| ok i was pulled over last nite for a headlite out. The issue with the headlite is i was in an accident wiring was damaged. I am waiting for my car to go into the bodyshop for repair which is may 20th (which is a long time away but we know what winter wrecks are like). I explained this to the officer (alberta sheriff) and he had said that i still was breaking the law he then proceed to tell me that my plate cover was illegal (fair enough i got my hand caught in the cookie jar) and offered to remove it. He asked for my lisc and reg i gave it to him he moved to the rear of my car and started kicking my plate cover and plate. He proceeded back to his car and wrote me a ticket for $115 for the headlite out and $115 for the plate cover he came back issued the tickets to me told me what they were for. I asked what should my course of action be about the headlite he said he was unsure fair enough. I then asked why he kicked my car he said he could not see the plate. I reminded him i had offered to remove and surrender it to him. His response was your plate is obstructed. By this time i was getting mad!! Again i asked why did ya kick my car?? He walked back to his cruiser and left. So now i have 230 in fines a damaged plate (when i got home i looked its's bent severly ) and a damaged plate frame what course of action do i have if any ? should i park the car till the appt with the bodyshop ? The damage caused to the plate and plate frame and hatch is there any recourse for me to get reimbursed By the detachment? |

| apoligzies i was a lil miffed when i wrote the thread and it became a bit if a rant . i have edited it now and it makes more sense. i am going to pay the plate cover ticket ( it is illegal and i got caught ). I am looking to see if i can either fight the headlite (or if i should bother) ? The damage that was caused by the officer does the detachment have any liability ? |

| Tell your insurance company to pay the headlight ticket and give you a rental, as your car obviously doesn't meet the minimum requirements to drive on the street. |

Do you have a damage sticker on your car?
Was the collision that caused the damage reported? Is there a file number?
Do you have an appointment booked with a body shop to get the damage fixed.
If the answer is yes, I would argue the head light ticket in court.
as far as the the sheriff kicking your car, I would first call and speak with his supervisor, if nothing happens, I would then write a letter of complaint.
I would also fight the licence plate cover ticket and ask him in front of the judge why he kicked your car after you told him you would remove the plate cover. You may still be convicted; however, there is no additional fines for having the crown prove their case.
Just my 2 cents based on your version of the incident.... |
