So I'm heading west on 153ave about 58th st, I yeild to a peddie crossing the road, a teenage girl dressed all in black with a black overcoat, didn't press the button, but she's crossing anyways becuase everyone else heading west is yeilding to her. She's gabbing on the phone, whatever.
There is a dark purple sunfire heading east, not paying attention or what have you, moving at a fair clip, about say 60-65 Km's/h. This lady in the sunfire is heading right for the teen, a black GMC Yukon facing north making a left turn onto 153 to head west is honking like crazy to warn the teen, just as I do a sharp intake of air to yell, it happens.
Not a dull thud, but a sound similar to the squeaking of a sneaker on a gym floor.
The Sunfire, luckily enough, clips the teens back leg in some kind of miracle, as the car managed to *just* miss scooping up the teen and spinning her in the air.
Without missing a beat, the teen spins on the woman in the sunfire who at this point has stopped and is screaming insults at her. I beleive I shouldn't have to repeat them here.
The teen continues her original course across the road yelling at the sunfire and still on the phone.
The sunfire takes off, the teen continues her path un abated. She didn't seem injured and was more intent on getting to wherever she was going, the sunfire was long gone. Nothing more I could do, so I left.
If that is anyone here on the board, I'd be happy to be a witness to this incident.
I do have a question... If this teen was paying attention and wasn't on the phone, you think she would've gotten across the road unharmed?
WTF was up with the Purple/Dark colors Sunfire?
Too many questions. I hope the teen is alright and learns to not be on the phone all the time and I hope the driver of the sunfire gets her license taken away sometime soon. |

do u have the license plate of the sunfire?
hang on to it, but generally without a victim, police can't really pursue charges...so until the girl comes forward, it's pretty much a dead case. |

| well its good that no one was hurt or at least that it wasnt' worse then what it was, and your right kids gotta wise up a bit crossing a road without hitting the walk light thing and wearing all dark clothing at night as a pedestrian sounds like a suicidal personality to me |

Some people just don't pay attention sometimes..
Twice in this past week.. I was slowing down because I saw people Crossing on the opposite side of the road, So that By the Time I got the to Ped Cross walk, I'd be stopped, and they would be crossing infront of me.. Well.. If thats not Obvious.. Some Ford Tarus, Some old hag Driving, is plowing along, so I tap my brake lights quite a few times to let her know she Get's the hint as soon as they pass my car and she stops within Inches of the crosswalk. The people just look at her and shake their heads..
The Other Incident was Simmilar But with an SRT-8 Charger.. I saw Him cruising down and I was stopped.. and I didn't see him slowing down.. So I stuck My arm out the window and Waved Stop. But this Guy knew as soon as He saw it, and stopped right away...
People Need to Wake Up at Ped Crossings.. and Ped's SHOULD Be Responceable Aswell.. If you see a Car flying.. and It's Not gonna stop, Don't Cross.
This Isn't 'Frogger', Like when you die.. You can Start a New Game... |

I got hit once at a crosswalk walking my bicycle across, lifting it over a meridian when a girl in the inside lane plowed into me. I think she was actually doing her make up (no joke). My shoe was a little ripped up but I was like whatever, picked up my bike and kept going on my way.
Had a few other close calls at crosswalks. That one on jasper and 115 st is terrible it needs lights. It used to be really bad there in the summer when everyone used to cruise up and down jasper ave. The way I do it now is only cross one lane at a time and wait until each car has come to a complete stop. |

Myself included. Trying crossing a road in Quebec ;) .
I usually cross one lane at a time, but a few times I've had the driver stopped in the one lane I'm waiting in honk at me as if I'm deliberately trying to slow down traffic... |

last week some friends and i were nearly hit by a city of calgary truck, this was in the afternoon and the crossing lights were turned on.
luckaly we always do the one lane at a time trick, and just as we peered around the bus to see if it's the truck flys through. |

| On two occasions I've had kids run/skateboard across the ped crossing where there was a bus parked obstructing the view of the sidewalk and they didn't hit the lights. Damn unnerving I tell ya. And the stupid thing was they didn't even check for traffic, they just kept walking expecting me to be able to stop. |

| ETS bus drove through a red downtown at 101st and Jasper Ave. as I was crossing last year. Luckily he was paying enough attention to honk at me, but still not enough to stop at the light that had been red for 10 seconds. |

