If it was his first license suspension, so it would only be 1 month, I believe it can be as bad as a year suspension. Worst case senario anyways.

Not 100% certain, but yeah.. I've had my license suspended a few times and thats what I remember.

quote:
Traffic Safety Act of Alberta
94(1) For the purposes of this section, a person is an unauthorized driver if
(a) that person’s operator’s licence is suspended or cancelled under this Act,
(b) that person is disqualified from driving a motor vehicle in Alberta,
(c) that person’s licence or permit to operate a motor vehicle in a jurisdiction outside Alberta is suspended or cancelled, or
(d) that person’s privilege to secure a licence or permit to operate a motor vehicle in a jurisdiction outside Alberta is suspended or cancelled.

(2) A person shall not drive a motor vehicle on a highway at any time during which that person is an unauthorized driver.

RSA 2000 cT‑6 s94;2003 c42 s15

95(1) A person who is guilty of contravening section 94 is liable
(a) for a first offence to a fine of not more than $2000 and in default of payment to a term of imprisonment of not less than 14 days nor more than 6 months, and
(b) for each subsequent offence committed within one year after the commission of the offence referred to in clause (a), to imprisonment for a term of not less than 14 days nor more than 6 months.

(2) Subject to section 98, a person who is guilty of contravening section 94 is disqualified from driving a motor vehicle in Alberta for a period of 6 months from the day of the finding of guilt.

Also note:
quote:
Traffic Safety Act of Alberta
98 Where
(a) a person is disqualified from driving a motor vehicle in Alberta, and
(b) during the period of disqualification referred to in clause (a), that person is disqualified from driving a motor vehicle in Alberta under section 94 or anywhere in Canada under section 259 of the Criminal Code (Canada),

that 2nd mentioned disqualification referred to in clause (b) shall run consecutively to any previous disqualification that is still in effect or waiting to go into effect, as the case may be.

So. If this is his first time being caught driving with a suspended licence, he can get fined for no more than $2000. If he can't pay, he can go to jail for anywhere from 14 days to 6 months. In addition, if found guilty, his licence is suspended for a further 6 months from the time it would have been reinstated. So if he had 2 months left of his original suspension, he has 8 months to go.

And if it's not his first time within a year, or if he's found guilty again within a year, it's an automatic 14 days to 6 months in jail.

The worst part is the mandatory 30 day seizure of the vehicle.
But is looking for a significant fine and a furhter suspension

Cheers

A while back my wife got pulled over... it turned out her license had been suspended due to over $500 in fines, cept she didn't know about it... we got pulled over for some reason, they asked if she knew it was suspended, she said no, they let me drive the car, then her insurance had a cow... so $1000ish and 3 days later I paid off all her fines and got her new insurance.

She knew she had a couple tickets, but was going to wait til registration renewal to pay them off.

But in this senario... I have no clue...

Did he just have it temporarily suspended or did did he lose it from an impaired charge? I'm assuming it was just suspended

But if it was an impaired charge, he'd be facing a criminal code charge with a max jail time of five years.

silvertable58
no he got it suspended when he had to redo the driving test and failed.

Sooo they told him he was a bad driver and "took" his license so he couldn't and he did anyhow??? Ok then.... Tell him to bend over, lube up and walk backwards :P

silvertable58
haha ... yea
no not because he was a bad driver..when he did his driving test..and passed , a couple months later he had a letter stating that the instructor that did the test was not qualified therefore , he had to redo it with someone else and failed lol ..

Lawyer's always a good choice. Some are slimebags, but they all know their stuff.
