So I got a speeding ticket today at around 12am, going down yellowhead at 110km well actually 107km. I turned off at 66st and started going 60km, there was a cop following me which I didnt notice,I pulled into my driveway and got out of the car, but the cop wasnt behind me nor pulled me over. As I was walking to my front door I heard a "honk" from a car that just pulled into the ally, and I looked and it was a cop car, the officer was waving his fingers telling me to go to the car. He told me how fast I was going etc etc, and asked for my drivers license. Then told me to stand in front of the police vehicles hood, as he wrote me a ticket. The officer did not ask for my insurance nor registration.
Well anyways the ticket was $264, hopefully there was no demerits added, as I forgot to ask."
The Reason I posted this is, is there a way I can reduce this ticket.
Thanks.
P.S reason I was speeding was going home with some medicine, that I picked up from shoppers for my baby. |

Yes, you will get demerits.
I would go and see the crown prosecutor and see if he will let you get off on the demerits. |

That's strange, I had the same thing happen to me and the cop pulled up and let me off with a warning because I was already out of the car and on private property (my drive way) well that's what i figure, but maybe he was just being nice to me...not sure. If the crown lets you off with no demerits then it would be because of this reason I would think. |

You should not have looked when he honked. I never look when someone honks. :D
Anyways, I would fight it. My question to ask the CP would be why the police officer waited until you pulled into your driveway, allow you to get out of your car, then honk at you to get your attention to give you the ticket. Why not the usual lights and or lights and siren the moment he caught you speeding? Why not pull you over on the street? Why did he not ask for insurance and registration?
Where was the violation cited for.. the yellowhead, a city road, your driveway? See where I am going with this. I do not know the distance from the yellowhead to your house, but if it is a few blocks away…..
Now my question to you is that if you did not see the police on the yellowhead, how did you know he was following you?

AFAIK, driveways are public property. If you want to be an ass, park in someones driveway. Last time I checked you are legally allowed to. :D

When I used to drive Yellowhead at midnight every night I would often see the police perched atop an overpass scanning cars as they passed. If someone was speeding a police cruiser came down the offramp and attempted to intercept them.
If the poster got onto an offramp before the police cruiser could safely pull him over, that would explain why he wasn't caught until he was at home.
Either way, my advice is to pay the ticket since you admit to speeding. Take it as a lesson learned, after all, accepting responsibility for your actions is what being a man is all about. |

I didnt notice that he was following me, I was just driving home, the cop had no sirens, it was one of those cars that didnt have one. I didnt even know because when I got out of my car there was no car behind me, and just when I walked through the front gate of my house, he rolled up and honked.
BTW I live like 6 blocks off yellowhead. And didnt I just earn 4 demerits, not 5.
Yellowhead speed limit is 70 right?
I was going 110. 110-70=40km.
I check the demerits breakdown here http://www.qp.gov.ab.ca/documents/R...isbn=0779717953
And it says
9) Speeding ‑ exceeding limit by over 30 but not more than 50 kph 115(2)(p) 53(5)(c)
4 Demerits |

Ya I dunno.. if I'm paying property taxes for the land that, that concrete is sitting in it better not be public property.. otherwise I want my taxes back or the Gov better be paying to fix it when it cracks... |

Are you allowed to change your oil and such on a public road way?
I think as long as no one calls by-law that you are doing it, then there should be no issue. Now... the home owner may freak out on you about changing the coolant and oil on his driveway.
My information is pretty old, not sure if the rules have changed or not.
My understanding is that you can not block a driveway as it is public access, but you can park in it. :dunno:

So does this mean that all photo-radar and red light camera tickets are also void? Um, no, thats not how it works. Please don't speak on behalf of the police when you don't know what you are talking about. Have a nice day. |

The rest of you,
If the officer does not ask for your licence and registration that fact alone will not "void" a ticket. It may cause problems if it goes to trial as the officer will have to state how you were identified. But by no means is the ticket VOID.
