Tow Truck Dropped My Car!! Need Advice!! - Click HERE for Original Thread

Ok so here is the story... I was cruising down calgary trail two days ago when all of a sudden I lost all boost and started to blow black smoke out the exhaust... I couldn't find the problem at the moment as it was 2 am and dark where I was... I now find out the boost lines coming off the bov was the problem but anyways...

I called a tow truck to get my car to my house... I called Kingsway towing... They said it would be 3 to 4 hours before they even made it to my car and that if i left the key under the floor mat the car would be at my house after that...

THIS IS MY FIRST MISTAKE!! NEVER LEAVE YOUR CAR WHEN ITS BEING TOWED!!! but i was working the next morning at 9 am...

Anyways at about 6 in the morning I get a call from the towing company and it went a little like this...

"Hi, this is kingsway towing and we have some news about your car..."

At this point I figured the car was to low for them to tow and now I will need a flat bed and it will take longer...

So I ask... "What's that?"

They reply with... "We dropped your car off our tow truck..."

Now at this point i'm not sure if i'm stunned or pissed, probably both... I then ask for the how, and this is what was said...

"Well the driver didn't feel that where the car was parked it was safe for him to get it on his truck... (Where the car was i was visable for more than a km each way, but anywho...) So he lifted the car by the front end just to move it... He figured that it would be safe to get the car all the way to my house... (Which by the way is by WEM)

Boy was he wrong...

Apparently what happened was while driving threw a residential he hit a bump and allegedly the parts that hold the wheels to the truck flew off and well so did the car... Car dropped an estimated 3 1/2 feet, hopped up a curb, and flew into a big mail box that was bolted to the ground...

He broke my HKS FMIC, rad support is pushed in, hood, fenders, window washer fluid bottle :p, dent in the frame rail, and the wheels look like this / \ so i'm pretty sure the coils is done and some other suspension parts, also the possibility of the frame being warped...

I went to talk to the owner of the company today he starts telling me it wasn't the drivers fault and that it was because of my exhaust... and his solution was that he gives the car to his so called "specialist" who didn't even know what a FMIC was... and he CUT the fmic's bottom 3 rows which are crushed and weld in a piece of aluminum... and for the rest i dont even want to get into it...

At this point I just left...

Now my question is what would you guys do in this situation if you were in my shoe's? I think it's pretty awesome how much they don't care sometimes...

Also they didn't report this to the police which is illegal I do believe since there is a lot more than $1000 worth of damage plus the damage to the mail box my car did to it... Are you not supposed to report any accidents that damage government property?

simply tell them to pay for all damages.
if not take them to small claims

they dropped your car off their truck, they have inssurance for those reasons.s

Call the cops and ask them how it should be handled. If they say that the incident should have been reported, pass that on and see if they're more willing to put in an insurance claim then.

They towed the vehicle in an unsafe manner and could have easily done much worse damage. If they aren't willing to shell out the money to pay for their mistake then they could end up losing a whole lot more in the end.

They have insurance, make them use it.

Ya there gonna give you every excuse they have for it but that driver could be in alot more shit.
When I was doing the tow truck thing sometimes I would have to pull a car just a little ways to some were better and you drive slow cause the cars only sitting in the pockets.
I would always throw on at least one safety chain on, it's one of the key points they constantly tell you about even if your in a high-risk Repo just toss that chain on and drag if you have to.
I would recommend talking to the police and for-sure your insurance company for advice.
I bet dude just got lazy cause 99% of the time a car will ride just fine without any strapping or chains if you go slow and make easy turns, do it enough times a day you just say bah.

wow they did some damage eh maybe it will get written of if it goes through insurance. get an estimate and some pics up. fadis towing ripped my celica gt4`s rear bumper off last year they fixed it better then new.

thats harsh dude, the towing company will try anything to blame it on your. talk to the police, call the tow company and ask them weather u need to file a report or are they gonna handle it on their own, they should be held responsible for all the damages to your car. find any little detail and tell them u want it fixed! good luck man.

They called me today about getting you a new FMI sounds like they are going to fix it for you, well I hope they do anyway. I would lose my mind on them and probily get nothing back lol

Worse comes to worse, go through insurance. The insurance company, who has much much much deeper pockets than a piddly-ass towing company, will then sue them for the money.

If they try to blame it on you in anyway, ask them why the proceeded to tow your car if they deemed it unsafe...

With the amount of damage that you described to me at the meet I'm guessing this car is going to be unsafe to drive without some serious work to the frame and subframe.

