Most of you know my story about highway racing, aswell as the ticket for failure to produce valid insurance. Well.. Here's the story

I was stopped at Light 1, a neon was stopped at light 2. I turn right at light 3 to get home.
Light one turned green and I accelerated quickly. Light 2 turned green thereafter and the neon took off squealing tires. I got behind the neon and we might have been doing a little over the limit when we both turned off at light 3.
I noticed the blue and red behind us after we turned in. I thought it was the ground effect lighting the neon had. so I slowed and pulled to the right to allow for the officer to move past me. He didn't. He wanted me.
I provided old insurance, and ..... he nailed me for it (130(I think) dollar fine), fair enough, my own mistake, and I'll pay for it.
He also said I was "highway racing without a permit"
I was coming from a GAS station and wanted to get HOME. anddd I was highway racing.

Well, first of all. I overlooked my tickets. The one with the highway racing without a permit was dated for June 18, which is correct. The 'Failure to produce valid insurance" was dated for May 18.
Any way of fighting this ticket? I believe he had to wait for another police officer to show up to either Gock at my idiocy, or they had to show up to confirm the insurance ticket.
My point is.. another officer showed up. why? i'm not sure.
Secondly.. If an officer randomly says I'm guilty of racing, how do I go about winning my ticket. He doesnt have the other driver, or a speed at which I was driving.
Any suggestions?
I'm thinking between my high rpm, the neon squealing his tires, and his lights. he thought we were racing

And I would assume he'd also have his notes on why he thought you were racing (Tires squeeling, rapid acceleration, etc...).
I would also assume you were racing, but you don't want to admit it.
You can always fight the tickets, but if you were truly racing then why stand up in front of them and lie? |

I have insurance. I forgot to put the pink ticket in my car.
I have a letter from the insurance company stating I had insurance the entire time.
I wasn't racing. I wasn't even tryin to catch up to him.
Doesn't he need to post the speed on the ticket? |

Having insurance is one thing but you need to be able to produce a document to prove that you have valid insurance upon demand by a police officer.
Having no insurance is a mandatory court date and your vehicle gets seized and impounded.
Failing to produce valid insurance upon demand by a police officer is something like $240 bucks.
So its good that you had valid insurance but you are guilty of not having the documents on you at the time you were driving.
BTW, racing isn't all dependant upon speed. Like TrevorK said, it is based on the observations of the police officer. If you feel that you are innocent then by all means go fight the ticket in court. Just know that a ticket like this usually has a lot of evidence to back it up by the cop. What confuses me is that you were told "highway racing without a permit", as far as I know there is no such permit. Your ticket should state the section and short title of the violation. |

| Yeah, racing has nothing to do with speed, back in 98 my wife was racing an Iroc down Jasper ave, stop light to stop light.. getting 1 block each time and barely getting over 60km/h after the third race they both got pulled over... my wife got a "racing on highway for bet or wager" she never fought it, took the 6demerits and the fine as a badge of honor.. cause she kept winning. Anyhow... speed was never mentioned.. |

There is an organistation that the RCMP is involved with or piloting where they shut down a road, and have mini-drags so it becomes a proper event... thus letting people race in a "highway"
Maybe it has something to do with that :P |

Alright. I see what you're saying. My issue is that.. I was driving normally, the neon squealed his tires. I was merely behind him.
I wasn't even concerned with the neon ahead of me. I was more concerned with getting home cause I had work the next day. |

So basically, because a cop says I was racing, I am? I thought it was Innocent until PROVEN guilty...not...guilty until proven innocent.

Unfortunately this is the kinda shit you have to deal with when you get a dick cop..
They have the power to say black is blue and often theres fuck all you can do.. A good lawyer would get you outta this though..
The fact that he made no attempt to pull over the over car which actually did lose traction. |

Not a racing ticket... speeding ticket yes, but even then if they toss it he can re-issue.(I do believe) |

On one hand you have a ticket which is mostly invalid. The date in incorrect, and on that ground you could probably have it tossed before things ever go to court. Bring your insurance with you and visit the crown. Explain you had valid insurance and you received this ticket, but that the date listed is incorrect. Most likely, the crown will decide since you have and had valid insurance it's not worth their time and drop it.
On the other, you have a ticket which you believe is wholly unfair. And because you feel it's unfair, you should exercise your rights. Show up to court and plead your case. Dress nice, be polite and speak honestly.
And largely ignore the people who try to tell you the cop was just hassling you. He's not being "an asshole". He acted based on what he saw. Does that mean he was right? Of course not. And I doubt any cop would think they are. If cops could operate with complete independance we wouldn't need courts and judges. They would be able to assign blame and drill our punishments. Even hinting that you have that kind of attitude would not benefit you in court.

you honestly just filled me with confidence. I'm going to have the insurance ticket dropped. and I'll talk to a buddy whose apart of the RCMP. and i'll see what he says. maybe it can be settled outside of court.

You should probably turn down the music then. If you can't hear tires squealing, you probably won't hear a siren. T-boning an ambulance usually doesn't turn out too well. |
