well this is what happened
was driving my gf's car with her in the car, i was stopped with cars infront of me at a red light, car plows into my rear. we pull out and exchange info. the lady asked if i was ok and i said yeah. she asked if i can go get a quote and call her so it doesnt go through insurance and i said sure why not. my girlfriend feels some neck pains and i have some too but its probably normal so i go to a walkin clinic that night, nothin serious, doc says to take some pain killers. next day, my gf and i feel like shit. neck is stiff and kinda swollen. i decide to go into work (practicum) anyways and its like the worst day of my life. im hurtin pretty bad, stiffness and pounding headache so after that day i decide not to go into work or my part-time job. i went to a theraputic message the other day and have a chiroprator (sp) appointment tomorrow. lady calls me today to see if i got some estimates done and i said not yet, im kinda hurting.
my question is, what is the best way to deal with this situation? what steps do i take to claim all these medical bills so it doesnt come outta my pocket? do i need doctors consent before anythin else? do i sue her for whiplash? im not looking for quick cash, just want to get rid of this pain and finish my practicum

Tell her up front that you will be making a personal injury claim, and that you think it's best that you go through insurance because you can't give her a monetary figure at this time.
Then proceed with going through her insurance company for the physical damage and personal injury. There is no use going to her directly for your personal injury claim, only a fool would attempt to pay it out of their pocket.
As well, remember that you have 2 years to file your personal injury claim (Whereas you only have 1 year for the physical damage claim). |

Tell your insurance company immediately. You do not have up to 2 years file an injury claim anymore. You have to start the ball in motion much earlier (several days).
This does not mean that you HAVE to sue, just that you will be able to, if you so choose.
Call your insurance company, and they will guide you through the steps. About lawyers, you can deal with them later if you feel it is necessary.
From what I've seen, you will probably have some pain over the next couple days, then you'll be fine. |

this accident happened on the 6th so i still have time, thanks for the info insomniac and trev
another question is, since it was my gf's car, we have alraedy told the insurance company of what had happened and the extent of the injuries. since i am hurt as well, do i need to contact MY insurance company and tell them what happened as well? or will my gf's insurance cover my ass too?
my gf's insurance company is the same as mine (statefarm), however her representative is shit and didnt tell us shit all what to do except "ill fax you all the info", but she didnt fax me nothin about what to do about my injuries |

is your statefarm agent charlene zoltenko? because if it is, then that would explain her not doing anything...she's the worst statefarm agent i've ever dealt with.

Your section B will cover days off work, prescriptions, docs bills etc, then they go after her insurance - for an actual injury pay out - pain and suffering you go through her insurance(who will sometimes pay you the time off work and perscriptions too, but don't expect it)
10days is BS for injuries... some times it takes that long for symptoms to crop up. (Not arguing with Insomniac, just the system is silly) Shoot one accident I was in it took 2-3 weeks to get intouch with a person at the other persons insurance company just to get a rental.(I was under 25, wasn't getting one on my own)
If you run into any issues with the other persons insurance co, you can call thse guys: http://www.ibc.ca Works wonders... one insurance co was cranky cause I got a quote from one body shop, that body shop screwed me around for a couple months... no work done, then decided they didn't want to do it, so I switched shops. The new shop had a higher hourly rate and the insurance co didn't want to pay it cause "they're not one of their prefered shops" they demanded the body shop accept less than they where gonna pay the first shop, well the second shop took that as an insult and the insurance co adjuster guy kept saying "You can't let the bodyshop hold you hostage like that" so I called IBC.... talked with the guy... not 20min after I hungup with him, I got a call from a diff dept at the insurance co... appologizing like crazy.. and they paid up. |

| I agree with the 10 days thing.. I felt shitty for 2 days then was fine... for about 4 months... then I had nothing but problems and my doctor said its common for injuries to come up months later. |