I'm sure the police would LOVE to know about an accident worth more than $1000 in dammages that wasn't reported... is the mailbox still fucked too? better ask the owner of that and find out if they got the runaround too

ya i am pretty sure it would cost them a lot more to fix the car than to just pay me off... and im going tomorrow with my lawyer to talk to them... i will grab some pics and let you know guys know how it went down...

yep, post updates. im always scared shitless of towing companies. i would never leave a unattended car for them to tow either. but i can see where your coming from.

ive always had the best luck with cliffs flat beds. chain it right every time, very caregul with lowered cars, etc. surprisingly enough. i never use normal trucks.

wow kingsway sucks...i used them last thursday to tow my car to Dougs Place to get the engine bay painted....i made sure to take off all the CF parts becuase i knew they dont take care.....and what do i find??? they didnt have the rear on dollies and they exhaust was dragged for 15 kms on the ground and now i have a nice hole in the bottom.....problem is i didnt know about it until i got the car home after the paint....a few days later....oh well you live you learn....never use kingsway!!!

*UPDATE!*

As directed by my insurance company I was to call the towing company to get there commercial insurance information... So today I had called for the person in charge of this, (who's name and cell phone number I have) 7 TIMES!!! Yes that's right seven times... Leaving a message for him to call me back each time, and yet nothing... I started this at about 10 am this morning and I made my last and final call at 7:30...

First couple calls were a few hours apart and for these he was at lunch, next couple he stepped out, next few he was in a meeting, then again he stepped out missing my call once again, then finally on the last call he had gone home for the day... Even if he was to be going home he could have called me none the less no matter HOW tired he was...

You can be assured that if I don't here from him TONIGHT! The BBB shall be involved by tomorrow morning... It's been almost a week and nothing has been solved yet...

I'm very sorry about what has happened with your car.

Just remain calm and professional when talking with them, be sure not to "threaten" them at all, and make sure you take precaution with your requests.

You can be as pissed off as you want when they are not listening, but the reality is, things will be taken care of much sooner if you remain "understanding" throughout this whole thing.

Personally, I would burn their building down, but... that's me. hah

Honestly though, they were asked to tow your car, and as a professional company, they no doubt tow more than one car a day, and thus have proceedures. Obviously towing it in an unusual way is unacceptable to begin with, but then secondly hitting a "bump" that knocks the car off the truck? Sounds like a careless driver.

THey hired a careless driver to represent their company, your car damaged public property, and sustained thousands of dollars of damage.

Unacceptable by all means!

Good thing it didn't fall off and hit a pedestrian.

well my last call went a little something like this...

Hi this is Josh calling again and I was wondering if I could speak to gary... no sorry he's gone home for the day... ic well can you tell him that i have been trying to reach him several times today leaving several messages to call me back and still nothing... also my insurance company says that if i dont get his insurance information by tonight the BBB shall be getting it tomorrow... and she replied with ok i'll tell him...

about 15 mins later i get a call from him saying o hey josh ya i just got back to the office and i got your messages... why do you need our insurance information... i then tell him my insurance company needs it... he then tells me that if they need it they can call him... wasnt to happy that he STILL refuses to give me ANY information... i then say ok have a good night bye...

now tomorrow we shall see how things go...

You probably don't know me... but I see Kalum around every few meets or so.

Sucks about the car... it was real nice. Hopefully you get a fair resolution quickly.

Kingsway towing does it again this happened to Mr Preicdia . They lifted his bumper up and broke it by jacking up the bump and not at the frame. They didn't pay for nothing and just gave them the tow for free.

man i am sorry about your car but I was just wondering, say your illegally parked and they tow your car and its too low and they wreck it...whats supposed to happen? my gf once dated a tow truck driver and she said they dont care they they'll wreck it if they have too but I dont think thats right. Sorry if this is a little bit off topic but I just dont believe her.

depending on the situation... if the car was in an accident and wreaked they are allowed to do what ever is necessary to get the car in a safe place... but not when the car breaks down on the side of the road... i mean if that were true i would just back my truck up till the wheel loaders were wedged enough in the front bumper so i can just drag it... there are limits to things... as well as common sense/courtesy...

yeah but I'm talking about if your illegally parked. If anyone had their cars towed by autorescue and it got ruined I know where the ass lives that gave my gf all this bad info and even showed her how reckless he was with others vehicles. I know if someone dropped my car or even tryed to tow it I'd go ape shit.

ya i am upset that it wasn't towed properly... and im not sure about being parked illegally, you would have to ask someone else

either way they better fix it properly. you should be able to take it where you want and have them pay for it. who knows how it could turn out if they ask you to pay and they'll reimburse you. I'd take them the estimate and tell them you want this much and if its over the estimate that you want that much too!

Being illegally parked is not a license to damage a car while towing it.

If you can prove that the tow truck driver caused damage to your car while it was being towed, even if it was for a parking violation, then their insurance will pay for it.

kingsway towing is terrible,
last time my buddy's jeep broke down
we had some old drunk guy tow us back, and
he honestly stalled 7 times, and it took him
30 minutes to back up my friends driveway,
burning his clutch and leaving rubber all over
the place. never use kingsway.

I should open up a tow truck business cuz I have a nicer car so I'd definatly be nice to someone elses because I know how it feels. lets just hope something like this happens to this guy sometime during his life and then he'll know how we feel!
