is searchable for up to 7 years.
the Cop saved you a demerit as well be thankfull.

It's up to each indavidual officer. Most in edmonton are too lazy/buisy to track you down again, but they can and do.
If the ticket goes to court and is adjudicated on then you are done with it. Guaranteed Prosecuter will withdraw the ticket if that is your defence. Seen it happen many times.

| According to the sign overhead on 97th, that lane is ONLY for buses between 07:00-09:00, so at any other time you should not be get ticketed for anything. |

No i dont think they can reissue you a ticket if personal information is incorrect because then the legitamacy of the ticket comes into play..was it actually this person, or someone else, was it on this day or does this person have an aliby saying they werent even there at that time.
where as, the TYPE of ticket can be changed as there is still PROOF it was THIS person at THIS time, commiting THIS action.
i know i went to court a few months ago to fight a speeding ticket, the cop pulled me out of the courtroom and said if i plea not guilty he will issue me the ticket i deserved which was speeding 51+ over the speedlimit rather then speeding at an unreasonable rate of speed. (i wont even go into the fact that he told me if i plea innocent that there would be no demerits attached to the original ticket, so i plead innocent and 2 months later i have 4 demerits on my record, called him and said too bad lol ) |

Take it from the horses mouth who has issued many tickets after a 12 hour shift , mistakes happen when your sleep deprived. It can be done successfully you just have to articulate yourself properly in court (fess up to your error). Done it a few times and have been successfull each time. By the way if the ticket is withdrawn it NEVER even see's a court room as it is non existant.

Haven't read the thread, but I gotta say...the guy cut you a break and you're asking if you can fight it? Sounds like a dickhead thing to do. But I'll say "yeah, go for it" so that the magistrate/judge can switch it over and charge you the appropriate fees.
That's one reason I hated being a police officer, even when you try to be a good guy people just whine. You broke the law, you got caught, pay the damn fine and be glad you were cut a break. |

| I agree just pay it.. except if you where in that lane outside of the window(the 7am-9am window) Like if you got tagged at 10:30, it's perfectly legal for you to be in that lane, of if you where originally planning on turning into one of the bussiness parking lots within a 100m or so of entering the lane. |
