Here’s the story:
I was speeding going home (1:15am) and it was pretty stupid yes I agree. It was going about 90 in a 60 zone. Yes I know speeding is bad, shame on me…I get it. Anyways he pulls me over and comes up to my window and yells at me!!! This is what the convo goes like:
Officer 1: (Yells) and says “You’re going 100+ in a 50 zone!”
Me: "That’s BS. And it’s a 60 zone."
Officer: “OK you want to be like that, fine. I think I know what the speed limit is, I’ve been driving that road for a long long time. Get out of your car asshole with your documents in a stern and loud voice (yes calls me an asshole) and go see my partner” (standing behind my car)
Officer 2: pats me down
Officer 1: "Cuff him! and put him in the back of the car"
Officer 2: "you made it a lot harder than it had to be."
Me: "how so?"
Officer 2: "keep your mouth shut you're speeding and that all you need to know. We’ll talk to you in a bit." And cuffs me and throws me in the back.
That second officer cuffed me so hard my wrists are swollen now and red. Takes me to the cop car and PUSHES ME in with out letting me get in on my own. And I watch them both go through my car without asking me. All this for speeding.:dunno:
If I get placed in handcuffs and pushed into the back of the cop car, don’t the police have to read me my rights? Which they did not. Or does that even count as being arrested?
He said I was doing 100+ in a 50 zone…it’s actually a 60 zone but wrote 50 on my ticket. He also didn’t clock me because I asked to see the gun and he said he estimated my speed and he’s only been off by 5kms…bullshit.
Both officers at some point call me names, Officer 2 types to someone on his computer “we just caught a fucker going about 140” I don’t call them names so why do they get to call me asshole (to my face) and fucker (on the computer) So all in all I have a pink ticket that says I was going 140 in a 50 zone. (that's bullshit) What are my options? Should I get a lawyer and then sue for the lawyer fees.
I was being so cooperative and nice and I still got treated like shit, I honestly think it has to do with the color of my skin, sadly but true.
:( why do I say this? This isn't the first time I got pulled over and searched for no reason and then let go with nothing? Maybe they aren't racist but still after going through that so many times it makes one wonder but I guess it isn't fair to say that. So sorry for the racist comment against the cops.:dunno: |

You will be able to beat this one easily, especially considering the illegal search. Get yourself a lawyer and the satisfaction will come when he chews them both new assholes.
Cases are few and far between where you are able to recoup your lawyers fees. It just doesn't happen very often. |

Saying "thats bullshit" as the first words out of your mouth to a cop is probably not a good idea, let alone arguing about the speed limit.
By the sounds of it, you weren't being cooperative.
If they have a reason/suspicion to search your vehicle they can. They don't need a warrant, nor your permission.
Complaining about handcuffs being to tight.... well..... dont give them a reason to be pissed off, and you wont get cuffed.

Cops CAN estimate your speed, and it will hold up in court. It did to me.
I garuntee you will waste your money trying to fight this in court.
I've fought tickets where there was cops in the courthouse testifying who werent even at the scene.
Moral of the story, "Yes sir, no sir, 3 bags full sir"... It sucks but thats how to deal with cops, and your more likely to get off on a ticket showing respect rather then fitting the typical ricer stereotype which reflects on all of us. |

It is a 60 zone, I said BS not the actual words bull shit and gave them everything they asked for. I was being cooperative and spoke with yes sir and in a nice normal tone. Where do you see just cause for them handcuffing me? You obviously don't know me, but Matt does. I don't ever do anything that fits in as a "Ricer stereotype" AND THEY HAVE TO READ ME MY RIGHTS which they did not...that alone should get me off the ticket. If that even counts as being arrested? |

You won't be able to recoup your lawyers fees but contrary to what Aaron says, I believe you have a solid case.
The only reason for them to search your vehicle would be under the assumption that you were carrying a deadly weapon or were hiding some sort of illegal contraband. In which case, it is false on both counts.
If you re-enactment was completely accurate, regardless of your retort towards the officers accusation, you never gave them a clearcut reason to search your vehicle. Privacy laws are intact for this very reason.
Considering the speed limit in the certain location was as you say it is, you will win easily. The officers inability to provide the proper speed limit much less an estimated speed will be one angle your lawyer will use to make the officers in question look like asshats.
Trust me, once its all said and done, the 500 or so dollars you spend on a lawyer will be money well spent. |

When I got my 50 over ticket, I used a criminal lawyer service. It cost me about 475 dollars all said and done.
I'm not sure what your best option is to tell you the honest truth. I think you should talk to someone more knowledgable in the field and explain the situation and allow them to divulge the proper course of action.
If it was me, I would probably use a criminal lawyer again. 0 demerits.

I don't suffer from the race card.. I do however suffer from DMMTTM. Driving more money than they make.
I don't know why but i've yet to be pulled over without attitude towards me being 21 and my car. Most ask me repeatedly whos car it is..
Which is stupid. A young guy in a Dodge Pickup wouldn't get that attitude yet most those trucks are worth more than my car. Guess math wasn't a pre requisite for cop school. |

Most the work i do is for Law Firms. After working for them and getting to know alot of them theres not a chance in hell id use most of them..
1.) Most of them aren't that intelligent.

Illegal search? Says who? Being cuffed illegal? Says who? Being read your rights? WTF? You've seen too many US movies. You're the kind of kid that cops take to the station and is screaming "where's my fucking phone call pig?"
Being handcuffed is being "detained" not arrested. Charter 10 clearly states that upon arrestyou must be informed of:
1) The fact that you are under arrest and whether it is closed or open custody
2) The reason for your arrest
3) That you have the right to retain and instruct counsel without delay.
But you weren't "arrested", so charter 10 doesn't apply. Did you at any time say you don't consent to a search? If you didn't, it will be trickier to prove the search was illegal. Did they find anything in their search? Anything at all might give them reason to claim "plain sight" and probable cause for a full search.
I'm not saying the ticket was just or the search was legal, I'm saying no one here can say whether or not it was because we have YOUR side of the story and YOUR side only.
There are 3 people you don't fuck with:
1- The person who pays you
2- The person who cooks your food
3- The police.
You fucked with the police. You tried to play tough and toss attitude, you got nailed for it.Whether the ticket is tossed or not, you lose. You lose time and you have a shitty experience. Not to mention the officers will remember your car and tell the story around the office, so you'll be watched more closely in future most likely.
I can tell you this with certainty though: if you show up in court with the same attitude you gave the cops and the same attitude you're giving in this thread (which is one of complete disrespect based on a complete lack of knowledge of the laws which you're claiming should protect you), no lawyer will save you.
Get a grip on your emotions. Quit blaming race, age, car, etc for anything. You were pulled over for a valid reason, lipped off, and were treated harshly for it. If it was racism, ageism, moneyism, jealousy, or anything else that assclowns are claiming cops have judged them for, you would have been treated like that for not lipping. Since you did lip, we'll never know. All we know is that cops were harsh to a lippy punk. Next time don't be a lippy punk and see what happens. |