Here's my take:
if a pedestrian chooses to cross anywhere other than a marked crossing or chooses to not activate the lights when available, then a driver should be able to charge them with something in the case of an accident, i.e. the pedestrian should be held responsible for their own actions.
If there's no crossings reasonably close-by, i guess it should then be 50/50 assuming the walker uses hand-signals before entering the roadway.
I thought we had rules which spelled-out expectations for pedestrians and bicyclists, like jaywalking and self-endangerment. how come nobody ever gets charged for it?
I'm not saying that drivers are innocent, but they have enough shit to look at with all the noob drivers and impossible-to-read signs and craters to avoid, without adding rollerbladers and shit like that attempting suicide by crossing without warning anywhere and everywhere.
In summary: I feel no sympathy whatsoever for a pedestrian with a ford emblem permenently imprinted on their hip, 100 feet away from a marked crosswalk that they didn't use-and I've seen it several times. |

back in 99 I smoked a pedi, He was crossing left to right, I was inthe right lane, It was Dec 17, a little cool, I saw a car stopped, and only 1 car stopped, no brake lights, no signals, no exhaust smoke, nothing, so I started to slow down, I get closer and I see the pedi right infront of him, so I hit the brakes, my passanger tires caught some slush in the right hand lane, and locked, both front and rear, I was moving towards the curb, pedi was standing still, we made eye contact, I was think, ok worst case I mash my new rims onthe curb.... I get within 15/20ft and the pedi starts running, towards my car, I'm thinking Ohh shit... so I start crank the wheel left hopeing to swirve the other way, keep in mind all 4 tires are locked at this point. I managed to pull the car back 3ft, and I just clipped him enought to toss him on the hood, and into the windshield.(I think my scoupe slowed him down.
Anyhow, he wasn't in a cross walk, the officer after talking to all the witnesses(they where all crap, only saw the after affect. I explained my story, what happened, what flashed through my mind like re-applinig the brakes, releasing ht brakes and hitting the gas to pull the car in a diff direction, release try to use first to helpo slow down, using the e-brake, and in this situation, all those options probably woulda caused my to hit him faster or the brake probably woulda put the car sidesways and I woulda hit him with the side of the car and he woulda went under.... The cop said I did everything I could, I didn't get charged, but neither did the pedi for jay walking. His wife did file suit, they tried for $600,000, and to my knowledge it still isn't resolved. The pedi died a year later from other medical problems.
Then I was on the recieving end, I was rollerblading to work I was at Japer ave an about 98-99st, a jeep was stopped at the red light, he looked right
, not sure if he saw me, then he looked left for traffic, I stillhad the walk sign, so i crossed, and he saw a brakein traffic so he floored it, I saw him (I was right in front of him) I turned, tookt he hit straight on, made this loud "slam" noise on his hood, he was still lookng left, he looked at me on his hood and freaks out, his the brake, I kinda flew off his hood, managed to do some tirwl thing on my blades so I didn't land on my ass or out in traffic, the guy look mortified, I looked at this jeep, no damage I seemed fine, I just yelled at the guy to look next time, I was concerned about late for work so I took off, I found out a block 2 tow a way one of my roller blades had broke, so I limped along, got almost to work(15blocks away) and the blade broke completely so I swapped on my actuall boots, tossed my blades in the trash hoofed it to work, clocked in sat down and promply hit the floor.
Soo yeah...
I've been on both sides of the story, and it sucks.... I actually think it's worse being in the car, when they pedi went up on my hood, his body contorted in such a manner I thought he was dead.
Wow what's with me and novels today. |

Funny I was hit when I was on rollerblades. Same situation except it was a work van. It ooked like something out of a cartoon I'm sure with me flattened across the front of the van for a second until he slammed on the brakes. Wasn't hurt at all though. I think being on blades helps cuz you roll with the hit a little better. |

