I take it his insurance did not pay to fix the car nor cover the rentals.

If it is both parties at fault he has every right to sue for damages. I believe the parents also would have a right to sue also.

Had he been doing the speed limit, hit and killed the kid, I do not think him suing the parents would be a big deal.

I wonder if the rules are regarding cyclists and pedestrians are in Spain. I wonder if the cyclist just appeared out of no where, or turned with out looking….. I am sure there is a lot more to the story than what has been written.

The fact that the guy who can afford an A8 has to sue the family of the guy he killed for less then 20,000 makes him an asshole.

you missed my point
this guy killed a member of that family...there was fault on both sides but the fact remains, one man is dead and this guy in the audi is responsible. Legally, he's been cleared, but if this guy had even a single ethical bone in his body, he would have at the very LEAST dropped the situation and let the family grieve.
Instead, he brings up the subject again not to apologize, but to sue this family for damages to his car.
He's got every right to sue, as a citizen and as a financial victim of this accident, and thats exactly what makes this mutherfucker the douchebag he is. He didn't HAVE to get the money back, most likely the repairs aren't going to bankrupt him (which is why i emphasized the fact he drove an A8) but he did anyways.

No.. I got your point. You are missing mine.

I like to look at all options.

It appears since this fellow is wealthy, he is being discriminated against for trying to recover $20,000.00 in damages. Had this guy not been wealthy, would he still be considered an asshole for trying to recoup $20,000.00 in damages?

I am not defending nor supporting his position, I am putting another point of view on it.

If you re read the article he is not sole to blame on the death. It was considered both parties at fault.

There is a lot more behind the story here than what has been released by the media. I do not know the driving and cycling laws of Spain, however I imagine they are different than ours.

If it was my family.. well…it depends on what they were doing…. Sure it would be sad, but if one of my family decided to ride their bike through a red light and got smoked by a car..well then they were an idiot for doing so.

It is an unfortunate incident, however with out ALL the facts it is difficult to pass judgment. Asshole or not, he has the right to reclaim damages as his family has the right to reclaim for theirs.
