Fighting Tickets, is there a "How To?" - Click HERE for Original Thread

type r
Hey, I know this has been asked many times, but can I get a detailed breakdown of steps to fighting a ticket?

So far what I have is, Go to court on the date and plead not guilty. After this do they give you another date to fight the case?
Also if you get a traffic lawyer to fight for you, will they do this all for you? also can you go to court to plead not guilty, then get a traffic lawyer to fight it for u after?

Most of the traffic help you get won't be a lawyer. It's usually just a retired cop who speaks to the prosecuting team before court and tries to get you a deal. If you're thinking of hiring an actual lawyer, you should do it before your initial court date. He/she may want to be present for that, so it'd be best to ask them.

Otherwise, yes. Initial court date, plead not guilty, get new court date when the police and witnesses (as applicable) can be summoned, argue your case. In some cases you may not get another court date, there is a chance the judge/magistrate will tear up your ticket then and there, but don't count on it. THat'd only happen if he's compelled to believe that there isn't sufficient evidence to warrant having an actual hearing, but since he hasn't seen or heard the evidence, it's unlikely. But it can happen.

But to be fair, I've only been to court once out here, and it was many moons ago, and I did so as part of the prosecuting team, so that info may not be completely accurate, though I believe it to be. I'm sure someone who's been to court more recently can confirm or correct me.
