| I got out to my car the other day and I look an there is a parking ticket saying I was parked 3.0m from a fire hydrant. The nearest one is around the corner and half a block away  Is there a way to fight this? Do they have a map that has the hydrants laid out or something? The way the tickets written would proves this is fake if they have a way to check. Its a waste of time if I have to miss work to fight it. |

| did you make sure it was for your vehicle? I once came upon the same situation and after I got home I realized that it was for a totally different vehicle. Someone else got it and thought it would be funny to put on my windshield. |

44(i) of RoR I'm assuming, parking within 5m of a fire hydrant. $57 fine.
Are you sure there isn't a fire hydrant there that you missed seeing? It seems strange you'd get a ticket for something like this if you really didn't do it, I mean, what kind of moron cop would mistake a dog or something for a fire hydrant? Bear in mind too, that the hydrant could be for away, like up against a building or something, but you need to remain 5m from the point on the curb closest to it. Maybe there's a fire hose plug-in on the side of a building near where you were parked? Otherwise........I'm stumped how it could've happened. That sucks.
I'm not entirely sure how magistrates work in AB, but in MB you could take your ticket to the law courts during the prescribed timeframe, and speak directly with a magistrate. That magistrate had the power to void your ticket or reduce the fine if you had good reason, but could also just assign you a court date to fight it. If you have a photo of where you were maybe he'd give you a break, but he might think the cops notes would shed light on everything. Guess you have to decide whether it's worth it or not. |

Cops don't give parking tickets...that's what City of Edmonton Parking Enforcement By-law officers do, under City of Edmonton bylaw 5590, which can be found on the net. |

| I use cop broadly to mean peace officers, as defined by any act which empowers them. Bylaw officers are defined as peace officers by bylaw 5590. Afterall, EPS officers are entitled to write parking tickets, as are RCMP. Besides, what kind of moron bylaw officer would make that mistake? |

Not taking sides in any way, but you're assuming that a Bylaw officer has less brains than a guy with 30 posts on this forum? :p

| Uhh. when did I say that? I'm asking this guy if he's sure there wasn't a hydrant there because I can't see anyone who would issue a ticket making that mistake unless they're a moron. Good lord man, read before you jump on my case, which you've now done twice in one thread, for no reason, and the first time even had nothing to do with the guys question and was completely irrelevant, which is unfortunately a trend I see happening in this forum. |

thanks for calling me an idiot cause I havent posted alot, Ive been around here since 2003. :asshole: Apparently the code is one letter off the right one and the guy might have left notes and apparently that doesnt invalidate the ticket. I really did look for a hydrant and like I said its at least 100 feet away. If I cant fight it Ill just pay it and make it worth my time. |
