Do I have a case here?(Long) - Click HERE for Original Thread

Well I posted about a month ago when I was hurt in a workplace injury , I broke my thumb blah blah blah..Anyways WCB paid me for 2 weeks off, and then they had a brilliant idea to send me back to office work.. using one hand

What do ya know? My hand in the cast starting hurting like a bitch, My other hand overstressed, I have nonstep headaches and anxiety, So I went to the hospital after 2 hours and they say "You should not even be working, stay off work until your Post operative appointment next week and see what he has to say"

So I do and I let WCB know this, they say im fit to work they can do nothing to help me, A week later comes by , my actual doctor says also "Dont work for another 2 weeks, then after that only work 4 hour days so you are not in pain or overstressing your injury or other arm..

So I told my case manager at WCB and he says it has nothing to do with my accident that my right arm is overstressed and im in pain from my thumb, He wants me working on modified duties NOW and hes not paying me.

So anyways I am supposed to be working 4 hour days now but I had prior plans to come down to Ontario for 3 weeks , but my doctors appointment isnt until january 15th so I'll be back in plenty of time to work some 4 hour day shifts..

Then after i see the doctor he will let me know if i can work full time..

So anyways they need to pay me full days up until December 12th and 4 hours a day (even if im not working the other half) while im away.. and up to my next doctors appointment..???

WCB says no way...,,, for anything past 2 weeks my injury... So they say "you can appeal this if you want to an adviser with WCB". But I just got the form and the advisor's want me to sign off saying "with this authorization, any and all other authorizations for any other representative are hereby revoked..."

Eeks, That kinda scares me considering they are still WCB and all they do is look at my case over again?...Should I hire a lawyer on my own? How can I get free advice first so I know I even have a case?

What do I do, Where do I start

File an appeal I had to I got punched in the face at work and had an emergency surgery and missed 2 weeks of work and they still didnt' pay me cause of all this other bs because of my braces.

but yeah if the appeal is ignored and you want it sped up talk to a lawyer I have found dealing with WCB is horse shit and they really dont give a flying fuck about you and your injures they are all about min days off and "modified" dudites .

I also broke my thumb i got put on modified duties . i had to sort mixed 5 gallon buckets of bolts into the separate bins it was horse shit but if i didnt' do it i didnt' get paid.

best of luck man

Ps hope you fingered out how to tie your shoes easy hahahahaa

where i work, they like to keep people working in any way possible, so if your unable to work the job, your on light duties until your better. the thing about my job is that its physically demanding, and theres plenty of bitch jobs for those that are injured. this way, it keeps the company happy cause they dont have to file a claim, and WCB happy cause they dont have to pay out, so i can see why they would want you to work.

if your unable to work at all, and WCB is telling you that they cant help you or any of that, get a lawyer to fight on your behalf for everything you deserve and to take them down a notch. their stepping on way too many toes and its time somebody stands up to them.

a co-worker of mine got injured on the job and reported it immediately to the exact time that it occured. at first, he never knew what it was until it started feeling a bit awkward, and then he went to the doctor and was told it was a hernia. he told my company what it was, and they filed a WCB claim on his behalf and they paid him 100% of his wage for the next 2 months after his surgury for recover until the doctor said he could work. when he came back to work, that was the time he was put back on light duties.

im not sure why my coworker didnt get the shaft, or why your getting the shaft, but i think you should consider legal advice. if he is able to get 2 months off with pay from them, you should be able to get however much time your supposed to get.

Document, Document, Document. Document everything, everyone you chatted with, times, days, first and last names. Document conversations and events, and the outcomes. This will help you.

I am pretty sure there are lawyers that specialize in workplace safety incidents.

I believe if you look under the yellow pages for a lawyer you might be able to find an agency that will give you a few min of free advice and point you in the right direction. I recall there being such an agency a few years ago, but that could have change.

You could call the Student Legal Services...I called them a few times, they are most helpful and will at least be able to give you some direction...

They might give you the run-around if you ask for last names, if so look for an employee number.

There are many ways to get last names with out getting the run around. :D It is all in how you ask. :D

“How do you spell your last name again Charles”
“I am not sure if you are the only Cathy there, but can I get your full name incase I need to call back and add to the file”

Etc,

Mike
