K, so I gassed up at the macs (3 km from my house) and was driving back to my house to get ready for work.
I'm at a red light, it turns green. I accelerate quickly. the next set of lights turns green. there is a dodge neon in front of me. I'm behind him. He turns right, I turn right(to get to where I live) and all of a sudden a cop is behind me, he nails me with:
not being able to provide insurance(fair enough)
highway racing.
I might have been going 80. TOPS. The neon was infront of me with ground effect lighting. But apparently we accerated too quickly for the cop to keep up therefore it's street racing.
Now I'm facing 6 demerits

Call a lawyer. Take a day off work to go to court. Tell your story. Hope for the best.

Honestly.......I wouldn't worry too much. He has to prove intent. Did he stop the other car? If not, he'll have a hard time accusing you of racing...unless he charges with you with racing the police car, which you'd have no problems beating. |

thanks bro for the confidence. i contacted my insurance company and they said it wouldnt even affect my insurance, which is kinda cool.
i'm going to contact a lawyer and pointTS about this too.

I would advise talking to your insurance company again - a 6 demerit ticket should be considered a major violation, and most companies will not give it to you as your one free ticket. |

| Did this happen in Fort Mac? With the way people drive there I'm not surprised that you caught the officers eye driving close to some other heatscore. The enforcement on traffic there is way more lax than it should be as they are very busy there(although the Sheriff's are definitely helping out big time on the highway). Regardless, sometimes the "innocent" take the fall. Wrong place wrong time? If you weren't racing hopefully it all works out for you. As recommended above, get your case together with as many facts as you can and cross your fingers. |

7 years with the Military Police.
I won't use the term "strong case" since I'm not a lawyer. If he didn't stop the other guy, the guy in front and therefore the guy who would have been going faster if it was a race, it shouldn't be too hard for you to argue your way out of the racing charge.
But if 6 demerits is a really big deal to you, I'd definately call a lawyer.
The rest of the advice is shit you already know: don't show up looking like a ganster, be polite, be respectful, don't talk until you're asked to, don't try to quote laws or regulations to a judge, etc. |

Yeah, it happened in Fort Mac..
I usually admit when I'm at fault. Once I even told an officer his estimate was incorrect and I was driving 5km/h faster.
he was a nice guy and knocked 10 off..
so.. when at fault, I DO bite the bullet.
but I dont like being accused when I didnt do anything |

It could be just me but i have a bit of a hard time believing you werent giving that neon a go... cops dont normally dish out massive tickets like that without justifyable cause.
In any case...i was nabbed with the same ticket about 4 years ago...however mine was against a motorbike who i was just playing around with nothing serious..anyway a cop was watching us fuck around and i got the same ticket... believe me..your insurance will be GREATLY affected...i think what your insurance company meant was it wont affect your insurance NOW, but when renewal time comes and that ticket is on your abstract, your rates should double.
Heres what i suggest... get someone like points or tickets. No, they arent lawyers, but most of them have relationships with the prosecuters or judges whatever u call them and are able to negotiate the tickets down.. .when i got my ticket i used Brian from Points i believe it was. My ticket was reduced from Racing on a Highway under a bet or wager, to Noise pollution. (basicly said i wasnt racing i just had a loud exhaust). My fine went from i think it was like 700 bucks to 140 bucks and no demerits.. although you will have to pay about 6 or 700 to points. Either way your saving ALOT of money in the long run... do not take a ticket like this lightly.. |

Thanks for the advice.
I wasn't street racing, I was behind the neon the entire time. on top of that. there was a bit of traffic ahead of both of us. It's not like we could have pulled out and went for a rip.
I will contact points
A couple of questions:
Did the officer pull over the bike aswell?
did the officer have you clocked at a certain speed with a radar gun?
how long did the officer watch you guys for?
He was at the intersection as we drove by. |

Call a lawyer if you are quite sure you have been wrongfully charged. If you know the police have information on you that will secure a conviction, then also call a lawyer. You can fight it to have it reduced to something else, but you'll end up paying a fine anyways.
I have recent experience with this and you can PM me if you have any questions. I got a 'racing' ticket along with 'driving with undue care and attention'. My problem was I could fight it in court... but my witness flaked out. I ended up bargaining and having it reduced (through POINTTS, cost 495$ for their service) to a lane violation with 172$, instead of a grand of fines and losing my drivers license (my insurance company would have dropped me instantly upon conviction). The crown prosecutor knew that I would take it to court if he didn't cut me a 'reasonable' deal, thats how I know a lawyer would have gotten me completely off.
The whole actual event is a long story... but the bottom line was that I wasn't speeding or driving unsafe... the officer just wanted to write set of big tickets. |
