a couple weeks ago, I got my window kicked in when my friend was driving my car. cops came, charged the guy etc. I gave him the QUOTES from 2 different repair shops, 1 that I have had work done before, and another independent office. I gave him a nice letter saying that he had 2 weeks to pay or I will start legal proceedings to get my money. He phoned me up a couple days after 2 weeks and said he has a problem with the quotes, and wants his body man to look at it. Wasnt thinking and said yes, Now that I think about it, I can guarantee the guy will lowball it. (first quote was 1910, second was 1873) I was asking for $2000 to cover all my time, increased insurance of having 2 cars insured at the same time and so on.

He also said that he would file a complaint against me. I dont really care because I wasnt driving, but I am pretty sure he is doing this to try and scare me? If he wanted to file a complaint wouldnt he have done it 3 weeks ago?

Also, If i do end up takin it to his body guy, I am no way comitted with the lowest price am I? I thought in the end, I choose where it goes because its MY car and he FUCKED it up.


ps. The first quotes included new window, pop and bondo the dent on the door and blend in the paint.

any advice would be appreciated.

Well.......

You can choose where to take your car, but in the end you're probably only going to see the money for it if you sue the guy. Him filing a driving complaint will do what? Exactly. Nothing.

The only snag you might right into is the court might decide your friend is responsible since he was driving. In which case your friend would have to pay you and then he would have to sue the guy who kicked in your door.

The bottom line is you don't have to convince this scumbag of anything. You have to convince the courts. And a court won't force you to take the cheapest way out if the place you're going is "reasonable".

I figured I would have to sue him, but i was hoping he would pay me first, it would look better when he goes to court if he already paid off his debt. Is there any minimum for shops that I have to see to get estimates?

Technically I don't think there is a minimum as you can bring your car where you like. However 3 is the general rule of thumb so to speak, just to be nice.

Hi mparns,

dtjohnst is correct.

You gave hime 2 quotes, 3 is prefered. You also gave him 2 weeks to respond, he responded a few days late. You were fair and allowed him to get 2 more quotes.

Now he is filing a complaint. He can do nothing.

If it was myself, I would have told him "I will see you in small claims court" and hung up the phone. Then proceed with the litigation. He is trying to play tough guy. Lets see how tough he is when he is subpoenaed.

At the end of the day, it is your car, you are entitled to take it where ever you want.

It is too bad your buddy may get dragged into this, but that is life.

his wife paid me! im surprised she did, he either didnt have the balls or the wife is the only one in the house with half a brain. full $2000 so its a little better. maybe i should have tried for more? emotional damage, I was detached from my car for 3 weeks!

Yeah, try for more.....if you're an asshole.

You got more than it'll cost you to fix it. Why go for more? Just because you can?
