Im 16, and was turning right onto calgary trail on the way out to lunch.
I didnt carelessly go through the stop sign at 40 or anything, i braked to the point where if i braked anymore (for a split second) the car would have been dead stopped, but i "rolled" through the stop sign seeing as there were 0 cars on the road, and i was met by an officer walking out into my lane...F@#$.

anyways, went through the process, didnt say anything disrespectful, wasnt short with him...$287!!!!!!!!!!

first time offence, no history of recklessness

i was told by the officer at my school that i may have a chance on getting it changed from "failing to stop at a stop sign" (287, 3 demerits) to "failing to comply with a traffic control device" (around 110, 2 demerits).

the demerits are huge as they will cost me more down the road (insurance).

advice on how to proceed?

o and p.s. please no comments about reckless teenagers or learned your lesson and such, i feel like an idiot already and im the safest driver out of all the guys i know that have a car, hands down (they stunt, race, run lights dumb stuff)

ya i was like you i am 17 now but i did do all the stupid things then got pulled over 5 times in a week not one ticket all warning and i learned my leason but ya these demerits are killers for use young guys they are painfull hope you can get around it and ya wat you talking about money an issue dont lie but gl wth it man ps i never stop at stop signs some are pointless

Article 57 of the Rules of the Road, fail to obey traffic control device, is a $172 fine. But yes, it is only 2 demerits instead of 3. I'd recommend showing up for court and asking for leniency. Mention it's your first offence, describe what happened, and see what you get. I've seen cases like these busted down to warnings, though I wouldn't hold my breath.

It's certainly possible you can get found guilty of a lesser violation, be found guilty of 37(a) fail to obey stop sign before entering an intersection but be given a reduced sentence, or be issued a warning. But you have to remember if you do try to have things reduced, that the violation you made WAS 37(a), and there's no guarantee that says it WILL be reduced even if it is a first offence.

What you need to remember is that the judge has his discretion to do what he thinks is in the best interest of public safety. Some judges might argue you're likely safe and have learned a great deal and would reduce it, others might say you won't learn your lesson unless treated harshly, and it could go any way depending on who you get. So don't get your hopes up, but I think you have a fair chance. At worst I'd say you have a 50/50 chance of a reduced sentence, maybe better.

Also remember, people of all ages and experience levels "roll through" red lights. I do it from time to time, though I really shouldn't and I've got a squeeky clean record with a boatload of driving courses under my belt. My friend just got one. So don't beat yourself up too much for it.

you learmed your lesson but still don't stop at stop signs? Sounds to me like you didn't quite learn it well enough. How do you know the stop sign is pointless? That's like people who argue whatever speed limit on a certain street is dumb and it should be higher. Are you a civic engineer? Are you a city planner? If not, then you really can't say what is or isn't dumb since you're not quite qualified enough to be able to make those decisions.

don't compare yourself to those who behave worse than you do, its not a good display of character

always stop for a stop sign. they are always there for a reason. also, you never know if there is a cop lurking around the corner, even if its just a 'pointless' stop sign.

try it out in court if you like. the worst that could happen is that you have to take the whole bit.

no i have seen cops run this stop sign like a yield so i donno you would have to use the srteet every day to understand my point but thx ya i mean like rolling stop i tend to do iti now its bad

Finally someone posting respectful request's. Glad to see, sorry about your luck though.

Here's what you do, show up really early to court wearing a suit or nice shirt and tie, No cartoon characters!!! Do your hair nice remove any earrings or piercings (for Court) Approach the prosecuter politley and advise the prosecuter your sorry for what you did but as a new driver you would really like a brake and you have learned your lesson. Advise him you will pled guilty today to the Failing to obey Traffic Control Device for the $172 and that he will never see you in court again. SOB SOB SOB. The prosecuter will likely cut you some slak.

If the prosecuter won't you'll likely have to plead not guilty and present your Story to the judge later on down the road. Most cases if you talk to the prosecuter really early and show a great amount of remorse, you'll get cut a brake. If you catch him two minute before court he won't even talk to you. or worse will be pissed off and tell you he doesn't care.

Anyway hope it works out for you best of luck.

It doesn't matter how often you drive the street, nor does it matter what cops do.

And respectfully, I think you could potentially get some slack on this ticket...but keep in mind as stupid as this ticket seems, there is a purpose to that particular location being a stop sign vs. a yield sign. Whereas with a yield sign, you will be usually looking to your left as you check for oncoming traffic, but as you're rolling forward, there could potentially be a pedestrian stepping off the curb on your right side, that you would otherwise not see unless you took the time to come to a complete stop, right?

It seems stupid, and sure there are plenty of intersections that would otherwise seem better off as yield signs, but I've seen quite a few locations with yield signs changed to a stop sign because of the carnage that has resulted from driver's only looking in one direction.

Good luck with the ticket though. You sound like a responsible driver.
