Anyone know if Impark reports to a credit bureau if you dont pay? I've heard some people say u never have to pay there tickets and others say u do have to.
I know you have to pay city parking tickets, but impark?

| they report to the credit bureu, however it will not affect your credit report. Basicly you will just get a hundred thousand calls a day from them and lots of threats of legal action. But because it wasnt actually credit given to you, it will not affect your credit. |

Yeah, that makes more sense than what I said. I knew they reported to a credit bureau, I never considered it wasn't credit. Like he said just above me here too, they can tow you, but only from one of their lots. Otherwise it's theft. And man would I ever love to see Impark start stealing cars. I hate those creeps. Overpriced windbags. |

Two things...
Overparking on Impark is not breaking the law. Since when did Impark have the power to enact laws? Get your facts straight.
Secondly, Jim got a transfer to a detachment out of the "hub"...he still hops around on the boards still. He didn't leave because of this so called "complaining"...he knew what he was getting into long before he created an account. Again, get your facts straight. |

I believe it would be trespassing because you have no legal right to be on their private property since you didn't complete your end of the transaction (By purchasing a ticket).
By trespassing on their property they are allowed to engage their right to either ticket you accordingly, or tow your vehicle away and force you to pay storage fees/ticket charges.
So technically, it is breaking the law. Which is why Impark is allowed to tow your vehicle away (But I've rarely heard of them doing this). |

Trespassing means not allowed to enter. Nowhere on Impark's signs does it say "DO NOT ENTER" or anything similar. They have, therefore, not complied with either the Petty Trespass Act of Alberta or the Trespass to Premises Act of Alberta.
They argue that their sign is a contract, and by reading said sign you are bound by that contract. But let me put it to you this way. Have you ever played a video game or bought a peice of software for your computer which, during installation, made you agree to some terms of service? "By clicking "I agree" at the bottom of this page, you agree to........." type thing. Would you believe that the Supreme Court of Canada has deemed those forms of contract unenforceable?
To park on impark land, you don't even have to click I agree or anything like that. You just pull in and park. Furthermore, trespassing can be establish with signs, and even if a person can't read, the law deems you to have provided adequate notice. Contract Law is quite different. If you can't read, or chose not to read, you cannot be held to that contract unless you have signed it of your own free will and accord. You aren't signing anything, you're just parking.
The law is very plain on what constitutes trespassing, and Impark is nowhere near it. If you were charged with trespassing, you'd have to go to court. If you park on my driveway, I can't write you a ticket for $70 and say "Ok, you have to pay me now." I have to take you to court.
The only thing that impark has is common law. What this means is that there have been cases in the past (probably the distant past) that have established a precedent for this type of action. And through that, they believe they have grounds to charge you. What people don't realize is that should you refuse to pay Impark and go to court with them and the credit bureaus for harasment, they've got a pretty decent shot of winning. Which would void their fines and possible award them monetary fees. However, it's likely that at that point they would receive notice from Impark that they are not allowed to enter their property at any time in future, which would then be trespassing if they did.
But basically, our good friend above is right. There is no written, regulatory law violated by parking at Impark. Otherwise, they would have the right to arrest you as owners of that property, which they don't. |