Also helps if you turn into the vehicle so your joints are bending the way they're supposed to, not sideways :P
You want cartoonish. I posted this before, but I was on whyte ave a number of years back, I saw a drunk lady get smoked by a small older toyota car, I saw her bounce across the road, didn't see the actual impact due to a tree, but I saw her flying from the front of the car. I swear when she was flying through the air it looked like a scene out of a cartoon where they get punched in the stomach and go flying ass first. She was a little out of it when she was on the groudn, she was drunk. The paramedics said her injuries didn't look too bad at all. Poor driver had a green, the look on his face was wow, I swear he probably took him a good month or two to get behind the wheel again. |

SilverNeon, I sincerely hope that you are able to put the whole ordeal behind you. That really is a bit of a wrecker, hey? You must felt like shit for a long-time...even if you weren't at fault. I know that sick feeling to the gut though...
Anybody see the ped hit by St. Albert Transit in August? That was insane...she decides to stumble out in front of the bus on St. Albert Trail...the skid marks from the bus were insane...like 20ft long. Medics thought she was going to pass so they called STARS for instant transport to the hospital. Her worst injuries? A broken rib. Dr's prognosis: the level of alcohol in her body saved her. Police report: had she not been drunk, she would have possessed the common sense to not play chicken with a bus. |

Oh my god, University is the worst for that...
Noone cares, they just cross.
I really wish the EPS did follow through with their threat to remove right of way from pedestrians.
Maybe then, they'll take some care to their surroundings.
Until then, my $40 air horn from Gregg's FTW :) |

Post Ressurection: I have the stupid pedestrian story to top them all.
I was going east on 76th ave, wanting to turn south on 75th St. There was a transit bus in front of me. The bus stopped at the red light, and I saw a lady and the fattest kid I've ever seen standing on the sidewalk a little ways from the intersection, looking at me. I figured that they wanted to cross, so I stopped 1.5 car lengths behind the bus. This corresponded with an intersection of sorts, so they wouldn't have been jaywalking to cross there.
I waved them on, but the lady just gave me a stupid look. Fine, whatever.
The light turns green, and the bus moves about a foot and then stops, waiting on the now oncoming traffic. Suddenly the moron on the sidewalk takes off at a full run, behind the bus and infront of me, dragging the kid along with her. She was looking back at the kid as she ran out from behind the bus, straight into the path of a pickup truck. I didn't even have time to honk, it was that fast. The truck missed her by less than a centimeter, and the guy driving it must have pissed himself. She didn't check her running when she almost died, instead kept running until she got to the other side. Then she turned around and started berating the guy in the pickup. WTF!
Anyway, I was kind of dissapointed. I though I would get to see what Jabba the Hut would look like if hit by a car. I wouldn't have felt sorry for them at all, darwinism is a great thing. |

| its completely possible the lady in the sunfire would have gotten away with hitting her. If the girl did not press the crosswalk button it is her own fault if she gets hit. however she was in the crosswalk and other cars stopped so it could be seen as neglagence on behalf of the lady driving the sunfire. If you guys do not remember whyte ave before the lights were installed many people got hit at that intersection infront of plush and a few died i believe. Its a crosswalk but had no lights and i believe a few of the accidents the drivers walked away without charges |

| Try driving in Montreal. Pedestrians have no regard for crosswalk lights. and the drivers there in turn have no regard for the crosswalk lights either. |
|
|
| dtjohnst |
Pedestrians have right of way, no matter where they are. People seem to forget that, like they seem to forget you should keep right unless you're passing.
That doesn't mean "jaywalking" isn't illegal. Impeding traffic certainly is, but regardless of where a pedestrian is, they ALWAYS have right of way, ie anytime you hit one, you're in the wrong UNLESS they jump in front of you. If they're commiting suicide or give you no warning, you can't help that, but at no time can you make any other argument.
Driving is a privilege, moving around is a right (right to liberty, section 7 of the Charter). You can exercise your right without a car. It's kind of like how wildlife has right of way. The fact is, your car might be damaged, but a pedestrian will probably die, that's why they get right of way.
As for the lights....not all crosswalks have lights. But more importantly, ANY intersection is a legal place for pedestrians to cross whether marked or not.
I deliver pizza, so I drive alot. And I see people standing on street corners for a long time as cars zip by. I stop and people behind me honk, but that's what you're supposed to do: yield to pedestrians.
Besides, it's hard to see lights during the day. Lights, markings, etc, they're all just designed to increase visibility at busy intersections. |
