The judge’s ruling would force TorrentSpy to act in a manner contrary to its privacy policy, which says that the site does not collect any personal information about its users. In a message to the “friends of TorrentSpy” published on the TorrentSpy front page, its administrators say that they are appealing the judge’s order and will not create logs of what its users do throughout the site without their consent.

File-sharing sites have always had it tough from movie studios and the MPAA. While the sites provide a disruptive medium for sharing data, they are also prone to being used as the medium for the transfer of copyrighted content. The logging process would ultimately lead to some information (like IP addresses) being recorded and turned over to the MPAA. All this, while the privacy policy explicitly states that the Web site will not track its users without their consent. Is this the beginning of a trend where user privacy is compromised for business interest?

Umm TorrentSpy isn't American... They're from the Netherlands.
Doesn't the Canadian law on the subject pretty much in effect say it's perfectly legal to amass a collection, just that collection or parts there of cannot be sold? |

| I use isohunt.. same results as torrentspy for the most part... the MPAA would hate me.. I've got a 2TB file server to hold all my downloads :P |

| i thought american laws do not apply outside of the USA, couldnt torrentspy just say no shove it up your ass and never travel to the us? kinda like that guy from russia i think who broke the dvd encryption ? |

I have everything I need for my 2TB server...... except the friggin harddrives... till then my whole collection sits in a big box of 100 disk spindles, stacks and stacks of media going to waste...

Heh I have a 600W Psu in mine, I'm picking up a 1200W this weekend... then by mid July I hope to have it at 3TB which, unless I replace some of my current drives, (3 - 200GB IDE) with larger IDE drive... or the 5 SATA II 16MB 320GB's I have.. it'll be maxed out. |

The ruling by the Supreme Court of Canada was that an individual is only guilty of copyright infringement if they distributed copyrights materials. So download = ok, upload = bad. With torrents, you ARE uploading. However, since you don't have a choice and MUST upload (at least while downloading), I'm not sure how that interpretation will apply.
There does not need to be a profit made to violate copyright, but merely accepting copyrighted goods is not illegal by itself. |

| Use protocol encyption on your torrents, newsgroups and ftping. Most high end newsgroups don't track usage, most good torrent trackers don't keep usage info (you can always spoof, anyways), and secure ftp is a safe bet, too... |

RIAA and those other guys would have a field day with me... :P I have a 2.7TB file server with 32GB of Music, 320GB of TV shows and 400GB of movies, they're shared... but mainly only so I can watch them from my laptop :P I'm in the process of obtaining another 50GB of TV shows right now.... |
