Was your car parked? If so, it is 100% his fault and HIS insurance will have to cover everything. You're insurance will not go up and you won't have to pay anything.

Finally someone who understand accidents lick balls even when you aren't at fault simply for the time it takes.

There aren't enough specifics to really answer that though. Like Ek9 said, if you're stationary you're fine. If you weren't there are lots of other factors. Generally, however, if you hit something while you're backing up, you're at fault.

this happened to me in january. in my police report i just stressed the fact i was completely stopped and they just kept backing out and then hit my car. in the end there insurance company paid me.

same situation. However if the insurance finds him at fault, good, but if they go 50/50 then it'll be my 2nd accident in 2 years. Some guy told me that insurance companies may triple your insurance rate or drop you altogether. Is this true?

The damage the guy caused is about appro. $750, and he offered me only $250 cash. So I'm a bit peeved at his low ball, however if I go the insurance route, he could lose, and my car will get fixed properly. However even though he backed into the side of my car, because it happened in a parking lot, they might also rule 50/50 then I would lose big-time in my insurance rate. can I withdraw my claim at that point? Or is it too late once you report it to your insurance company or broker?

it shouldnt go 50/50... when backing up if you hit something you are right fucked. when i had to take a AMA driving course the instructor made me stop whenever cars came towards me... i seem to recall him telling me that if someone hits me and i am still moving in reverse i am totally at fault no matter what the other guy was doing. but anyway go through insurance if they say that you are at fault somewhat because its 50/50 just dont make a claim.
