So, im sitting at home after a not so good day of work and then i hear a door bell, im thinking its something not to bad, and its a lady standing there, she asks if my car is in the parking lot and point to it, i say yes.
She says she back up into in, now my car isnt small, its a 1987 toyota cressida so...kinda hard to miss.
She has many excuses and says its not her truck she was driving it was her friends and writes down all the info for insurance ect.
Now its not slippery out, my car is gold in color so its more then visible and it wasnt moving or parked weird, just parked where i allways park. Now i know its going to be over 1k in damage. the kicker is i got it with 169xxxk still shiny paint pretty much mint..and this bs happens, heres the pics.

Now im just wondering if in anyway the insurance company will try and say its 50-50 i live in a complex thing so its not public property. what do you guys think do i have her by the balls |

| ok nice. i wasnt even in the car also, and would she technically be admitting guilt if she came and found me? and how would i go about this she said the guy who owns the truck, which is registered to his company probley wouldnt wanna go through insurance, but i have all his info. can i make a claim against him after i do the police report? or is he the one who has to make the claim? or would the lady just be the one paying cause she was driving? ive never gotten into an accident. so this is all new to me:mad: |

| Your vehicle was parked legally and nobody was in it. It isn't going to be a 50/50 deal because you are in no way at fault. If you want to be nice, ask her if she wants to pay for the damages herself and settle outside of insurance. |

honestly, get a couple quotes, get her to pay you out an average of the quotes.
then buy a new light, rig it up and put the other $XXX in your pocket. once you buff out most of the scratches and get a new light it will be barely noticeable.
i had a minor altercation last week and it was looking like i was going to need my bumper cover repainted (100% other guys fault) i went and got some quotes the guy wrote me a cheque 4 days later. the best part, i was able to buff out 99% of the dmg.
its frustrating but if they are on the up and up by telling you, they should be on the up and up about paying for there mistake.

| its not just simple scratches. theres a dent right after the wheel well and around the housing where the light connects to the body its dented and pushed up so the 1/4 panel isnt lined up with the trunk anymore and the bottom of the light housing where it connects to the body on the metal its in fucked up shape cause the bolts stretched and pulled the metal before the light housing cracked and came off the car. and around the corners of the housing on the body the paint is cracked so itl;l have to get painted also. i think its like 3-4000 worth of damage and the bitch is i cant find anywhere for a replacement light and center piece:( but i filed the police report and i just need to go get some quotes, anyone know of a good place to go, if its not written off i want it to look like it was before which is pretty much brand new:( |

I don't see the issue, if she/insurance is paying for it then you're not responsible for finding parts. Let the shop fixing it deal with it, don't worry about it yourself.
If you are settling it with her, I would advise taking it to Toyota and having them provide a quote. Produce this quote to the lady, and ask her if she's prepared to pay this amount (And she might not realize the cost). If she is, you can then offer to get other quotes, however if done in a similar-quality shop they will most likely be very similar. This way you aren't wasting your time getting a bunch of quotes if she's not willing to pay that amount.
If you are settling with insurance then discuss it with them, you shouldn't have to take it to several shops if they are paying for it because the appraisal will indicate the approximate amount they are willing to pay. |

| so i got an estimate today done by robertson body works and its 2719.40+ or- so the car is going to be wrote off. now im wondering if i dont get cash whos insurnace should i go after cause the truck was owned by one person and the driver was someone else.:dunno: |

| Insurance covers vehicles... Not drivers. It doesn't matter that she was driving somebody elses vehicle. The insurance policy which covers THAT vehicle is responsible. |

Yes, you go through the owners insurance... Your car probably wont be touched with 3k in damages. Expect at best a $2k-2.5k payout just because of how old it is. You have first right of refusal if you want to buy your car back.
Pretty much they will write off your car, pay you some money, you buy it back minus a clean title for very little (or possibly nothing some insurance companies are nice), and you can make it your drift sluttt, DD, hooker rammer, w/e. |
