bus lane infraction & muffler ticket, can I fight them? - Click HERE for Original Thread

well i got pulled over on way home driving in a bus lane on 97 and got a 172 dollar ticket and a 115dollar ticket for my muffler and is there any way i can fight them????

please help me 1st time getting pullled over

You can fight them by paying a visit to court, everything you need to know is on the ticket. I don't think it'd be worth hiring someone, as neither ticket carries demerits.


Although, I'm not sure what you're going to use as an excuse for the bus lane ticket. I mean, you were or weren't in the bus lane. The signs are clearly posted.

well the bus lane ticket take off 2 demerts so i dont know what to do

say you were turning... go in offer to plea guilty, pay the fine and in return for no demerits.

Ahhh - it's marked as Failure to Obey - I forgot about that.

In Alberta PLPD insurance is regulated by the government. And they allow you one minor ticket without raising your rates. So this ticket will not affect your record (If it's your one minor ticket that is).

i could say that can i just go do that whenever?
and he made me roll up my window and said if i dont the tint taken off by monday i am going to get another ticket sent in the mail

also is it true if theyu dont put ur full name on the ticket u can fight it?

What about your muffler? What's the ticket for, and what is your muffler like? We can't answer blanket questions without details.

You can go to court and plead guilty and ask to have no demerits, but if they say "no", you've now plead guilty. They may offer that, they may not, you'll never know unless you go to court.

First name is enough to keep a ticket valid. I'm assuming the rest of the information is correct, so they can easily prove it was issued to you and it was meant to be issued to you, so you could try to fight it on that basis, but you'd lose.

I thought that you were unable to plead guilty to get no demerits?

Or is that law not passed yet ?

Never heard of it. Sounds...unconstitutional. Merely pleading guilt doesn't mean you can't have a valid excuse why you commited the action. That's the logic for "self defense" with murder afterall. You're "guilty", but with reason. Perhaps your guilt stems from mis-information, or some other factor. But a judge/magistrate should always have the power to dish out lesser punishments, within reason.

I heard of that law too, and it's just to enforce crrent law or something you speed you get ticket, the penatly for breaking law is X fine and X demerits, everybody knows that. I read too many people ae getting away with just the fine and no demerits. I'm pretty sure the judge could waive it if the circumstances really warranty it, Not just "I'm sorry your honor, I promise I'll never do it again, it was my first time" but "your honor I was speeding because somebody tried to car jack me and my wife got stabbed, I wanted to get out of the area fast, and i didn't have a cell phone, and I couldn't see any pay phones on the way to the hospital" might get you no demerits.

The way alot of people where doing it in Westlock when I was there is they would plead no guilty to the ticket, but plead guilty as registered owner, so full fine, but no demerits. Dunno if the new law would allow for that or not anymore though

That basically says you can't go to a "First Appearance Center" to do it. I'm pretty sure they can't remove that power from a judge. Like I said, it'd be unconstitutional.

There's a thread here about "enlarged mufflers", read it. You're probably ok as far as has been explained.

What is illegal about that?
I thought it was a ticket for enlarged exhaust, but isent that how the part was made at the factory? so shouldent it be legal since it wasent enlarged by him?

What the hell were you doing in the bus lane?? You totally deserve that one for being a dumbass IMO.

The exhaust I would fight though. It is a stupid law.

But your exhaust does look retarded, I would put something more subtle on plus straight.

i think my car would look pretty gay is it was st8 and not out the the side like that. and i am going to find my silencer and take some pics and then see what happenes. i know about the bus lane ticket i went in for like 5sec to pass some one and there was like 2other people in the same lane as me at the same time

I recommend driving a bus to court and telling them that you were wrongly issued a ticket for driving in a bus lane, since you drive a bus.
