ok so as far as I know if you rear end someone, your at fault. I understand a agree with this. My question is what if the other person cuts you off so bad that theres no way anybody could have stopped?
I was on a double left turning lane and I had a car to me left that was turning as well as the guy in front of me was also turning. Now the guy on the right of me decided he also had to turn even though I was going straight and turned left right in front of me. I missed him by a mere inch but being as I was in a semi and he was in a VW rabbit I am curious as to woule he be at fault or would it have been a case of me rear ending him? |

Well...there's one potential saving grace in this: 9 times out of 10 the guy doing the rear-ending is at fault, but 9 times out of 10 the guy turning left is at fault too.
Make or break in most cases would been witnesses. Their statements would be the most likely what determines who's at fault.
However, as you're in a semi and everyone knows how shittily people treat semi's on the road, always "cutting them off" (I use quotes because it may not seem like cutting them off but it's hard to haul several tons to a stop as you know) and zipping around them, that will probably work in your favour. Additionally, the fact that you're a professional driver will also probably be taken into consideration.
So, there's no obvious answer in this case, it could go either way, but with a few good witnesses I think there's enough mitigated factors that would work in your favour. |

That's not really a rear ending, it's an idiot making an unsafe left turn..
He would have been at fault for sure |

| in my opinion which i hope is a good one . it would have been the other guys fault not yours so i think u would have had little to worry bout if it did happen . he cut u off and u had very little time to stop cause of HIM cuttin you off . and witnesses would have backed up your statement . |

That right there is the snag. Witnesses often don't want to get involved. Others will have personal prejudices which may effect what they think they saw. You hope in cases like this that witnesses come forward and speak what actually happened, but the reality is more often then not people are left high and dry. |

that is another side that is very true as well . i've had that happen to me and it was a big pile of shit that i had to deal with . cause i'm a 17 year vietnamese kid with the stereotypically look of an asian . but they didnt no who i was . so they quickly went to sayin that i was speedin and blah blah blah eventhough i wasnt . so it can go either way of course lets jus hope that u get the good side of it not the bad . :D |
